In My Opinion

"There is no more than three years or so of proven reserves." So said President Obama a couple of weeks ago when asked about the continuing rise in gas prices as he was explaining why domestic drilling was not the answer. This response was disingenuous.
The three-year data on gas prices comes from the Society of Petroleum Engineers. It is based on how much oil the government allows access to. Given our government's moratorium on domestic and off shore drilling, plus the numerous state road blocks towards self-sufficiency, the three-year estimate becomes a self-fulfilling prophecy.
The truth is were these restrictions to be lifted, there is over two hundred years of recoverable oil and natural gas, and when the entire western hemisphere is added, we would not need one drop of Middle Eastern oil. Just the announcement that these restrictions would be lifted and you would see an immediate calming of the commodities market which is the driving force behind this climb in gas prices. The other is the de-valuing of our currency by the Federal Reserve making the dollar worth less and less.
You see it is the threat to the free flow of petroleum that causes the market to fluctuate. When you remove that threat, the fluctuation would ease. Our biggest problem is we have a government with an energy policy, if that is what you call it, which is at war with the American economy.
To believe we can "green" or conserve our way out of this is pure folly brought to you by those is power that wishes to control and restrict your movements. Think about it, their alternatives either by those wind up new cars that plug into you house outlet that need re-charging at under 60 miles (restricting movement) or mass transit, where you come and go on a government schedule (controlling movement).
The answer is now and for the foreseeable future is lifting restrictions on domestic and off-shore drilling. Petroleum fuels ours and the world economy. That pesky fact does not go away. It is time for our government to stop its economic war against its people.
This is my opinion, you may beg to differ.

THE YORKTOWN ELECTION SEASON BEGINS NOW!
Dear Readers:
Let the games begin! On Wednesday (04/20/11) the Yorktown Republican party nominated their candidates for this year’s race for Supervisor and Town Council.
Even though it is as of this writing not official on the Democrat side, we are having a re-match in the Supervisor’s race between incumbent Susan Siegel on the Republican side and former Supervisor Don Peters on the Democrat side.
We have now had two years to judge two distinct styles of governance. Don Peter’s who had top notch people under him and let them do their jobs, and Susan Siegel who micro-managed. There were times when she could be confused with Highway Superintendent, Chief of Police and Town Lawyer. As with most once in office, both candidates had a problem with the definition of “open government”. It will be interesting to see if in November, the voters will continue with the present “Kingdom Of Yorktown” or want a return to the “Town of Yorktown”.
On the Republican Council slate, we have a continuation of the “old guard” with the re-nomination of incumbent Nick Bianco and a familiar face, David Paganelli, owner of the Traveler’s Rest who ran as a Democrat two years ago. As I have said many times in the past, in local elections, party affiliation is not that big a deal. Paganelli, is a case in point. No matter the label, he is a business man who acknowledges and has seen first hand Yorktown’s unfriendly business culture and wishes to use his experience to change that perception so those vacant buildings on 202 and Rt. 6 will again be adding to the town coffers’ through sales tax revenue.
Again though not official, on the Democrat side will be another member of the “old guard” Incumbent James Martorano seeking another term on the council. I have been told by high ranking members in the Democratic circles, that the other open position will be filled by a woman. Two years ago, voters in Yorktown rejected old guard representatives Lou Campisi and Matt Metz. As the business climate in Yorktown has yet to improve, not everything can be blamed on the recession; will voters look in another direction and reject the last two members of the old guard Nick Bianco and James Martorano? This is my opinion, you may beg to differ.

ONLY YOU CAN STOP THE RULING CLASS
Dear Readers:
Even a stopped clock is right twice a day. Here is what former House Speaker Pelosi said Monday (04/11/11) "To my Republican friends: take back your party. So that it doesn't matter so much who wins the election...” She is acknowledging the dirty little secret I have been trying to warn you about. There is a ruling class and party affiliation does not matter. Once you are in, you are part of the ruling class.
She is telling the Republicans to jettison the "tea party". That's you. You see the Tea Party is not so much a party than it is a true grass roots movement. That being the case, you the tax payer are a danger to the ruling class and their continued quest for total control over everything you do. If you are marginalized then the ruling class can do what they wish without restrictions, such as that pesky Constitution that the ruling class feels is a straight jacket, which it was designed to be.
Look at "Cap and Trade" which the ruling class wishes to use to control your movements. Class warfare regarding the tax code. His Majesty Obama last Wednesday (04/13/11) came down from the mountain to tell use that those that achieve success need to pay more taxes, calling it their fair share. The top 3% of wage earners pay 60% of the taxes now. 44% of the people pay no incomes at all, and with the earned income tax credit, get most is not all their FICA taxes back. How fair is that.
Let's not forget "Obama Care" which is the greatest assault on liberty, where the government forces you to purchase health insurance under penalty of fine and/or imprisonment. Also if you do not think this is the ruling class' attempt at control over life and death, look no further that those continuing resolutions passed by Republican controlled Congress that continues to fund "Obama Care" to the tune of 100 billion dollars this year. The Republicans could have de-funded it, and chose not to. Yes, they too are part of the ruling class now.
So you must get your hands around the fact that you, the tax payer are an enemy of the state and must be neutered. Through various laws, codes, regulations and taxes the ruling class is trying to do just that. Last November, you sent a message. It is time to contact your representatives and tell them they are on a short leash. You will not be neutered or dismissed. This is my opinion, you may beg to differ.

