Dear Readers:
There will be no "perp-walk" today. No trials and no running the Highway Superintendent out on a rail. Forget the tar and feathers while you are at it. The final N.Y.S. Comptroller's Audit of Yorktown has been released. You can read it at:
http://ncnlocal.com/ncnlocal_news/article_6ad899b0-c520-11e0-9d95-001cc4c03286.html
It was just as I wrote when the draft was released to the press:
http://ltpbazzo.wordpress.com/2011/06/25/in-my-opinionyorktown-not-run-by-crooks-unedited/
Yorktown is not run by crooks. The Highway Superintendent is not a crook. Yes, The Highway Superintendent did have pornography on his computer, but not the illegal, criminal kind. It was more likely the kind of dirty jokes my friends send me. The report suspects it was Eric DiBartolo's, but as anyone did have access to his computer, they could not say with absolute certainty.
The reports says Eric made suspicious purchases and conducted private and political business on his computer, however it did not come to the level of criminal and lays most of the blame on past Town Boards for lax controls and lack of rules. As I wrote, Eric in trying to get from point "A" to point "B" did what he thought best for the town, sometimes rules or lack of be damned. He did not do it to enrich himself, and at the end of the day, that's all that matters.
This audit and all the hoopla surrounding it comes down to as I wrote complacency, sloppy bookkeeping and a mentality of "this is the way we have done things in the past". This present board has set and proposed new rules to prevent this from reoccurring. Hooray for them.
However these proposals and new rues were set forth before the report and draft was released. Meaning the tax dollars and time spent on this was more or less a waste. This time and money was spent in my opinion, on a vendetta with the hopes of a "per-walk". Maybe if this present board survives this election they will not let personal animosity rule the day. Make no mistake this was driven by personal animosity.
Yes, Yorktown government will be better run in the future and that is a good thing. However we did not need the New York State Comptroller to tell us how. This is my opinion, you may beg to differ.

What is the "Tea Party" Really?
Dear Readers:
Question: Does ones very existence affect inter-state commerce?
This is the very question that lay behind the individual mandate (the requirement to purchase health insurance under penalty of fine and/or imprisonment) in Obama Care (the Affordable Care Act). The position of the Obama Administration and the Democrat Party is that your very life affects interstate commerce and a such can be regulated. To believe this is to believe that our Constitution has no meaning. That we are servants of government and that government dictates what are rights are.
The premise, the very first pillar holding up our government is in our founding document The Declaration of Independence. This pillar, that we are empowered at birth with certain rights granted us by nature and nature's God. "Life, liberty and the pursuit of happiness" are ours not by government decree but by birth and no government can take them away without our consent. This was a unique position, for at the time of our founding, the opposite was true.
This is the past, being servants of government, that the Obama Administration and the Democrat Party wish to take us. This is the foundation of Obama Care. To force perfectly healthy people into buying private health insurance with coverage dictated by the government, so as to subsidize people with chronic illness and pre-existing conditions. Because you live you must be insured.
This government position is understandable as they already dictate what kind of toilet we can have. What kind of shower head we can have. What kind of light bulb we must use. They usurped this power form us because we allowed it, as there is no existing constitutional authority to do these. Now they are grabbing the whole enchilada. Total control.
The reversing of this trend, to bring government back to being servants of the people, is what the "Tea Party" is about. To prevent a ruling class from taking permanent hold is what is behind this movement. You see the "Tea Party" is not a party per-say but a way of thinking. In spite of what Vice-President Bieden and Senate Majority Leader Reid say, it is not a party of terrorists. In spite of the media template, it is not a party of bigots, homophobes and xenophobes.
Taxes enough already. That is what the "Tea" in "tea Party stand for. They know that government takes enough money from us already. The know that every dollar taken is less for us to enjoy "life, liberty and the pursuit of happiness". They know that no congress can compel a future congress to spending cuts as every congress has the constitutional right to make their own budget. They know no congress has spent less then the last congress. They know that to believe that the Constitution has no meaning, that future cuts in spending is not a fallacy, that we are servants of the government is to be a fool. What the "tea Party" is not, are a bunch of fools. This is my opinion, you may beg to differ.

UN-FUNDED MANDATE MADNESS
Dear Readers:
Question: When is an un-funded mandate not an un-funded mandate?
Another question: When is an un-funded mandate perfectly okay with an elected official?
The answer to both question is when they are imposed on private business.
