JUDGE AND JURY DUTY BLUES

Dear Readers:

Jury Duty:

Jury Duty is a civic duty. The question is should civic duty require putting one business or abode in jeopardy? This is not about me, but could be, for I am in the same situation. A person I know has received a summons for jury duty in White Plains. The penalty for not showing up is a fine of $1,000.00 and/or imprisonment for 30 days. You are paid a nominal stipend for your time. However that stipend is subject to tax and you must also pay for your own parking. So it is pretty much a wash. If your are like this person I know or me, a sole owner of a business, it actually costs you money to serve as being away from the business means no money is coming in.

For people not in the corporate or public sector world, this translates into no money, no pay. No pay means no ability to pay rent or mortgage. Yet the notice says "there are no exemptions from jury duty". Oh, you can lose a day’s wages and business trying to get a postponement, but that is only a temporary reprieve. Even that is not guaranteed. Remember you are dealing with a bureaucrat that gets paid no matter what.

Now we live in a county and state with nanny legislators that have created for your enjoyment or annoyance according to your perspective the following: The adult bike helmet police. The no smoking police. The calorie count police. The garbage police. The no idling your car police, just to name a few. Yet they could not find an exemption for honest, tax paying, hard working residents summoned to jury duty that would not put their home or business in jeopardy. It is time for these legislators to grasp the concept of no money no pay and do something to protect these people.

The Tax Man Cometh:

He cometh and with a vengeance. You see New York needs money and at this point they do not care from where they get it. Judge Joseph Pinto, a New York administrative law judge, ruled last month that all income earned by a New Canaan, Conn., couple is subject to New York state taxes because they own a summer home on Long Island they used only a few times a year. Now every dollar of income earned throughout the year is subject to New York residential income taxes whether New York is your permanent residence or not.

This is not the New York tax authorities. This is not Albany. This is a New York court, the New York State Tax Appeals Tribunal. Here is the scary reasoning of the judge. The judge ruled that this couple in Connecticut, that their Long Island vacation home qualified as a permanent abode because it was big enough to be. It was suitable for year-round living. The judge said”Whether or not the couple actually stayed in the home wasn't relevant." Whether they were in the state of New York did not matter. They could have been.”

Talk about taxation without representation. Remember, unlike other enforcement entities, when dealing with tax law, you are guilty till you prove yourself innocent. Now it does not even matter whether this couple could prove that were in New York or not. The result of this ruling will be hurt sales in New York's vacation-home communities. People will think twice about spending any summer time in New York. Also remember this, other states will reciprocate. This is my opinion, you may beg to differ.
