THE OLD STONE CHURCH SAGA CONTINUES

I know this weeks NCN also has an updated story on the "Saga of the Old Stone Church" you should and can check out on line. I have been and continue to be on record as favoring the opening of this business. I also said it was a mistake to go to court. If as I am lead to believe that this present town government has majority in favor of opening this business, then I think they interested parties should sit down and meet. Cases are settled out of court all the time, this should be one of those times. This should not be a case of who blinks first, but of who has the best interests of the town first.

I have grown tired of towns such as ours (I am a Yorktown resident) using zoning codes and traffic studies as an end run around the rights of private property owners. Right now you have new construction going on right next to Wallour's. They are going to build a bank on Mohegan Ave. Apparently traffic has no baring on these new projects. It insults one's intelligence to think that the proposed winery could have a worse adverse affect at these already approve projects. It is starting to look like in my opinion, the winery's owners civil rights are being abused.

There is nothing to dangerous that it cannot be talked about. It is time for our elected officials to sit down and talk, lawyers advise be damned. In this economy it makes no sense that a job creating, sales tax generating and other taxes paying business should be prevented from opening. This does not have to play out in court, nor should it. I implore our officials to think about what's best for the town instead of what's best for them.

The Winery lawsuit continues to move forward, albeit very slowly.

In the interest of trying to move this process out of litigation and save both the Yorktown Taxpayer and myself legal expense, my attorney and I have contacted the town and the town attorneys to see if they were interested in talking. As I expected, the Town refuses to meet. We have a serious problem with the Yorktown leadership. They are currently over budget by $100,000 just on legal fees and they clearly don't care much about the cost of this litigation to Yorktown residents.

“Town attorney John Buckley reported an unanticipated “triple play” that has caused the town to overspend it's $20,000 2008 budget line for outside legal services. To date, $117,000 has been spent and there are substantial additional bills that will have to be paid by the end of the year. Mr. Campisi noted that if the town wins the winery/old stone church case, it could get some money back. Some of the money spent for tax certiorari cases were for preparing for trials that never opened because the cases were settled.”

I am planning to have a question and answer session on the Winery and the lawsuit in the coming weeks. Please let me know if you would be interest in attending.

A MESSAGE FROM YORKTOWN COUNCILMAN NICK BIANCO:
RE: SCHOOL TAX REBATE UPDATE:

Our town assessor was notified by the State of New York Office of Real Property that the School Tax Relief (STAR) exemptions for the 2009-2010 School Year will be reduced again by 11 % for enhanced and 10% for basic. This means that even if our four school districts in the school year 2009-2010 go with a O % tax increase every homeowner will see a $125.00 to $400.00 tax increase in the Town of Yorktown and I am sure throughout Westchester and Putnam County.

I have notified our state representatives about my concerns. The ironic thing is that this process began in April 2008 when there was little or no concern of a financial meltdown. While we are constantly being told that STAR is not being cut. The reality is that it is.
2008-2009 Enhanced Exemption $4,020; Basic $2130.
2009-2010 Enhanced Exemption $3580; Basic $1900.