THE TRUTH ABOUT THE 2012 FEDERAL BUDGET PROPOSAL
Dear Readers:
Rep. Paul Ryan (R) has released Congresses' proposed 2012 budget. What you ask, 2012? Then what is all this caterwauling about continuing resolutions for the 2011 budget? Well, last year when the Democrats still controlled Congress abdicated their responsibility as it was an election year and did not produce a budget. So now it has been left to the new Republican majority to keeps government functioning.
As we have seen with both budgets on the table, the Democrats are not interested in an honest exchange of ideas. They are not interested in putting their own proposals on the table as they have none. No their play book, right out of Senator Schumer's overheard phone call giving marching orders to his fellow Democrats, is distort, demonize and demagogue. The primary casualty of the Democrat play book is the truth. You will also notice, with the Democrats walking out of Legislatures across the states rather that accept the results of last November’s elections, political cowardice is part of their DNA.
Rep. Ryan's budget essentially brings government spending to 2008 levels. These levels were from a budget passed by a Democrat controlled Congress. Back then the Democrats pronounced this as the best thing since sliced bread. No old people were going to die or eat dog food. No kids were going without health care of proper nourishment. Now when a Republican wishes to go back to those spending levels, Armageddon is just around the corner.
This play book by the Democrats is the longest running show in history. The joke is that these same Democrats did not have the guts to produce a budget last year, do not have the guts to offer an alternative. No they have the nerve to think they should have any credible standing in this discussion. Ryan and the Republicans took on this responsibility head on as they realize real people are affected. To the Democrats this is just another political opportunity to score political points with their base. As for you, the hell with you.
The biggest lie being told off the bat is that those mean old Republicans are going to take Medicare from the senior citizens leaving them to die in the streets. The truth: nobody 55 and old losses Medicare as we know it. Those younger will be offered the same plan that those in Congress have, and you will notice they are not dying in the streets.
The other biggest lie is that those mean old Republicans are going to kill the poor and children by destroying Medicaid. The Truth: under this plan, control of Medicaid qualifications returns to the states where it belongs. All but 17 out of 50 Governors want that control. These Governors know best what their citizens need better than Washington. To believe the Democrat argument is to believe these 33 Governors want to kill off their own people.
I would advise you to pay no heed to those Washington Democrat cowards who have no alternative to offer, other than to distort, demonize and demagogue. It is time to cancel this longest running fiction. This is my opinion, you may beg to differ.

THE TRUTH ABOUT THE NEW STATE BUDGET
Dear Readers:
Welcome to Pennysaver Community. For those of you who are new readers of this column, my name is Anthony J. Bazzo, part owner of a taxi company licensed out of the City of Peekskill. I am also the conservative voice and commentator of all things political. Before you get caught up in the euphoria of the recently passed state budget, nothing really happened. Oh yes, they closed a deficit of 10 billion dollars with out raising taxes and it was on time. That it was on time and a big deal was made of that is because we live in a state with a dysfunctional legislature. An on time budget is what they are paid to do. That this is an exception and not the rule is actually quite sad.
As for the 10 billion, that was done by lowering the projected rate of growth from 13% to 7%. You see there were no cuts as third rail expenditures, education and health care did get more money than last year. It just was not as much as was wanted. In a recession such as this, a zero base line budget should have been the order of the day. Zero base meaning nobody get more than last year.
What did not happen was real tax relief. Remember over the last two budgets, 11 billion dollars in new taxes was added, plus numerous unfunded mandates enacted. None where repealed. Do not count the so called "millionaires tax" as that was set to expire at the end of the year, so those affected by it this year, those making two hundred thousand dollars and up are still paying it this year. The “Tri-borough Amendment” where public sector unions still get paid w/ scheduled raises even though their contract expired still stands.
All the promises, property tax caps, and budget caps, ignored. Caps on medical pain and suffering awards, not there. Ethic reform, hah! Like that would ever happen. No, all they did was keep the status-quo and want you that thank them for not giving you their yearly shafting. Well I am not going to thank them for being slightly less money grubbing. They still took care of their own.
Actually you should get angry that they played you for fools again. Real relief, a more business friendly tax codes are still the things dreams are made of. The only way to make them a reality to keep on your representatives and hold their feet to the fire. It is only next year when they must face you again. Show them that if things do not really change in fact not in rhetoric, the last thing they will want is to face you now and next year. This is my opinion, you may beg to differ.