Finger Printing:
Tuesday (08/09/11) and Wednesday (08/10/11) were the second and third meetings between the Peekskill taxi industry and the Peekskill police who licence taxis. The purpose of these meetings is to review and upgrade the taxi code with input from the taxi industry. In my last post on this topic (http://ncnlocal.com/blogs/article_026dc924-c1e0-11e0-b33f-001cc4c002e0.html) I talked about some of the issues of concern to the taxi industry of which I am a member as I am part owner of a taxi company licensed out of Peekskill.
The first meeting a big bone of contention was the proposed rule change regarding finger printing of licensed drivers. As of now it is no longer required after five years of driving with a clean record. The new proposal is to finger print every year. The only case cited as the reason is a driver within ten years acquired a criminal record outside the jurisdiction of Peekskill. One case and every taxi driver must be punished. The cost of this un-funded mandate is $86.00 and you have to go to Mahopac to get this done. The problem when the licensing official and the same enforcement official are the police is that police come to think over a period of time is that everyone is a potential criminal. I would suggest that if this one case happened within ten years then move the five year requirement to ten years. Being that there was only one case cited, I believe this is a solution looking for a problem.
Limiting the Taxi Drivers Licence:
Does the desire of a cab owner to want to hire a driver out weigh the cost of administering taxis in general? We were told that if there are no limits on taxi driver licence's, that eventually the now cost of $125.00 a year would be increased (probably another $50.00) to cover the increased cost of administration.. So should owner/operators who have no intention of hiring a driver subsidize those who do with a higher fee? The reality is that if you ask most cab drivers, and they have been asked, they will tell you there are already too many driver already. This may or may not happen as there are court challenges to this in other jurisdiction a of this writing. Peekskill will wait for a ruling before this is implemented or not.
Taxi Liability:
In an idea coming out of City Hall according to my sources, a proposal to require a one million dollar insurance liability on all taxis was met with universal resistance by the industry. This epitome of un-funded mandates would raise the average insurance policy to $8,000.00 a year per car. That is if the carrier does not drop the insured which two companies that insure taxis said would happen.
We were told that this proposal is based on what White Plains and New Rochelle are doing. This is comparing apples to oranges as both those jurisdictions have fleets only. It is a matter of record that fleet drivers are more careless than owner/operators as a car owner is likely to be a safer driver.
We were also told that this is to protect the City against lawsuits resulting from a serious accident. As we are not at this time being provided with the information on how many lawsuits are pending or have been in the past initiated against Peekskill by people injured in taxi accidents, it seems to be a state secret, my guess is that there are one or none. This is another solution looking for a problem.
We are told over and over again that the city is short on man power because of the recession and upping taxes on the people would not be wise at this time. This proposal supposes that the taxi industry is recession proof. The we can take a $8,000.00 hit in increased costs. This is on top of the average increase in gas costs of $4,000.00 over last year and this is only August. Plus the increase in finger printing costs proposed and the increase cost of car maintenance needed to pass muster with the taxi inspector which is done twice a year.
Butt Out:
The initial reason for the review of taxi codes as was explained to me was to manage the amount of taxis and drivers on the road. This liability proposal goes beyond the scope of this review. It will put owner/operators and small companies out of business. This proposal by people in City Hall who neither drive, ride or can spell taxi should die the death it deserves. As this is an idea out of City Hall being based on other jurisdictions that have no relation to Peekskill, by people who do not know the difference, these people should butt out. This is my opinion, you may beg to differ.

PEEKSKILL RE-VISITS TAXI CODES
Dear readers:
Last Wednesday night (08/03/11) at Peekskill Police headquarters was the first of four meetings with the police and taxi owners and drivers. The objective is input from the taxi industry as the police (who licence taxis and drivers) review the rules and regulations regarding the taxi industry in Peekskill, and are upgraded to reflect the changing times. To remind you, there is a four month moratorium requested by the Chief of Police in which no new cab or taxi drivers licence's will be issued while this review is going on.
Turn out from the industry was higher than expected as this out reach was viewed with skepticism. The reason for this skepticism was because in the past, decisions were made by the licensing agent(police) then the taxi industry was notified of the changes (sometimes). There were some who viewed this as a fait-accompli. The Peekskill Council directed the police to include owners in the process, there was thought that this was window dressing to appease the council. So far this has turned out not to be the case.
