TRYING
TO ARTIFICIALLY ENGINEER RACIAL DISHARMONY

"Responsible
leaders never -- never ever -- work to promote racial turmoil.  The fact that
Mr. Cuomo has methodically and systematically tried to do that should disqualify
him from another term as governor.    
 
New York--Oct. 30...New
York State Lt. Governor candidate Chris Moss, the Chemung County Sheriff, today
denounced Governor Andrew Cuomo's repeated attempts to artificially engineer
racial animosity in the race for governor. Mr. Cuomo has run millions of dollars
worth of dishonest and inflammatory negative television ads baselessly
suggesting that gubernatorial candidate Rob Astorino wants to exclude
African-Americans from living in Westchester County -- the fourth most diverse
county in New York State.  The Governor now refuses to repudiate a ludicrous
statement made this week by New York City Public Advocate Letitia James equating
Mr. Astorino with southern segregationist "Bull" Connor.

County Executive Astorino has widespread support in the African-American community. In his race for re-election last year, he was endorsed by two Westchester NAACP leaders; the president of the United Black Clergy; the Chairman of the National
Action Network and other African-American ministers and leaders. Sheriff Moss,
his running mate, is African-American.

"Andrew Cuomo has forfeited his right to lead this state, at least his moral right,"
Sheriff Moss said. "Responsible leaders never -- never ever -- work to promote
racial turmoil.  The fact that Mr. Cuomo has methodically and systematically
tried to do that should disqualify him from another term as governor. As a
sheriff and as an African-American, I find Mr. Cuomo's political tactics
unconscionable."   

Mr. Cuomo, a Westchester County resident himself, has used a multi-year dispute
between a Washington bureaucracy he once led, the U.S. Department of Housing and
Urban Development (HUD), and Westchester to try to gin up racial turmoil.  The
HUD suit was filed against Westchester in 2006 under former Democratic County
Executive Andrew Spano, now a senior official in the Cuomo Administration,
arguing that Westchester was not "affirmatively furthering fair housing."  The
Spano Administration called the federal action a "garbage suit" at the time, and
the County under Mr. Spano settled with HUD with no admission of wrongdoing.
 

Mr. Astorino's principled disagreement with HUD now is over its attempts to exceed
the terms of the Spano settlement and break up local zoning laws to force high
density housing into single family residential neighborhoods. Mr. Astorino
believes the federal overreach is unconstitutional. The Obama Administration has
said it is using Westchester as a "grand experiment" and is now pursuing a
lawsuit against Nassau County. It is planning to pursue similar social
engineering actions nationwide next year.

"Westchester and Nassau communities aren't racially exclusionary; they're just expensive," Sheriff Moss continued. "Ask Andrew Cuomo. He lives in one of them."

Legislator Parker Urges Astorino Administration to Expedite Playland Repairs

 

Re-Opening of Ice Casino is “365 days late and nearly two million dollars short”

 

White Plains, NY – Westchester Legislator Catherine Parker (D-Rye) strongly urged County Executive Rob Astorino and his Administration to expedite work on crucial repairs and necessary maintenance of Playland, the County’s iconic 290-acre amusement park and recreation facility. Parker also criticized the delays in repairing the Ice Casino at Playland, which resulted in the loss of nearly two millions dollars of revenue during the 2013-2014 season.

 

“Two years after damage incurred from Superstorm Sandy, the entire north boardwalk is still closed to the public and fenced off because it is still in a state of destruction, which is unacceptable,” said Parker. “The Administration has tried to characterize the necessary repair work at Playland as being ‘ahead of schedule,’ but other municipalities, including New York City, have fixed and renovated their storm-ruined structures long ago.”

 

In April 2014 Astorino trumpeted the newly rebuilt Playland boardwalk on the south side of the amusement park, near the beach, without mentioning that contracts for repairs of the north stretch of the boardwalk had not even been bid out. Parker visited Playland earlier this week, and the wrecked remnants of the boardwalk are clearly visible, with much of the torn apart planking yet to be removed.

