Bazzo Says: Should we elect a liar?

Recent polling shows women favor Democrat candidates in New York by a margin of 6 to 1. Most of this support comes from ads and mailers painting Republicans as anti-women saying how they voted against the Women’s Equality Act. Then, of course, you throw in the national Democrat party line of the “Republican war on women.” I have explained in numerous columns the fallacy of this template. I would rather not bore you with a repeat of my previous arguments. However, after reading last week’s story in this paper, “Wife, daughter defend Murphy from ‘anti-woman’ label,” I can state flat out that the Justin Wagner campaign is lying through their teeth.

From the story; “Justin Wagner, the Democratic candidate for the 40th Senate District, responded by saying that it is not OK to ‘settle for nine-tenths of equality.’”

There you have it. Wagner will not separate the common sense, redundant nine items from the act that deal with domestic violence, human trafficking and stronger work place protections etc. without the 10th provision that would allow abortion up to the ninth month, which can be defined without equivocation as late-term abortion, or infanticide. There can be no debate on this according to Wagner, even though Republican candidates in general and Murphy in particular, would vote for the first nine items. According to Wagner, let’s not compromise on the nine points we can get passed, then discuss the 10th item. It is all or nothing. Who is really for protecting women and who is just using women as pawns for political gain?

From the story: “Mr. Murphy may be a nice guy, but he is dead wrong on women’s issues,” Wagner said. “He’s proudly anti-choice. In fact, at a recent Tea Party debate—yes, he was debating at the Tea Party—he said he was a ‘pro-life type of guy.’ Well, let me tell you what type of guy I am. I am pro-choice and I stand with this community every day of the week. I don’t think women in this district in New York need a guy telling them what to do with their body, and I don’t think they need a guy getting between them and their doctor. This district and this race is critical to passing the Women’s Equality agenda and moving our state forward.”

Are we now to believe that to be pro-choice means being pro-infanticide? As no governor, state senator or assembly person can undo Roe v. Wade, the right to choose is not on the ballot, nor in jeopardy, regardless of a candidate’s feeling on this Supreme Court ruling. This is fact. To make this about choice is disingenuous, to put it kindly. Worse still is the belief that a father of daughters such as Murphy and, in this case, Assemblyman Steve Katz would be against the equal protection of women, which they are not, is the worst kind of political pandering, bordering on an outright lie. What you are looking at is the difference between Republicans, who believe in life, which a baby of nine months certainly is, and Democrats, with their unyielding desire for item 10, as a party of death.

Wagner’s campaign also said the “Women’s Equality Act does not expand abortion in any way in New York; rather, it would codify Roe v. Wade, a 1973 Supreme Court decision.”

This is where the Wagner campaign out right lies. From legal experts I asked to explain item 10 to me, here is their reply: “The ‘Tenth Plank’ of the Women’s Equality Agenda effectuates the same end as its predecessor, the Reproductive Health Act, through the codification of the U.S. Supreme Court’s decision in Roe v. Wade.

Before the U.S. Supreme Court modified Roe in Planned Parenthood v. Casey, the controlling law from Roe held that the state does not have the right to regulate abortion (where and who can perform) until after the first trimester. See Roe at 113 US at 164 (1973).”

Non Doctors

“By repealing the New York State criminal statutes relating to unlawful abortions, the Tenth Plank eliminates the operative statute that requires only a physician perform abortions. See NYS Penal Law Section 125.05 et seq. (Rather than this clandestine/operative approach, the RHA expressly allows non-doctors to perform abortions.)”

Late Term

“The opening line of the WEA says that you have a fundamental right to an abortion up to 24 weeks and ‘anytime’ a woman seeks one for her health, without any reference to the fetus’ viability. Under Roe, the term “health” can be construed to include virtually any basis, including the mental health of the mother.”

Partial Birth

“Regarding partial birth abortion, the Tenth Plank states that it does not conflict with the federal ban on partial birth. That said, the Tenth Plank would eliminate the state’s ability to enforce the federal partial birth ban because the state Penal Law provisions are repealed by the Tenth Plank and federal law cannot be prosecuted by the state.”

By saying that the word abortion is not in the item is being cute by half. This is what women’s equal protection is being held up for. If any party is playing women for fools, it is the Democrat party. This proves it.

We know that Justin Wagner is against pipelines his law firm does not represent, (Bazzo Says: What Ticked Me Off This Week bazzman.blogspot.com/2014/10/bazzo-says-what-ticked-me-off-this-week.html ). We know that Justin Wagner will misrepresent what the Women’s Equality Act actually says. We know that Justin Wagner will misstate Terrence Murphy’s stance on this issue for political gain. We know all the shenanigans going on in Albany that is on the federal prosecutor’s radar. The question has to be asked, do you really think Justin Wagner is the right person to represent us in Albany? I say no! This is what I say, what say you?