Be sides the designated licensing officials, Detective Sergeant Ray Henderlong and Patrolman Chris Vaseos, both well know to the owners and drivers as fair and reasonable, included was Corporate Council Counsel dutifully taking notes as to research the legalities of topics discussed.
Reflections on the first meeting:
Even thought this was just the first meeting, some things I can tell you will happen when this moratorium is over. There will be drug testing. There will be a limit on cars and drivers. There will be an English test as a working knowledge of English is a requirement. There will be a limit on the amount of passengers per car. There will not be an increase at this time in licensing fees.
Still to be discussed are continuing fingerprinting every year you renew your hack licence. As it stands now, after five years fingerprinting is no longer required if you have remained free of violations. I would agree to this for new drivers only, grandfathering drivers not now required now to do so. Most of them, my self included are of an age where being nefarious is to much like work. Besides I do not need to spend $86.00 for someone to tell ,me what I already know, that I am Not a criminal. I would make an exception for drivers who have a criminal record already. One of the changes proposed on this topic was it will no longer be allowed for people with criminal record to obtain a taxi licence. This would be for new applicants only.
Car seats for minors. This addresses a problem that does not exist. Something I pointed out at the meeting. These are just some of the topics addressed in the two hour meeting. I will keep you informed of others at future meetings.
Enforcement Becomes An Issue:
This brings me to a related topic. As no matter how many laws and regulations are passed, without enforcement, they are meaningless. This particular bugaboo was brought up numerous times by various owners and the reply was the same, lack of man power.
This is a valid answer. There has been a reported hiring freeze in effect. This is to hold taxes down. However I have written that safety is the primary responsibility of any government, and the polticizing of it is just so wrong. There was 2 Park Rangers now there is 1. There was 4 Community Service Officers, now there are 2. Each costs roughly half the amount of a police officer. There were 62 cops, now there are 58. There were 3 Lieutenants one assigned to evenings, now there are 2 with none on evenings.
Even if you do not want to hire additional police officers, Park Rangers and Community Officers could be hired to do some of the enforcement now lacking. When I started driving a taxi 15 years ago, this was the case. The fact is the city must find money for law enforcement and cut from somewhere else if necessary.
Side Stepping the Property tax Cap:
I know Peekskill has money problems like every other municipality. I also know this as I obtained a memo from the City Comptroller Charles Emberger, stating all non-essential purchases are on hold. Only approved by the City manager Rick Finn or the Comptroller will be allowed.
Speaking of City Manager Finn, I want to thank him for proving me right that the recently passed property tax cap was a sham. It has been reported that Peekskill may face a 5% legal increase in taxes as pension and litigation costs were exempted from the cap. The two biggest drivers of tax increases were exempted, protecting the unions and lawyers.
This is not the first time Coumo and the Legislature has scammed us. When as Attorney General, Coumo pressed the Legislature to pass consolidation legislation, it exempted school districts and Counties. Again the two highest drivers of increase taxes, together they make up 75% to 80% of your property taxes. Again protecting the favored few. This is my opinion, you may beg to differ.

THERE OUGHT NOT BE A LAW
Dear Readers:
There is a letter to the Editor recently posted on PennysaverCommunity.com from Pat Conlon who is trying to open a new business in Peekskill (http://ncnlocal.com/ncnlocal_opinions/letters/article_151dc5c4-bc81-11e0-9c82-001cc4c002e0.html) He is asking for support in his initiative to lift an outmoded law banning the art form of Tattoo in Peekskill. I am here to offer mine. Full disclosure: I have know Pat for at least 10 years and he is a customer of Atom Taxi Inc of which I am part owner.
I realize the when the original passage banning tattoos was enacted, the industry suffered from a negative image. Bikers taking over towns and going after the women folk was the common template. That was then and of course like all stereotypes not exactly true. Like the billiard hall in the play "The Music Man" where "trouble started with a capital "T" and it rhymed with "P" and that stands for pool." People were scared into thinking a tattoo parlor invited trouble. Like I said, that was then.
This is now and even respectable people are getting tattoos. He has been trying to overturn this as he states "antiquated ban on what has become a respected contemporary art form." A year just trying to overturn a law and they are now just getting to a public hearing. This is the trouble with local governments (just ask Tom DiChiaro and what Yorktown has put him through just to open his business), they have no regard for the prospective owner's time and expense. After all, these officials have their meetings at night, after their work day is done and they have earned their pay. Well, not everyone works nine-to-five.