 

“The Administration has simply put a fence around the damaged boardwalk,” Parker said, adding that county residents wanting to visit Playland and stroll along the boardwalk up to the Edith G. Read Wildlife Sanctuary have to detour through the parking lot.

 

A good deal of regular maintenance of Playland, like painting and paving work, is not being completed on an annual basis either, Parker also noted, giving the park a sense of general deterioration.

 

“I think it’s shameful that County Executive Astorino would talk about preserving Playland and modernizing its facilities on one side of the park while clearly neglecting the park as a whole,” Parker said. “A short walk from his photo-op today the boardwalk is still in shambles.”

 

Legislator Parker’s criticism follows Astorino’s announcement today that the Ice Casino at Playland is finally being re-opened—two years after Superstorm Sandy severely damaged the roof of the building and caused flooding inside. Westchester County Department of Public Works and Transportation (DPWT) Commissioner Jay Pisco assured members of the Westchester County Board of Legislators (BOL) in November 2012 that the Ice Casino would be ready for the 2013-2014 season.

 

“While I’m pleased that residents will finally able to skate once again at the Ice Casino, the reality here is that this project is 365 days late and nearly two million dollars of anticipated revenue short,” said Parker. “I want us to remember what still needs to be done at Playland. Let’s show our pride and love for this magnificent County park by honestly dedicating resources and efforts to its repair and upkeep.”

Earlier this month, the NYGOP released "Andrew Cuomo's Bottom 10" to coincide with the Governor's appearance on David Letterman.  We'll be recapping one of those items every day for the final ten days before Election Day. Today, here's:
#6: The Buffalo Boondoggle
Here are some scary facts:

If the fifty counties that comprise Upstate New York were their own state, that state would rank dead last in job creation.

New York has five metropolitan areas that rank in the bottom ten nationally, and ten that rank in the bottom twenty.

Of the 363 metropolitan areas in the country, Buffalo's economy ranks #354.

Enter the "Buffalo Billion."

After getting shellacked in Western New York in 2010, Andrew Cuomo is peddling false economic hope to greater Buffalo in 2014.  And his words will ring just as hollow as Hillary Clinton's promise in her 2000 Senate campaign to create 200,000 jobs in Western New York.
 
The centerpiece of Cuomo's empty promise is the Riverbend project, a plan to create jobs producing solar energy.  But the companies that Cuomo claims are moving to Buffalo can't fund new facilities without massive government subsidies.
 
As Buffalo's own Carl Paladino put it:

"This is as crooked as the day is long! The day after the election, he'll forget about Western New York."

But don't just take Republicans' word for it.  The press has caught on to the idea that this project isn't everything Andrew Cuomo says it is.  Check out our recent roundups of investigative reports here, here and here.

And by the way, if you live in Rochester, Syracuse, Utica, Binghamton or anywhere else, sorry, Cuomo's got nothing for ya.

We'll let Carl take it from here. This is from his excellent op-ed in City & State last week:

At River-bend in Buffalo, Cuomo is subsidizing a solar panel company under Federal investigation with $750 million of taxpayer money to "buy" 1500 jobs ($500,000 per job.) The key word is "buy." Subsidies do not create a permanent atmosphere for job creation. They only cause an unleveled playing field which frustrates development, burdens taxpayers and adds to a dysfunctional business atmosphere that forces companies like Tyson Foods to send 300 jobs out the back door.
 
Texas has no income tax. They don't buy jobs. Businesses move to Texas without subsidy because Texas has a government that serves the people. Instead of commending them as an illustration of good government our small minded press criticizes them for stealing our businesses.
 
Permanent job retention and development will only be achieved by cutting taxes and debilitating regulation. We need culture change in Albany. Buying jobs in an election year to create an illusion of investment in WNY is just more sick politics.