NO MATTER WHO IS RIGHT OR WRONG, THE TAX PAYER IS STUCK WITH THE BILL

It seems a little clarification is necessary in regards to last weeks In my Opinion “The Death of Liberty”. After speaking with both Legislators Burton and Kaplowitz, while both agreeing the did vote for the override, they (and Legislator Harckham) were not in favor of siding with the CSEA against the county. So let's see where this leaves us. Not in dispute is that County Executive Astorino canceled the contract with the State to administer the County Section 8 program. As there were no longer jobs to administer this, Astorino eliminated the 38 positions. The Board of Legislators upset that Astorino did not say pretty please put back into the budget proposal the 38 jobs even though those positions no longer existed. Astorino then vetoes this and the Board overrode this veto. The CSEA which is the union that represents these workers then sued the County executive and Board of Legislators to put these 38 people back on the public dole even though those positions no longer existed.
The county attorney, Robert Meehan, recused himself from representing the county because of a perceived conflict of interest between the County Executive and The Board of Legislators. The perceived conflict being that the County Executive and the Board of Legislators were on different sides. Being that both the CSEA and Board of Legislators (with their veto override) wanted those positions back on the payroll and the County Executive did not.
The Board of Legislators released a statement that said ”On Monday night (03/28/11), the County Board of Legislators approved a resolution waiving any conflicts on behalf of the County Board in this matter, ultimately allowing the County Attorney to represent the County Executive, which would eliminate additional taxpayer expense”

It seems a little clarification is necessary in regards to last weeks In my Opinion “The Death of Liberty”. After speaking with both Legislators Burton and Kaplowitz, while both agreeing the did vote for the override, they (and Legislator Harckham) were not in favor of siding with the CSEA against the county. THE RULING CLASS IS AFTER YOUR MONEY AND LIBERTIES
Dear Readers:
When the coroner's report is written on the demise of liberty, the cause of death will be listed as apathy. Yours, you the voter's apathy. You fall for the same garbage time and time again, and then vote for those who spew this garbage time and time again. Wake up! The ruling class, regardless of party is at war with you and they are after your money and liberties. Take a look at the following:
CSEA Is Suing The County:
That means you. One of the first acts Westchester County Executive Astorino did was cancel the contract with the state to administer the Section 8 housing program. His argument was that it cost more to administer than the county was reimbursed. The Board of Legislators, well actually the Democrat majority, voted to restore the program even though there is no longer a contract. Astorino vetoed this, and the board overrode that veto.
Astorino then laid of 38 workers who administered this program the county no longer administers. The board of legislators by reinstating this program that doesn't exist is trying to keep on the county payroll these 38 people whose positions are gone. Basically giving 38 people a pay check to do nothing. The CSEA is suing the county to keep these workers on the payroll.
We are the county. The CSEA is suing us. The Board of Legislators, actually the Democrat majority is siding with the union against us. Here is the point; Democrats Peter Harckham (District 2), Mike Kaplowitz (District 4) and Bill Burton (District 1) are fighting to keep on the payroll 38 people who will have no job to go to. The CSEA supports these people with campaign donations. This ruling class has chosen the money over you. Keep this in mind when they tell you how hard they are working to make living in the county affordable for you.
Only The Little People Go To Jail:
Wesly Snipes is in jail. Richard Hatch (the first winner of Survivor) is going back to jail. Rapper Ja Rule faces jail. Money manager Kenneth Starr is in jail in the general population. All these are for tax evasion. Former New York City Council President and member of the ruling class who along with Kenneth Starr evaded 2 million dollars in taxes get three years probation. Congressman Rangel, supreme ruler in the ruling class evades taxes and Congress says naught, naughty.
The Daily News did an expose on member of the New York City Council who have been getting STAR rebates by claiming as primary residents homes not in their district, while claiming on their campaign forms that they live in the district they represent. All members of the ruling class, all still serving.
Apathy by the voters allows these things to happen. You voted for these people or the people who protect them. The only way to destroy the ruling class is to hold the enablers to the same standards as the perpetrators. They must all be retired to private citizen. If you do not demand equal justice, then nobody as you can see will. The ruling class will always protect themselves, people be damned! This is my opinion, you may beg to differ.