Pat has put forward a "law with high-standard requirements aimed at ensuring quality and allowing the safe practice of this art form". Taking from mhis letter, below are some bullet points outlining his proposal:
• All Peekskill tattoo artists must have a valid license obtained through the NYC Health Dept.
• Universal Precautionary steps must be adhered to at all times.
• No convicted felons may apply for a permit to open a studio in Peekskill.
• No tattoo studio may not operate in a residential area.
• No sale of tattoo equipment will be permitted.
• No piercing or other form of body modification will be permitted.
• No tattooing of minors will be permitted, even with parental consent. You must be 18 years of age. No exceptions!
• Local studios must incorporate an on-premises art gallery. This is a requirement aimed at attracting a higher caliber of artists who seek to open a studio/gallery in our area, bringing with them a focus on the quality of the artwork itself, as well as reinforcing this art form’s place within the greater arts community.
What he is proposing goes in my opinion above and beyond what should be necessary, yet there are objections from what I have been able to find out, from the religious community. As this is a legal, licensed and heavily regulated industry, I say religion should refrain from interfering in matters of state.
This is not rocket science and Pat's proposal is eminently fair. People should go to the public hearing on August 8, 2011 and voice their support for this endeavor. This should not have taken a year already, and after this hurdle is passed, it should not take another year for this business to open. This is my opinion, you may beg to differ.

THE POWER TO THINK
Dear Readers:
Besides the three unalienable rights granted us by our creator as expressed in the Declaration of Independence, there is a fourth gift granted us. This gift is what allows us dominion over all other creatures on Earth. I am not talking about the movable thumb. I am talking about the gift that unlike all ,other creatures on Earth that fear fire, it is the gift that allowed us to harness the power of fire. The gift is the ability to reason, to think.
The horse is faster, the elephant stronger, the rabbit more prolific, the butterfly more beautiful. The ability to think is what separates us from all other creatures. So why are we so willing to suspend this gift and allow ourselves to be stampeded into a fear and panic that in reality is not real. Our Washington elected and appointed officials panicked us into TARP and Stimulus 1. As time has shown, what they said to us was a lie. However it was an effective one as it allowed the Federal Government to steal from us and transfer to them almost 2 trillion dollars of our money we worked hard for. The kicker was that almost all that money was borrowed. Your children will be paying for this, even thought that money was spent last year.
No matter what has or has not happened when you read this, our credit rating was not in jeopardy contingent on raising the debt ceiling. It was and is contingent on controlling our debt, which no plan offered as of this writing addresses. The constitutional fact is that one congress can not be bound by the actions of another congress. In other words, all promises of future cuts are worthless. The historical fact is that all promises of future cuts made by a sitting congress were never honored by even that sitting congress let alone future ones. Both parties are addicted to spending our money. Money equals power to them and no matter the party, neither will relinquish power.
No matter what has or has not happened when you read this our debt service will have been paid, as it is the constitutional duty of congress to do so. The debt service is 29 billion dollars a month. Our obligation to seniors, the disabled and military is 50 billion dollars a month. The government takes in on average 200 billion dollars a month. Those bills would and will be paid.
Since 1948 Democrats have frightened seniors into thinking their social security checks were in danger in the hands of Republicans. Those checks have always come. In fact till this present Democrat President, they have always had a cost of living increase. This administration changed the calculus to show there was no raise in the cost of living in spite of the rise in gas and food prices. Those prices are not included in the cost of living index. Who then has hurt the seniors more?
I do not feel sorry for those who suspend the power to think and reason and allow themselves to be panicked. This fear card has been played for over sixty years, so it is not new. Those who still fall for it deserve the sleepless nights they bring on themselves. There is a place in hell reserved for those who play this card for political purposes without a care to what is does to others. The antidote for this scare card is to use the gift God gave you and think. This is my opinion, you may beg to differ.

I AM STILL HERE
Dear Readers:
I am still here. Here is now the "new", "old" Pennysaver. According to CEO Carla Chase and echoed by Bruce Apar, this is the format you wanted. Truth be told, you were not enamored with Pennysaver Community. Only in politics is the customer always wrong. In business you listen to the customer and that is what Chase Media Group has done. I have also been told that recognizing this damn recession is still going strong in spite of what the Obama apologists in the media are telling you, there is a new pricing structure designed to encourage business' ability to reach more customers in an affordable manor.
