FEDERAL JUDGE RULES "OBAMA CARE" UNCONSTITUTIONAL

Dear Readers:

Judge Roger Vinson, a Federal Judge has ruled "Obama Care" unconstitutional. The entire thing is unconstitutional. Even though there are individual aspects of the health care legislation that could stand on their own, most of the legislation hinges on the "individual mandate clause". That is the clause that requires every American to purchase health insurance or face penalties including imprisonment.

He found this is an over reach of the powers of Congress innumerate in the "Commerce Clause" in the Constitution. Congress can not force citizens to purchase a product from a private enterprise nor not purchase a product. Unlike car insurance which you must purchase if you wish to drive your automobile, Congress can not order you to purchase a car. As the judge noted, if the congress can order the purchase of a private product for the public good, it can then order citizens to purchase what ever else it believes to be in the public good. This would forever change the principal of "limited government" as our founders envisioned. Our rights would no longer be ours by birth, but by government decree.

The reason why the whole act was found to be unconstitutional was Congress did not add a "severability clause". The severability clause says basically if any part of this is found unconstitutional, the rest of it remains okay. The judge in his ruling basically said, "There is no severability clause. I'm finding the whole thing unconstitutional." By ruling the whole act unconstitutional, there was no need for an injunction in spite of what you are being told. This ruling supersedes all other rulings on this act, even the two which upheld this act. Until a higher court either affirms or overturns this ruling the government is by law duty bound to cease enacting any part of this law. If they do continue to keep enacting parts of this act, they can be held in civil contempt by the courts, should any of the twenty-six states pursue this matter.

What you are now being told by supporters of Obama Care, is that unfeeling opponents of this act want to prevent seniors and children from getting medical care and health insurance now being provided. This is a canard to keep you confused about the real issue this court ruling rests on. The issue being is this act constitutionally legal. What supporters of this act want you to do is agree to throw out constitutional restrictions on the federal government for supposed benefits.

Where as now the federal government is the creation of the states, should a higher court overturn this ruling, the states and the people would forever be subservient to the federal government and they would be the dictators of what are rights are and are not. I am not willing to surrender the principal that our rights are unalienable, granted by a higher power and ours by birth. Not for government sponsored health care or any other reason no matter how well intentioned. For the true intention of this act is total government control over the life and death of its citizens. This is my opinion, you may beg to differ.

JUDGE AND JURY DUTY BLUES

Dear Readers:

Jury Duty:

Jury Duty is a civic duty. The question is should civic duty require putting one business or abode in jeopardy? This is not about me, but could be, for I am in the same situation. A person I know has received a summons for jury duty in White Plains. The penalty for not showing up is a fine of $1,000.00 and/or imprisonment for 30 days. You are paid a nominal stipend for your time. However that stipend is subject to tax and you must also pay for your own parking. So it is pretty much a wash. If your are like this person I know or me, a sole owner of a business, it actually costs you money to serve as being away from the business means no money is coming in.

For people not in the corporate or public sector world, this translates into no money, no pay. No pay means no ability to pay rent or mortgage. Yet the notice says "there are no exemptions from jury duty". Oh, you can lose a day’s wages and business trying to get a postponement, but that is only a temporary reprieve. Even that is not guaranteed. Remember you are dealing with a bureaucrat that gets paid no matter what.

Now we live in a county and state with nanny legislators that have created for your enjoyment or annoyance according to your perspective the following: The adult bike helmet police. The no smoking police. The calorie count police. The garbage police. The no idling your car police, just to name a few. Yet they could not find an exemption for honest, tax paying, hard working residents summoned to jury duty that would not put their home or business in jeopardy. It is time for these legislators to grasp the concept of no money no pay and do something to protect these people.

The Tax Man Cometh:

He cometh and with a vengeance. You see New York needs money and at this point they do not care from where they get it. Judge Joseph Pinto, a New York administrative law judge, ruled last month that all income earned by a New Canaan, Conn., couple is subject to New York state taxes because they own a summer home on Long Island they used only a few times a year. Now every dollar of income earned throughout the year is subject to New York residential income taxes whether New York is your permanent residence or not.

This is not the New York tax authorities. This is not Albany. This is a New York court, the New York State Tax Appeals Tribunal. Here is the scary reasoning of the judge. The judge ruled that this couple in Connecticut, that their Long Island vacation home qualified as a permanent abode because it was big enough to be. It was suitable for year-round living. The judge said”Whether or not the couple actually stayed in the home wasn't relevant." Whether they were in the state of New York did not matter. They could have been.”

Talk about taxation without representation. Remember, unlike other enforcement entities, when dealing with tax law, you are guilty till you prove yourself innocent. Now it does not even matter whether this couple could prove that were in New York or not. The result of this ruling will be hurt sales in New York's vacation-home communities. People will think twice about spending any summer time in New York. Also remember this, other states will reciprocate. This is my opinion, you may beg to differ.