An Open Letter to New York School Teachers and Retired School Teachers from Westchester County Executive Rob Astorino

To Our Esteemed Teachers: 
 
New York public school teachers deserve respect for their day-in-and-day-out dedication to our children.  I know, I have three young children in public schools; I went to public schools, and I served as an elected public school board member. My wife Sheila is a special ed teacher.
 
Mr. Cuomo's adversarial stance toward teachers borders on disdain. I simply cannot understand it. All I can say is that, as governor, I will treat you, as teachers, with the respect you deserve as educational professionals, and with which I treat all public servants. We may not always agree on everything, but our goals will remain the same: Strengthening New York's public school system to better prepare the children we love for the future.
 
I am deeply committed to public schools in New York, as is my running mate Sheriff Chris Moss. Public schools are in my blood. I am also a card carrying union member, so I understand the need for and benefits of collective bargaining.
 
I have heard your concerns over charter schools, and I agree that accountability within them is a must. I have supported charter schools in New York's inner cities, but I recognize that better public schools must ultimately be the answer to New York's education challenges. Governor Cuomo has taken millions of dollars from charter school backers and has no interest in accountability.
 
As a parent, first and foremost, I am committed to getting rid of Common Core in New York, and as governor, I will pull New York from the program. No K-12 teachers were involved in writing the developmentally inappropriate experimental standards; they were conceived in secrecy and never tested, and the math and English content experts on the validation committee both refused to endorse the standards saying they were of "poor quality."  We'll replace it with better standards set by New York education experts with input from teachers and parents.  And through the same approach, we'll develop proper assessments for our students, teachers, and schools, of which testing will only be one piece of the puzzle. Our teachers are not test-giving automatons and our children are not guinea pigs.  Each deserve better, and they'll get it under my administration.

I have twice been elected by wide margins in a 2-1 Democratic county.  That happened because I am willing to listen and to reach out to everyone, in a respectful manner, to find common solutions.  I stand on principle, but I also understand that compromise and good will are how we move forward together as a society.
 
I would be honored to have your support on Tuesday.  I promise you'll have a respectful governor in me, willing to work with you honestly and constructively to protect and better New York's public schools.

Earlier this month, the NYGOP released "Andrew Cuomo's Bottom 10" to coincide with the Governor's appearance on David Letterman.  We'll be recapping one of those items every day for the final ten days before Election Day. Today, here's:
#5: Tax Free -- er, Start Up NY
Here's one for Throwback Thursday: does anyone remember "Tax Free NY?" That was the original name of "Start Up NY," Andrew Cuomo's economic development plan, before everyone reminded Cuomo that his New York is still the most taxed state in the Nation.

Texas Governor Rick Perry pointedly called the plan "small ball."  Texas, after all, has no personal income or corporate tax.  That must be nice.

So Cuomo changed the program's name

But he didn't change its problems.  And the problem is, under Start Up NY, only a select few businesses qualify for only a select few tax exemptions for only a select number of years.

As for everyone else? They're still stuck in the most taxed, most regulated, least economically free, least business-friendly state in America.

Cuomo has said that lowering personal income tax rates is "impossible." Instead, he's extended tax hikes on high-income New Yorkers as well as the utility tax on all New Yorkers. The former is an incentive for New York's job creators to relocate; the latter is a hidden tax hitting New Yorkers' paychecks.

Not that you'd know any of this from watching those ubiquitous Start Up NY ads.  Indeed, Cuomo is using  hundreds of millions of tax dollars running thinly-veiled campaign ads for himself, while New York remains dead last in just about everything.

We've called on Cuomo to reimburse taxpayers for these blatantly political advertisements.

And what do we have to show for all of this?  Well, not a whole lot.  The New York Post reported just this week that Cuomo is touting 72 new jobs as proof that Start Up NY is working.  That's 72 jobs, in a state with a labor force of 7,614,500 workers.  As the Post said in an editorial, if this is considered "a 'success,' maybe it's time to rethink our business-development plan."

Capital New York reported last week that a gathering of tech executives in New York called Start Up NY "too slow and complex to be useful."