I am still here because of you. You have made this product, and it is a product as it is designed to attract readers to this publication, worth keeping. Your feed back to the powers that be convinced them that "In My Opinion" was part of your weekly reading. It is also your feed back that keeps the blog "Bazzo at Work"
(http://ltpbazzo.wordpress.com/) going strong. It is there that you read in your elected officials own words what they are doing, unedited. It is also because of you that Chase Media Group has continued production of the cable T.V. show "Bruce The Blog Goes Bazzo" starring Bruce Apar and your humble writer. It airs every Thursday at 10 P.M. on Cablevision channel 74 in Yorktown - Putnam Valley -
Bedford - Bedford Hills - Mount Kisco - Katonah - Lewisboro - North Salem - Pound Ridge - Purdy Station - Amawalk - Granite Springs - Lincolndale - Somers - Baldwin Place - Shenorock - Mahopac.
I am still here because Carla, Frank and Bruce still feel this column has something to say that's worth saying. Without their support there would be no Bazzo. I am still here because their loyalty to me deserves loyalty in return. At the end of the day, all you have is your word and your reputation. Once you sell that out, you have nothing.
In this crazy world where elected official are telling you the world as we know it will end unless you surrender to them your liberties and your children's future liberties, I am still here to tell you to " keep your head when all about you are losing theirs and blaming it on you."(IF by Rudyard Kippling) I am still here to keep you focused on the real picture and not the fallacy the media apologists want you to see. I am still here to tell you "Be at peace with God, whatever you conceive him to be. And whatever your labors and aspirations, keep peace in your soul. With all its sham, drudgery, and broken dreams it is still a beautiful world." ( Desiderata). I am still here and as long as Carla, Frank and Bruce want me, I am not going anywhere.

Tax Code Hypocrisy
Dear Readers:
The rich must pay their fair share. Republicans are choosing rich CEO's and their corporate jets over food safety and children's health care. Greedy corporations are using tax loopholes to avoid paying taxes. This is what we are being told by this administration and the Democrat leadership. This is also blatant hypocrisy by these same people.
Corporate Jets:
The tax deduction also know as "loophole" on depreciation was extended in the second stimulus bill voted on in 2008 and signed by this President. Remember not one Republican voted for this bill. So you have a Democratic Congress and a Democratic President extending this loophole, and now blaming the Republicans for it. You know who owns these private jets? Not just corporations and their CEO's, but members of Congress and the Senate. Nancy Pelosi, Jay Rockefeller, John Kerry to name a few. They passed a deduction that benefited themselves, but of course the stenographers in the media won't tell you this.
Loopholes:
The tax code was created to keep the middle class from accumulating wealth. It protects by various deductions and exemptions accumulated wealth from taxes. The tax code taxes income not wealth. The rich will not pay anymore significant taxes by increasing the tax rate. Wealth will still be protected or else Congress will be taxing themselves and that is not going to happen. The term loophole is being used to make you think something nefarious is gong on when in reality these are legitimate deductions, passed by various congresses to please the select few, such as your mortgage tax deduction. Or is that a loophole also?
Paying your fair share:
You know who wants the rich to pay their fair share of taxes? Timothy Geitner the Secretary of the Treasury, who admitted he evaded taxes till he was caught. Congressman Charles Rangel another person who evaded paying his fair share of taxes for years. John Kerry who parked his yacht in Rhode Island to avoid paying Massachusetts taxes. This is the ruling class in full hypocrisy. As it was once said, only the little people pay taxes.
The government does not have a revenue problem It takes in more than enough to pay for what it should pay for. It has a spending problem and they wish to use the politics of envy so you will let them borrow on your children and grand children's future and continue to confiscate the earnings of the productive class and transfer it to the parasites among us so they will continue to hold onto power. This is my opinion, you may beg to differ.

The Platform of Demagoguery
Dear Readers:
In a recent press conference, President Obama excoriated Corporate CEO's, their corporate jets and the depreciation tax credit they get. This tax credit amounts to 3 billion dollars over ten years. His budget proposal has 140 billion dollars in new spending which we have not the money for. So why focus on corporate jets? It is just another class warfare tactic. It is just another entity to hold in contempt. He is running for re-election and his platform is envy, demonazation and demagoguery.