LIES THE TEACHERS UNION ARE TELLING US
Dear Readers:
Enough already! I told you that you were going to be lied to about Coumo's proposed cuts to education. It has come to pass. The commercials are running with children telling you that mean old Coumo wants to harm their educational choices because he wants to give tax breaks to millionaires. These commercials sponsored the teachers union are using children to lie to you. Some example they are sending our youth. You try to teach you children it is a sin to lie, and these damned educrats tell them it's alright to lie if it protects public sector union's ability to pick their parents pockets.
There are no cuts! Get this through your heads. There are no cuts! Your tax dollars are funding education at a greater rate than last year. However instead of an increase of 13% it is an increase of 7%. No matter how you look at it is an increase! The kicker is that 85% of this increase goes to fund salaries, health benefits and pensions. Not your kid’s education! Oh, they tell you we are going to cut out art classes, after school activities etc. This is because they want you to hurt. They feel if they hurt you enough, you will join in their class warfare curriculum.
You see it is not that mean old Coumo, he does not have a printing press in his basement, it is mean old you the tax payer, but the unions don't dare say that. They are saying ignore the moniker public servant, you the tax payer serve us, and we will use the media, your children and the courts if necessary to protect our interests which out weigh yours. On top of that, we the unions will not let truth get in the way.

Teachers who have been found to have acted in various ways inappropriately in the class room and/or towards children under their care.
Wake up people, the kids, your kids are the last thing they wish to protect! So when you watch those lying commercials where the use of children for propaganda purposes is the order of the day, get mad. Get mad at the educrats that are using children to promote class warfare. You are being lied to and shafted. They are using your kids. Don't fall for it. On this issue, support the Governor who in this case is on the right side of the issue. This is my opinion, you may beg to differ.

Enough already! I told you that you were going to be lied to about Coumo's proposed cuts to education. It has come to pass. The commercials are running with children telling you that mean old Coumo wants to harm their educational choices because he wants to give tax breaks to millionaires. These commercials sponsored the teachers union are using children to lie to you. Some example they are sending our youth. You try to teach you children it is a sin to lie, and these damned educrats tell them it's alright to lie if it protects public sector union's ability to pick their parents pockets.
There are no cuts! Get this through your heads. There are no cuts! Your tax dollars are funding education at a greater rate than last year. However instead of an increase of 13% it is an increase of 7%. No matter how you look at it is an increase! The kicker is that 85% of this increase goes to fund salaries, health benefits and pensions. Not your kid’s education! Oh, they tell you we are going to cut out art classes, after school activities etc. This is because they want you to hurt. They feel if they hurt you enough, you will join in their class warfare curriculum.
You see it is not that mean old Coumo, he does not have a printing press in his basement, it is mean old you the tax payer, but the unions don't dare say that. They are saying ignore the moniker public servant, you the tax payer serve us, and we will use the media, your children and the courts if necessary to protect our interests which out weigh yours. On top of that, we the unions will not let truth get in the way.

Westchester Legislature’s new chair looks to play landlord via Section 8 legislation

Newly minted Westchester County Board of Legislators Chairman Ken Jenkins, the wingman of the liberal wing of county Democrats, will, according to my sources, resurrect Tuesday night (19) at the county board meeting what everyone thought was a dead issue: “Source of Income” legislation.
In a nutshell, this law would force landlords to accept low-income Section 8 applicants whether the landlord wants to or not. Below is a reprint of my column on this topic first published April 2009, plus a letter to the editor of NCN that same month. Both address the dangerous impact of this legislation.
As you can read more about in my column that will appear in this week’s Jan. 20 NCN on page 10 (“In My Opinion”), Ken Jenkins is tone deaf to the message voters sent to county government in last November’s election. This legislation is just another example of that tone deafness.