Policies that help create jobs don't have to be slow and complex. Let's cut taxes for everyone, roll back regulations and revamp our workforce development programs, just like other states have done.

It's not a coincidence that 8 out of the top 10 states for job growth have Republican Governors.

We can duplicate their success here in New York, but it'll take a serious jobs plan (like this one), not taxpayer-funded political ads that obscure the truth about our horrendous economic climate while providing political fluff for the incumbent Governor.

New York--Oct. 30..."Andrew Cuomo suffers from a core dishonesty problem," New York gubernatorial candidate Rob Astorino today charged in challenging Mr. Cuomo to back up a claim in his latest television ad falsely stating that Rob Astorino raised taxes in Westchester County.
 
As County Executive, Mr. Astorino froze or reduced the county tax levy every year he has served. The size of Westchester's budget is smaller now than when Mr. Astorino took office in 2010.  He reduced the size and cost of government more than any county executive in New York State, according to a report by the New York State Comptroller.
 
"Mr. Cuomo has repeatedly been caught lying by the news media, including by The New York Times today for doctoring a Moreland Commission report about the Hurricane Sandy response in Long Island," Mr. Astorino said. "Now he is blatantly deceiving New York voters -- again -- about my record of cutting taxes in Westchester.  I therefore directly challenge Mr. Cuomo to point to a single instance where I have raised taxes as Westchester County Executive."
 
Any school or municipal property tax increases in Westchester over the past five years were caused by Mr. Cuomo's unfunded state mandates which he refused to address as governor, Mr. Astorino said.  County Executive Astorino has no authority over school or local budgets.
 
"Mr. Cuomo needs to answer this question: 'If I froze or cut Westchester's tax levy every year that I've served as County Executive, how could taxes possibly have gone up?' The answer will be staring at Mr. Cuomo in the mirror."
 
Mr. Cuomo's false ads continue to run across the state.

This letter is submitted on behalf of Rob Astorino and Astorino for Governor in regards to a negative advertisement that the New York State Democratic Committee is running against Rob Astorino, a Republican candidate for New York State Governor ("the Advertisement") on your network. Without a doubt, the Advertisement contains false information deliberately intended to mislead New York voters and defame Rob Astorino's reputation.  Because the Advertisement conveys messages that are plainly disproven by fact, we respectfully demand that your station immediately stop airing the Advertisement and that no further airings of its misleading content be allowed on your station.

The advertisement at issue entitled "Campaign Trail of Broken Promises" makes false, deceptive and misleading claims regarding Rob Astorino's record regarding taxes and job creation as Westchester County Executive. In particular, the advertisement deceives and misleads as follows:

Narrator: "Rob Astorino promised to cut taxes and create jobs.  Instead Westchester Property taxes have gone up 8%.
Graphic:  "Astorino broke his promise."

FALSE:   In each of the four county budgets introduced by and signed by Rob Astorino, the county property tax levy was either cut or held flat.  In fact, according to the NYS Comptroller's office no county in the state has reduced the county property tax levy more than Westchester during this time.  The county property tax levy makes up about 20%-25% of the typical homeowners property tax bill and is the only portion of the bill that the County Executive controls.  School taxes and town/village/city taxes make up 75%-80% of the property tax bill and the county executive has no direct control over these budgets and tax levies.

FALSE:  According to New York State Department of Labor, during the first three full years of Rob Astorino's first term (2010-2013, using 2009 as a baseline), Westchester created 11,198 net new private sector jobs which is one of the best records in the entire state.  During this same time comparison, for instance, Onondaga County had 1,460 net private sector job LOSSES and Oneida County had 2,485 net private sector job losses.