What else can he run on? Another four years of high unemployment? High energy prices? Depressed housing market? The promise of high taxes? Out of control spending and borrowing? This is what his administration has brought us. He can't run on that, so he must play class warfare. It has passed the test of time as there are always people willing to count other people's money. The only question is, how does making the affluent suffer improve your life?
Life is not fair, and the only way government can make it fair is to spread misery. It plays to our lowest common denominator, not our highest aspirations. It must demagogue. Here is the list of entities we must hold in contempt so far: Big ,pharmacy, big box stores, big oil, corporate CEO's, fossil fuels, gas guzzler autos, talk radio, conservatives, FOX News, fast food, let's not forget, big tobacco. This is just the tip of the iceberg.
What we must embrace is big government and the future it wishes to rob from us, our children and grand children. Socialist government good, capitalism bad. Government can only give us mediocrity. Capitalism promises a better future to those who work for it. It offers more than just survival.
In 1989 it was yachts. They passed a tax increase on them. It decimated the domestic yacht industry. 70% went out of business. That meant good-bye jobs and the other businesses that relied on the yacht industry. This tax was repealed in 1993 and for good reason. Now it is corporate jets. Do you really want history to repeat itself? This is my opinion, you may beg to differ.

PLAYING NEW YORK VOTERS FOR SUCKERS
Dear Readers:
Gay marriage has passed. Property tax cap has passed with an exemption for pension increases and no unfunded mandate relief. They also passed a law to allow school districts to bond day to day operations and those bonds are exempted from the cap. Rent controls have passed Just to think only a few short weeks ago $200,000.00 a year qualified you for the millionaire's tax, now it qualifies you for rent relief. All these at the last seconds of the recent state legislative session.
All the "high fives' and complimentary comments regarding the coming together for the good of the state have come to an end. Let's not forget the strong leadership shown by our new Governor for getting his agenda passed. This is the picture that the main stream media has painted for you. If the state elections were to be held right now, wouldn't you just want to vote for your representative again? Suckers!
What you are not being told is why all the important stuff had to wait. Here is what took priority. First the legislature had to decide what the official state vegetable was. They decided our state vegetable is to be sweet corn. This was an appropriate choice as this vegetable is a hybrid produced by grafting. It is fitting that the state legislature voted a vegetable that exists by graft. I hope I am not the only one that sees the irony.
The other more pressing item on the agenda was to ban smoking on train platforms. Another restrictive law against a legal product and the people who use it. Never mind there is still not one autopsy to prove second hand smoke kills. Nothing to prove second hand smoke in the open air affects anybody. This law was to appease a group of people who do not like the habit. Also to protect the children. Yet it is the extortion called cigarette taxes that fund child health care programs. As long as tobacco and it's use is legal, non-smokers have no more rights in public than smokers in public spaces. This still about control and relegating smokers as the new outcasts like we treated lepers in the past. Freedom protects the unpopular. BTW: I smoke.
In a related story, the federal government has decreed that cigarette packs show gross pictures of the affect of smoking. Mind you, only one third of smokers die of causes directly linked to smoking. The other two-thirds die of causes no different that you and I. However if we are now extrapolate this to its logical conclusion as we turn the world upside down for a minority of users of a legal product, let us go down that road all the way.
Drinking alcohol is legal. Let us now put pictures of cirossis affected livers on every bottle and can. Driving is legal. Let us put pictures of car wrecks on every door. Sugar is legal. Let us put pictures of the grossly obese on every pack of candy and doughnuts. If you can do the first, you can do the rest.
When you allow government to infringe on the liberties of one group of people, you allow the government to infringe on the liberties of all the people. Eventually it get to you, and you look around and say "what happened?". That is the point. Why real concerns were on the back burner looking for the necessary votes, our representatives had no trouble getting support to pass laws that should never have seen the light of day. This is my opinion, you may beg to differ.

THE STATE'S CON GAME CONTINUES
Dear Readers:
We are being conned. This con game has been going on for years. My blog "Bazzo at Work" perpetuates this con game. To keep you informed, I re-print the press releases, unedited, from various candidates, political parties and organizations etc. regardless of party. The con are the releases from our state representatives.
These releases announce actions, important to you or various communities in their districts. Some are mundane such as which group gets a state award, or a road re-named in someone's honor. These are basically photo-ops for the politicians that keep their name in the papers. Other are legislation, either proposed or voted on, usually sponsored by the representative in question. It is these that are the cons.