IN MY OPINION: County has landlords in its sights

The Westchester County government is at it again.
It has already proven it is full of cooking experts, as in the no-trans-fat law. It has already proven its members are dietitians (see the new calorie-count law). And it is full of expert gardeners as illustrated by the new no-phosphorous law for fertilizer. We also know the government is expert in the art of bloated government and deflected blame. It is now going to show us it is an expert landlord. On the agenda is a new piece of legislation dealing with source of income. What lawmakers wish to legislate is that landlords cannot refuse to rent to people because of where their rent payments come from.
The stated goal of the legislation is to prevent people who receive disability income, alimony, Social Security and Section 8 housing allowances from being denied available rental housing. Doesn’t that sound so caring, going after those “bigoted” landlords who only want people who can pay rent to live in their units. The only problem with this is, after reading all nine pages of this legislation, what the government is really trying to do is force control of private property by making itself a de facto partner in the rental property without contributing one dime of its own in the effort.
You see, the government relies on a report by the Associations of Community Organizations for Reform Now (ACORN) that states that Section 8 recipients have fewer housing options than those not on Section 8. They do not like the fact that poor people cannot afford to live in Scarsdale. This is the same ACORN that has been accused, and in some cases found guilty, of voter fraud. This is the group some legislators are relying on for expert information.
This does not include Mike Kaplowitz or George Oros. I have talked to Legislator Kaplowitz from District 4 and Legislator Oros from District 1, and this is what they have to say:
Mike Kaplowitz: “I am opposed. Although I do not condone/approve of discrimination in any form, I feel that regarding this particular proposed law, a homeowner should have the right to choose who they rent to and who they entrust with their property. Further, there has been no tangible study/proof that this has been a problem to the extent that requires legislation. For any unused Section 8 vouchers, I know the Business and Realty organization has offered to voluntarily work with landlords to find available housing. Also, it is arguable whether this legislation is even constitutional, though it is certainly anti-American. Lastly, my office has received numerous e-mails and calls from constituents, all asking that I not support this proposed local law.”
George Oros: “I am a huge baseball fan, so my quote about the source of income legislation is drawn from an old baseball story. Bob Gibson had pitched himself into trouble. His catcher, Tim McCarver, started out to the mound for a chat. Gibson glared at McCarver and said, “Get back behind the plate. The only thing you know about pitching is you can’t hit it.” The only thing the county board knows about running a small business is they can’t do it. This law is also another one of those unintended consequences because ultimately it will result in less affordable housing as responsible landlords decide to abandon the business. Hasn’t our county done enough harm to small business already?”
What you are supposed to believe by this legislation is that landlords are discriminating against people because of their color or national origin, or even legal status. This could not be further from the truth. The reality is if you accept Section 8 housing, the government tells you how your rental unit must meet certain codes, all of which you must comply with at your own cost with horrendous fines if you don’t. If the tenant does not like you and makes a false claim against you, you are guilty in the government’s eye until proven innocent. Also, if the tenant proves to be disruptive, it is a very painful and costly process to evict them. It would be less painful to extract your own tooth without Novocain. Finally, landlords can’t even use their own leases but must use Section 8 leases without suitable protections. There are already numerous federal, state and county laws barring discrimination based on race, gender, religion, etc. So this becomes a redundant law, something the county loves to do.
Finally, being forced to rent to Section 8 applicants could force landlords to deny affordable housing to non-Section 8 tenants who, as working families, barely make more money than Section 8 permits. What the county is trying to do is force the landlords into accepting government as their partner. All money that comes from the government comes with strings attached, and there are landlords who don’t want that money or the strings that come with it. This is pretty simple: If a landlord wishes to rent his property to Section 8 tenants, it should be his choice and he should not be compelled to do so by the government. And that is what this legislation attempts to do. I hope Mike and George’s position will carry the day.

Volpe opposes Westchester County rental options for Landlords
To the Editor:
I would like to take this opportunity to expand on last week’s “In My Opinion” column dealing with the proposed “source of income” legislation before the Westchester County Legislature. This legislation would force landlords who don’t want county-controlled tenants to actually open their rentals to Section 8 or assisted living programs. Understand this– the inference here is choice. I am a participating landlord to these programs. However this law forces a landlord to open up a rental that is not part of this program and possibly force this person to comply even though he/she may not want to.
Not only am I a taxpayer, I am a business owner and a landlord. I currently house both private tenants and also Section 8 participants. I know first hand the rules and regulations, taxes, fees and surcharges imposed by County government on all ends of private ownership. If the legislation is being passed because the legislators feel there is discrimination going on then let me ease their concerns. This legislation is redundant and there are laws already in place to prevent discrimination. The laws currently on the books prevent racial, religious, or gender discrimination of any kind. When one reads through the codes you will find heavy penalties should you engage in such a practice. There are constant multi-layer government inspections to make sure you adhere to all the codes. County government already has it’s hands into my pockets and properties. I do not feel that being compelled to rent and use their leases and regulations is warranted if I choose not to. Legislator Kaplowitz from nearby Yorktown has already stated their is no need for this law. I agree.
In closing: this is the kind of intrusive and redundant laws Westchester County government continues to pass onto us as taxpayers. Enough is enough!

County government already has it’s hands into my pockets and properties. I do not feel that being compelled to rent and use their leases and regulations is warranted if I choose not to. Legislator Kaplowitz from nearby Yorktown has already stated their is no need for this law. I agree.
In closing: this is the kind of intrusive and redundant laws Westchester County government continues to pass onto us as taxpayers. Enough is enough!