The sensationalism paid for by New York State Democratic Committee against Rob Astorino plainly does not constitute a "candidate use."  Under Columbia Broadcasting Sys., Inc. v. Democratic Nat'l Comm., 412 U.S. 94 (1973), and Nat'l Conservative Political Action Comm., 89 FCC 2d 626 (1982), your station is not obligated to air any advertisement from third parties, such as the New York State Democratic Committee, as third parties have no guaranteed right of access to air their advertisements on your station.  Thus, broadcasting stations are not protected from legal liability for airing a false and misleading advertisement sponsored by the New York State Democratic Committee. Moreover, broadcast licensees have a legal responsibility to review and to eliminate any false, misleading, or deceptive materials contained in advertising. (See Licensee Responsibility With Respect to the Broadcast of False, Misleading or Deceptive Advertising, 74 F.C.C.2d 623 (1961).] Failure to prevent the airing of "false and misleading advertising" may be "probative of an underlying abdication of licensee responsibility" that can be cause for the loss of a station's license. [Cosmopolitan Broad. Corp. v. FCC, 581 F.2d 917, 927 (D.C. Cir. 1978).] We urge you to stand up for the truth and put a stop to these false attacks on your station.

Your station is hereby on notice that the Advertisement makes false statements intended to deliberately deceive New York voters and defame Rob Astorino's reputation.  Based on the foregoing, we respectfully demand that your station immediately cease the airing of this false and misleading Advertisement and further request that you reject any attempts by the sponsor of this Advertisement to purchase time for the future airing of this Advertisement because of its material misstatements of fact and defamatory nature.  

Please contact me at your earliest convenience at the email address or phone number below to advise as to your station's actions(s) with respect to cessation of the airing of this advertisement.

DI IORIO SECURES SPACE TO MAKE UP 17TH PRECINCT CANDIDATES FORUM WHICH MALONEY SKIPPED; MALONEY STALLS

NEW YORK, NY -- Congressional candidate Nick Di iorio secured space Thursday to offer opponent Carolyn Maloney (D-NY-12) the opportunity to make up Tuesday's 17th Precinct Community Council Candidates' Night forum, which Rep. Maloney skipped.  Di iorio offered a Friday 6pm forum or anytime Saturday.  The 17th Precinct Community Council and the Maloney campaign took no efforts to reschedule the Di iorio - Maloney portion of the Tuesday event after Maloney's cancellation.  The 17th Precinct Community Council originally told the Di iorio campaign that a member of Maloney's team would reach out to the Di iorio campaign regarding rescheduling, however, this never happened.  Therefore, the Di iorio campaign sought out space in the interest of giving any interested press and public at least one opportunity to hear from the two candidates before Election Day.

At Thursday evening's debate at The National Herald - which only allowed a handful of attendees and turned away many members of the public - Di iorio personally asked Maloney if she would attend the forum on Friday or Saturday.  She said her staff would get back to the Di iorio campaign.  As of Friday morning, the Maloney campaign had not responded.

Maloney has taken great lengths to avoid Di iorio.  In late September, The National Herald invited Di iorio and Maloney to debate - Di iorio immediately accepted and Maloney refused. In early October, Columbia University College Democrats and Republicans jointly invited Maloney and Di iorio to a debate, suggesting a range of dates in October.  Maloney rejected the invitation. The Columbia University College Republicans followed up by inviting Di iorio to speak, which he did Monday.  Rep. Maloney's campaign manager attended that closed talk and secretly videotaped him.  Rep. Maloney also missed Tuesday's 17th Precinct Community Council Candidates' Night, which she had attempted to pass off as a debate.

#4: A Prevalent Pattern of Pay to Play
This one is scary.

The Astorino campaign cross-referenced Cuomo campaign donors with companies that received state contracts from Andrew Cuomo.  What they found is shocking: the list of companies that Cuomo is involved in pay-to-play schemes with totals 100 pages. 

In exchange for $2.7 million in campaign donations, these companies received $7.2 billion in state contracts.

We just can't do this memo justice, so take a look at it yourself here.

Here's what Rob had to say when the campaign released the memo:

"This perfectly illustrates Mr. Cuomo's modus operandi.  He promises to do what the voters most want; then when the camera lights go dark he turns around and does the exact opposite. Mr. Cuomo has played New York reformers for fools, whether they be from the political left, right or center."