For the most part, most of these proposals never see the light of day. They neither have support from their colleagues or like minded legislation in the other legislative body. They allow your representative to campaign on this proposal like it is the real deal. Nothing could be further from the truth. There is nothing real, there is no there, there. Any legislator can propose. It is by design to make them look like they are doing something to earn their pay. In reality, it is a con to get your vote. You see, with out support from the leadership, it will not come to a vote.
The others are proposals sponsored by your representative, voted on by that particular legislative body, but has no counter part in the other legislative body. This is the con that allows your representative to cynically tell you that have actually accomplished something. For instance, the recently announced passage of a bill to repeal the MTA tax. This was only passed in the State Senate. The Assembly has no intent on passing a like minded bill. There is nothing there other than a great photo-op. Without a similar bill in the Assembly, it can not go to the Governor for his signature that would make it real.
The final few are proposals that actually have a chance to reach the Governor's desk. These are the scary ones. These are the one's that pick your pocket or take away more of your liberties. These proposals always seem to have everything needed to become law. However, most of these are never announced till after the fact for obvious reasons. These votes are fait-accompli. Meaning their passage is assured. Meaning your representative will be allowed to vote against it, to fool you into thinking they are on your side, but it will still pass.
Yes, it is important to read these releases. It is important to see how your representative's mind works. What they think is important to you. What they are busy doing while this sate keeps going down the toilet. It is also important to remember that these releases for the most part are as phoney as the person sending them. This is my opinion, you may beg to differ.

YORKTOWN IS NOT RUN BY CROOKS
Dear Readers:
It is finally here. The municipal audit on the Town of Yorktown conducted by the Office of the State Comptroller has arrived in draft form. This is important in that it is not the final report complete with responses by those mentioned in the report. That however will not stop those with axes to grind, to use this draft as an act of fact.
That this report has seen the light of day was not intended by the Yorktown Town Board, even though the public paid for it. I want to commend who ever let the cat out of the bag. The public has a right to know, even in draft form what is going on with their government. This was a good thing and don't let anyone tell you otherwise.
This draft is complete with everything that sells papers, possible corruption and pornography. Let me say up front, I believe after all is said and done sloppy record and book keeping would be more likely than corruption. In efforts to get jobs done, not every "I" was dotted nor every "T" crossed and corners were cut. Possibly favoritism existed, but that does not equal corruption.
As for pornography, there are no allegations of kiddy porn nor sending of personal pictures ala Anthony Weiner. So all in all I really do not care nor do I think some one should lose their job over it. Also the draft does not say if that computer in question was in lock down or if any one could have access to it. Though in the end, the Highway Superintendent must be held accountable for its contents. Naughty, naughty, don't do it again.
What the report does not say is that there were no guidelines in place that covers some of the allegations. There now, however you can not back date a violation. Stupid things were done. People should have know better. More questions needed to be asked by those in charge before monies were paid out. If said monies were paid out, than who should the be held accountable? Still, I believe that if there were questions of legality, those in charge would have been more thorough. I think it was more, "this is the way things have been done" than enabling wrong doing. I say this as more of an explanation, not an excuse. Perspective is needed. Also I come from the point that I do not think this town is governed by crooks. Complacency is more like it.
I think that the Highway Superintendent's greatest strength is also his greatest weakness. He sees a problem and does his best to fix it. However he does not always do it by the book. That can be a good thing and a bad thing. It leaves one open to questions this draft raises. What is missing is that sometimes the book is wrong. Sometimes it is more important who can do the job best than who can get the job done cheapest? Sometimes they are the same, sometimes they are not. It is a fine line. What matters is intent. Was it for self-profit or best for the town?
Most of the points brought up in the draft have been vetted before. Many during the last time the Highway Superintendent ran for re-election. The people spoke and made their decision. It would be different if he could enact law or taxes. In two years people may have a change of heart. Finally after all this I must conclude, "who needs Sarah Paline, we have Eric DIBartolo?" This is my opinion, you may beg to differ.

HOLD ON TO YOUR WALLETS, HERE COMES THE EPA
Dear Readers:
Recently I warned you about the Obama Administration's EPA. I told you it was headed by people on the same page as he is on energy policy, or more accurately, energy killing policy. It is why I took his announcement on more drilling with a grain of salt. It seems I was not off base on this.