CITY OF PEEKEKILL TO TAXI INDUSTRY:TOUGH NOOGIES
Dear Readers:
In full disclosure, I am part owner of a taxi company that operates and is licensed out of the City of Peekskill.
Believe it or not taxi companies, even single owner/operators are actually small businesses. As I have written previously, the City Of Peekskill has been handing out hack licenses and car licenses like pez.
We also know that there is a recession going on and that governments should be tightening their belts by looking for ways to curb spending to control taxes. We know that, but the City council lives in an alternative universe. We know this because they are spending tax payer money to hire a person to teach sensitivity to their employees to silence a rabble rouser. We know this because they are going to spend more money to hire an artist to paint more murals in town. We also know this because they are about to spend tax payer dollars to subsidize a charter shuttle to pick people up at the train station to cart them to the center of town during sponsored events.
They are going to do this despite the glut of taxis at the train station. Taxis they license. So one might conclude that the taxi industry is going to subsidize their competitor. It is the City of Peekkill that sets the rates of taxis for local in town trips. So if it a matter of saving strangers money when they come to Peekskill, then they could institute a special rate for these events. They do this now for seniors who pay half fare.
The fact is the taxi industry makes money for the city. So the question becomes is it a wise expenditure of tax payer dollars to subsidize a shuttle when transportation already exists that does not cost the city money? Should the city be saying to the tax payer and taxi industry tough noogies?
Who is the bigger nanny?:
During the recent audio and video sting of NPR executive Ron Schiller, he stated that the conservative Tea Party has an "evangelical" desire to interfere in peoples private lives. Let's look at that. Smoking prohibitions in private businesses and now public spaces. Trans-fat laws. Outlawing the incandescent light bulb. What king of toilet and shower head you can have in your house. Seat belt laws. Helmets for adult bicyclists. Anti-idling ordinances. Tree ordinances on private property. The use of zoning and environmental ordinances as an end run around the "takings clause" of the constitution. Political correctness, the most offensive assault on speech and thought. "Obama Care" and its control over who should live and who should die.
All these assaults on personal lives are Liberal Democrat (I repeat my self) ideas. No dear readers, it is not the conservative Tea Party that has this "evangelical" desire to interfere in peoples private lives, but Democrats who have contempt for personal liberties. For believers in "life, liberty and the pursuit of happiness", it is why Democrats should not be allowed near the levers of power. This is my opinion, you may beg to differ.

REFLECTIONS AFTER TWO HUNDRED COLUMNS
Dear Readers:
Believe it or not, this is my 200th column writing opinion for the NCN. I would like to share some things I have learned. It hasn't been easy running a business, and opining in 3 different forums (Bazzomanifesto, In My Opinion, Bazzo at Work) week after week, through sickness, and death in the family and not miss a beat? It takes a commitment. I remember after only a few moths on the job, and Katheen Malfetone was just hired as the new managing editor, she thought this column should run bi-weekly. She was not sure I could find something to opine about on a weekly basis. We can laugh about that now.
As a general rule, politicians have all the traits of a dog except loyalty. A very few in spite of all the glad handing would risk losing an election to publicly stand by a friend or principal if deemed radioactive. As we have seen in the recent controversy over public sector union benefits, they will throw the tax payer under the bus every time.
A big issue in last years state legislature elections was former N.Y.C. Mayor Koch's "hero of reform" movement where all the Republican candidates signed an agreement to propose an independent commission to form the new election districts to comply with the 2010 census results. The Republicans ran on this. Now that the have re-taken control of the State Senate, they have done a 180 and now oppose this. They knew this would not fly. New York is predominantly Democrat and any commission independent or not, would re-district Republicans out of power. What makes the Republicans phonies is they new this and signed the petition any way. They thought you were too stupid to understand that Koch is not a nice old man but a liberal Democrat through and through.
On the other side, when the Democrats controlled all levers of government on the federal and state level, they rammed through legislation, using shady back room deals, without any desire of bi-partisanship. Heck, they did not even allow the Republicans in the room. Now since November and Republicans have taken back some power, they scream of the need for bi-partisanship. As we have seen in Wisconsin, instead of adhering to the will of the voters, the Democrats like cowards fled the state. The Republicans like adults when out of power, took their medicine. The Democrats, taking their marching orders for the unions took the ball and went away. So it is easy to understand why the casual observer of the political scene would easily confuse politics with the world oldest profession.
Those were some of the negatives. Here are some of the positives. When I first started writing, I heard all the same things you have regarding Yorktown Highway Superintendent Eric DiBartolo. So I was skeptical of him when the Yorktown Town Board gave him the title of Head of Labor Relations to do an end run around civil service rules. Eric proved his detractors (and me) wrong by successfully consolidating services and saving the town money.
I initially found him a person of thin skin but fiercely loyal and a person who can at times play favorites, on who he will talk to a places he would go.
Since then he has developed a thicker skin. As for the other two things, I find them admirable. Loyalty is a rare quality in politics. As for playing favorites, who doesn't? We don't elect gods, we elect human beings. I do not fault being human. Heck I play favorites and in full discloser I always admit them. In the end Eric and his crew do what they are suppose to do better than most and Yorktown is lucky to have him and them.
Even though more often than not, we disagree politically, I have found Westchester Legislator Mike Kaplowitz one of the most honest people I know. When people say to me all politicians are the same, you can't trust them; I proudly point to Mike and say not true! Politics needs people like Mike.
It also needs people like Yorktown Councilman Terrence Murphy and State Assemblyman Steve Katz who entered the political arena for the right reasons. Neither needed the job, but was willing to take the slings and arrows of an election to make a difference for others in the same predicament.
Thanks to Bruce, Kathleen, Mary, Domenic, Dave, Nick, Eric, Mike, Darren, John, mostly Tommy for giving me strength when I feel down to keep my commitment to keeping informed you dear readers who have made this column and blog part of the political arena. This is my opinion, you may beg to differ.