GAS BABGS AND GASOLINE

Dear readers:

Gasbags:

Misdirection is a typical ploy of the Democrats and their stenographers in the media. As when the topic is illegal immigration, it is always phrased "immigration". Now it is collective bargaining. We are being misdirected into believing that union's collective bargaining rights are being taken away. As there is a difference between immigration and illegal immigration, there is a difference between private sector unions and public sector unions. Collective bargaining as we know it is not in jeopardy regarding private sector unions despite the fine history lesson in last weeks Knight Watch column. This confusion of the issue is by design.

As far as public sector unions are concerned, collective bargaining never existed. Both sides were never represented. The side selected to represent the tax payer, elected representatives, elected to represent themselves. They negotiated the best deal to get themselves re-elected. Elected representatives 10, 15, 20 years ago made untenable promises of future benefits that would have made Bernie Madoff proud. Both sides represented themselves, the bosses (the taxpayers) were never part of the equation.

The bill has now come due and there is no money to pay for it. That is the reality. The can kicked down the road has landed at our feet and the feet of our present representatives. That people planed their future on a politicians promise is truly sad and they were fools to do so. What did they think? That a political promise was worthless to everybody else but them? And you know what they say about a fool and his money. Those politicians played everyone for fools. They were the joker in a rigged deck of cards.

Gasoline:

The stenographers in the media would have you believe that the unrest in the Middle East is the cause of the present rise in gas prices. Not true, it is a symptom. The rise started last year when we started to see record prices in November, December and January. The root cause started in 2009 when the Obama administration canceled all contracts for domestic exploration and drilling that were initiated under President Bush. It was the easing of those past restrictions that stabilized the market and prices at the pump.

You have, even as I write this a seven year moratorium on all domestic drilling is still in effect brought to you by your friendly neighbor Obama, which this administration has no desire to lift. This in spite of the fact that a Federal Judge in Louisiana has held this administration in civil contempt for not lifting the restrictions for off-shore drilling in the Gulf. The judge found the administration's restrictions unconstitutional. You also have a lawless EPA creating by dictate, laws and powers not granted to it by congress, even the past one controlled by Democrats on coal mining and other forms of energy. Remember the Supreme Court gave the power to regulate green-house gasses to congress not the EPA.

The free flow of petroleum is in jeopardy, which is what makes the speculators nervous. You can lay this at the feet of this present administration and its flat-earth policies. By the way, do you know what Obama's answer to this present problem is? It is a tax on oil companies’ profits. A tax that will surely be passed down to the consumer in even higher energy prices. Or we may find the same thing when President Carter tried this, gas lines as the companies hold back supplies. Then you won't have gas at any price. In the end, I believe this is not by accident but by design. This is exactly what the President wants. This is my opinion, you may beg to differ.

THE TIPPING POINT HAS ARRIVED

Dear Readers:

New York City. New York State. New Jersey. Wisconsin. Pick one. Pick all. The fight is the same. We are in a seminal battle, a teachable moment. At the end, when the dust settles, we will find out who works for whom? In all these places the public sector unions control or at least before Novembers elections controlled either the executive or legislative branches, or both. You could, if you wish, add the federal government also.

In November’s election, the only poll that counts, people voted for a platform of no more taxes, period. They said we the people send enough money to our governing bodies, make do with that, and do not come to us for more. Do not ask for more taxes, fees, surcharges, or extenders. The difference between the public sector incomes (including health and pension benefits) and the private sector that pays for it has grown too wide, and we the people are tired of doing with less so you can do with more or retain the status-quo.

These brave elected officials have now done what was unexpected. They are keeping their promise. How novel! They are actually saying to their party leaders, this is what we ran on, and business as usual is over. No more wink, wink, nod, nod, we are in. We are not going to break our promise so you can retain the power you have gotten use to. We are going to propose and enact budget legislation that controls spending in some cases; balances budgets in others with out taking more form the people. We agree, they have given enough.

Base-line budgeting that is the starting point. In New York, as Governor Coumo explained, the built in increases are a thing of the past. He is saying to the public sector unions, you will get more money, it is there in his budget, but not what you want. Schools and health care are getting 7% more than last year. But no, they want the full 13% they were expecting. By knocking off 6% of a rate of increase, a budget projected to be 9 billion dollars out of whack, become 1 billion dollars out of whack, and not one dollar in increased taxes is necessary.

However these damnable public sector leaders and their puppets in the legislature are saying we want it all, people be damned! Keep the millionaires tax that is set to expire. What they are not telling you is this tax does not tax just millionaires; it taxes incomes of $200, 00.00 and up. This is not a tax on the rich, in Westchester it's a tax on the upper middle class, but middle class none the less.

Do not let the leaders of the public sector union leaders hide behind and hold hostage your children or grand ma and grand pa. This is what they are doing, this is what they always do, play the class warfare card at the same time trying to scare the beegeebers out of you so you will cave and put pressure on you elected representatives to give them more money, again as you do with less. Do not buckle. Coumo’s new budget is 132 billion dollars, which should be enough to run the state on. Let your representative do what you elected them to do. Let them fight for you. Become the boss again. This is economic war, and your future and the legacy you will pass to your children is at stake. This is my opinion, you may beg to differ.