Back in January 2008 at a San Francisco Chronicle Editorial Board meeting during a discussion about energy and the environment, one of the members of the Chronicle Editorial Board asks then candidate and Senator Obama about alternatives, including coal. Here was his reply: "...we, uh, would put a cap-and-trade system in place that is more -- that is as aggressive if not more aggressive than anybody else's out there. So if somebody wants to build a coal-powered plant, they can. It's just that it will bankrupt them because they're going to be charged a huge sum for all that, duh, greenhouse gas that's being emitted." This was not widely reported at the time by the main stream media at the time including The San Francisco Chronicle.
Fast forward to June 2011. It has been reported in a recent US News & World Report Washington Whispers, by Paul Bedard that "Two new EPA pollution regulations will hit the coal industry so hard that hundreds of thousands of jobs will be lost, and electric rates will skyrocket 11 percent to over 23 percent, according to a new study based on government data." The EPA admitting the job losses, admitting the rising electricity rates and knowing these regulations could cost the coal-fired power plant industry $180 billion, is standing by these new regulations because of the "health benefits."
Remembering that corporations can only spend money collected from the consumer, meaning you, under this plan, electricity rates will skyrocket. In the middle of a recession, the EPA is implementing it -- and the economic damage to you and the job loses, mostly union jobs, is of no concern because, they're concerned about your health. I keep telling you that this administration is at an economic war with you.
This nonsense started with the hoax of man-made global warming and conniving politicians using this hoax to control your movements interfere with your life, take away your liberties and most of all separate you from your money. The United States Supreme Court enabled this with their ruling that carbon dioxide, that which you exhale, that which is an integral part of photosynthesis is a green house gas to be regulated by the government, namely congress.
So was born congress outlawing the incandescent light bulb starting next year. Where they got that power is as unclear as where they got the power to force you to buy health insurance. Congress trying to force you into cars you have to wind up in the morning, you've seen those cars, they are found in the circus with ten clowns exiting them. Actually is the electric car nobody wants. It also birthed the second greatest assault on liberty and your wallet "Cap and Trade" (the first being Obama care).
The problem was that even a Democrat controlled Senate wanted nothing to do with "Cap and Trade". So the EPA usurping the powers of congress is implementing these new regulations. Congress has the constitutional powers to stop this. The question is do they have the will? This is my opinion, you may beg to differ.

The Sky Will Not Fall
Dear Readers:
To raise the debt ceiling or not to raise the debt ceiling, that is the question. Whether tis nobler to continue to spend money we don't have? There-by robbing your children and grandchildren of monies they have not even earned yet. Or tis is better to reign in this uncontrolled spending and borrowing and get a handle on our future for the benefit of your children and grandchildren?
We were told only a few short weeks ago that if we did not raise the debt ceiling, our country would default on its debt service and become a pariah in the financial community. Like TARP and Stimulus 1 before it, we were being scared silly by those smartest people in the room. The ruling class seeing that panicking the people worked twice already, went to the well a third time.
What happened? This time the people were not fooled. There was an election in November where the electorate sent to Washington a group to Congress with instructions "no more spending, mo more taxes, no more borrowing." This new group knew the electorate meant it this time. They were on a short leash.
So the deadline passed and the sky did not fall. In fact they moved up the drop-dead date to August 2. Pretty much the same thing that happened when the world did not end also a few weeks ago, those prophets of doom moved up that date also. What happened is the treasury moved money around and the bills were paid.
Here is the truth, there is no drop-dead date. They do not have to raise the debt ceiling. They do not have to raise taxes. The sky is not going to fall...yet. Not now, not this year. The debt service amounts to 6% of the federal budget. It amounts to 10% of federal revenues. This means for every $9.00 spent elsewhere, there is $1.00 in debt payment.
So as we saw on the last deadline, you move money around and you cover the debt service. What is behind all the scare tactics by the treasury acting as the mouth piece for the administration, Democrat Party leadership and a few institutionalized Republicans is that they won't be able to continue to spend the 120 billion dollars a month it does not have. They won't be able to continue to borrow on your children and grandchildren's future.
They are scared they will have to set priorities. They do not want to do that. They established a dependent class as a voting base, and are scare to tell them at this time they are no longer a priority while they are still in office. Let someone else tell them, sometime down the road, but not now.
This uncontrolled spending of money we don't have must stop. This uncontrolled borrowing of money must end. The time is now. It is up to you to hold you representative's feet to the fire. It is up to you to protect your children and grand children's future and your present. Whether the sky really falls is up to you. This is my opinion, you may beg to differ.