Since then he has developed a thicker skin. As for the other two things, I find them admirable. Loyalty is a rare quality in politics. As for playing favorites, who doesn't? We don't elect gods, we elect human beings. I do not fault being human. Heck I play favorites and in full discloser I always admit them. In the end Eric and his crew do what they are suppose to do better than most and Yorktown is lucky to have him and them.
Even though more often than not, we disagree politically, I have found Westchester Legislator Mike Kaplowitz one of the most honest people I know. When people say to me all politicians are the same, you can't trust them; I proudly point to Mike and say not true! Politics needs people like Mike.
It also needs people like Yorktown Councilman Terrence Murphy and State Assemblyman Steve Katz who entered the political arena for the right reasons. Neither needed the job, but was willing to take the slings and arrows of an election to make a difference for others in the same predicament.
Thanks to Bruce, Kathleen, Mary, Domenic, Dave, Nick, Eric, Mike, Darren, John, mostly Tommy for giving me strength when I feel down to keep my commitment to keeping informed you dear readers who have made this column and blog part of the political arena. This is my opinion, you may beg to differ.

FEDERAL JUDGE RULES "OBAMA CARE" UNCONSTITUTIONAL
Dear Readers:
Judge Roger Vinson, a Federal Judge has ruled "Obama Care" unconstitutional. The entire thing is unconstitutional. Even though there are individual aspects of the health care legislation that could stand on their own, most of the legislation hinges on the "individual mandate clause". That is the clause that requires every American to purchase health insurance or face penalties including imprisonment.
He found this is an over reach of the powers of Congress innumerate in the "Commerce Clause" in the Constitution. Congress can not force citizens to purchase a product from a private enterprise nor not purchase a product. Unlike car insurance which you must purchase if you wish to drive your automobile, Congress can not order you to purchase a car. As the judge noted, if the congress can order the purchase of a private product for the public good, it can then order citizens to purchase what ever else it believes to be in the public good. This would forever change the principal of "limited government" as our founders envisioned. Our rights would no longer be ours by birth, but by government decree.
The reason why the whole act was found to be unconstitutional was Congress did not add a "severability clause". The severability clause says basically if any part of this is found unconstitutional, the rest of it remains okay. The judge in his ruling basically said, "There is no severability clause. I'm finding the whole thing unconstitutional." By ruling the whole act unconstitutional, there was no need for an injunction in spite of what you are being told. This ruling supersedes all other rulings on this act, even the two which upheld this act. Until a higher court either affirms or overturns this ruling the government is by law duty bound to cease enacting any part of this law. If they do continue to keep enacting parts of this act, they can be held in civil contempt by the courts, should any of the twenty-six states pursue this matter.
What you are now being told by supporters of Obama Care, is that unfeeling opponents of this act want to prevent seniors and children from getting medical care and health insurance now being provided. This is a canard to keep you confused about the real issue this court ruling rests on. The issue being is this act constitutionally legal. What supporters of this act want you to do is agree to throw out constitutional restrictions on the federal government for supposed benefits.
Where as now the federal government is the creation of the states, should a higher court overturn this ruling, the states and the people would forever be subservient to the federal government and they would be the dictators of what are rights are and are not. I am not willing to surrender the principal that our rights are unalienable, granted by a higher power and ours by birth. Not for government sponsored health care or any other reason no matter how well intentioned. For the true intention of this act is total government control over the life and death of its citizens. This is my opinion, you may beg to differ.

JUDGE AND JURY DUTY BLUES
Dear Readers:
Jury Duty:
Jury Duty is a civic duty. The question is should civic duty require putting one business or abode in jeopardy? This is not about me, but could be, for I am in the same situation. A person I know has received a summons for jury duty in White Plains. The penalty for not showing up is a fine of $1,000.00 and/or imprisonment for 30 days. You are paid a nominal stipend for your time. However that stipend is subject to tax and you must also pay for your own parking. So it is pretty much a wash. If your are like this person I know or me, a sole owner of a business, it actually costs you money to serve as being away from the business means no money is coming in.
For people not in the corporate or public sector world, this translates into no money, no pay. No pay means no ability to pay rent or mortgage. Yet the notice says "there are no exemptions from jury duty". Oh, you can lose a day’s wages and business trying to get a postponement, but that is only a temporary reprieve. Even that is not guaranteed. Remember you are dealing with a bureaucrat that gets paid no matter what.
Now we live in a county and state with nanny legislators that have created for your enjoyment or annoyance according to your perspective the following: The adult bike helmet police. The no smoking police. The calorie count police. The garbage police. The no idling your car police, just to name a few. Yet they could not find an exemption for honest, tax paying, hard working residents summoned to jury duty that would not put their home or business in jeopardy. It is time for these legislators to grasp the concept of no money no pay and do something to protect these people.
The Tax Man Cometh:
He cometh and with a vengeance. You see New York needs money and at this point they do not care from where they get it. Judge Joseph Pinto, a New York administrative law judge, ruled last month that all income earned by a New Canaan, Conn., couple is subject to New York state taxes because they own a summer home on Long Island they used only a few times a year. Now every dollar of income earned throughout the year is subject to New York residential income taxes whether New York is your permanent residence or not.
This is not the New York tax authorities. This is not Albany. This is a New York court, the New York State Tax Appeals Tribunal. Here is the scary reasoning of the judge. The judge ruled that this couple in Connecticut, that their Long Island vacation home qualified as a permanent abode because it was big enough to be. It was suitable for year-round living. The judge said”Whether or not the couple actually stayed in the home wasn't relevant." Whether they were in the state of New York did not matter. They could have been.”
Talk about taxation without representation. Remember, unlike other enforcement entities, when dealing with tax law, you are guilty till you prove yourself innocent. Now it does not even matter whether this couple could prove that were in New York or not. The result of this ruling will be hurt sales in New York's vacation-home communities. People will think twice about spending any summer time in New York. Also remember this, other states will reciprocate. This is my opinion, you may beg to differ.

GAS BABGS AND GASOLINE
Dear readers:
Gasbags:
Misdirection is a typical ploy of the Democrats and their stenographers in the media. As when the topic is illegal immigration, it is always phrased "immigration". Now it is collective bargaining. We are being misdirected into believing that union's collective bargaining rights are being taken away. As there is a difference between immigration and illegal immigration, there is a difference between private sector unions and public sector unions. Collective bargaining as we know it is not in jeopardy regarding private sector unions despite the fine history lesson in last weeks Knight Watch column. This confusion of the issue is by design.
As far as public sector unions are concerned, collective bargaining never existed. Both sides were never represented. The side selected to represent the tax payer, elected representatives, elected to represent themselves. They negotiated the best deal to get themselves re-elected. Elected representatives 10, 15, 20 years ago made untenable promises of future benefits that would have made Bernie Madoff proud. Both sides represented themselves, the bosses (the taxpayers) were never part of the equation.
The bill has now come due and there is no money to pay for it. That is the reality. The can kicked down the road has landed at our feet and the feet of our present representatives. That people planed their future on a politicians promise is truly sad and they were fools to do so. What did they think? That a political promise was worthless to everybody else but them? And you know what they say about a fool and his money. Those politicians played everyone for fools. They were the joker in a rigged deck of cards.
Gasoline:
The stenographers in the media would have you believe that the unrest in the Middle East is the cause of the present rise in gas prices. Not true, it is a symptom. The rise started last year when we started to see record prices in November, December and January. The root cause started in 2009 when the Obama administration canceled all contracts for domestic exploration and drilling that were initiated under President Bush. It was the easing of those past restrictions that stabilized the market and prices at the pump.
You have, even as I write this a seven year moratorium on all domestic drilling is still in effect brought to you by your friendly neighbor Obama, which this administration has no desire to lift. This in spite of the fact that a Federal Judge in Louisiana has held this administration in civil contempt for not lifting the restrictions for off-shore drilling in the Gulf. The judge found the administration's restrictions unconstitutional. You also have a lawless EPA creating by dictate, laws and powers not granted to it by congress, even the past one controlled by Democrats on coal mining and other forms of energy. Remember the Supreme Court gave the power to regulate green-house gasses to congress not the EPA.
The free flow of petroleum is in jeopardy, which is what makes the speculators nervous. You can lay this at the feet of this present administration and its flat-earth policies. By the way, do you know what Obama's answer to this present problem is? It is a tax on oil companies’ profits. A tax that will surely be passed down to the consumer in even higher energy prices. Or we may find the same thing when President Carter tried this, gas lines as the companies hold back supplies. Then you won't have gas at any price. In the end, I believe this is not by accident but by design. This is exactly what the President wants. This is my opinion, you may beg to differ.
