If you are old enough you might remember when the Supreme Court ruled that burning the American flag was protected free speech. Do you remember how you felt? Over time you came to agree that free speech protected the unpopular because the popular need no such protection. In twisted sort of way, the people died in the name of that flag did so to protect the rights of those who would burn that flag. Yet, the Supreme Court got it right.
 
Fast forward to Sept. 17, 2014, Constitution Day, when the Ninth Circuit Court of Appeals affirmed that it is against the law in the United States of America to wear American flag shirts on Cinco de Mayo. Cinco de Mayo, mind you, is not even a real holiday. It is a promotion started by a beer company to sell their product. Mexican Independence Day is Sept. 16, not May 5.
 
On Sept. 17, the US Ninth Circuit Court of Appeals issued an order declining a request for an en banc hearing in a case involving four students in at a California high school who were sent home for wearing American flag t-shirts on Cinco de Mayo. An en banc hearing is where the full Ninth Circuit hears a case instead of the three-judge panel that made the ruling. 
 
The judges thus agreed with a lower district court and with appellate judges that officials at Live Oak High School in Morgan Hill, Calif. could censor students who wanted to wear “American flag-emblazoned shirts," on the fifth of May.
 
 
The origins of this episode go back to Cinco de Mayo in 2010, when officials at Live Oak High School forced the students to remove their American flag-festooned shirts. Administrators called the shirts “incendiary” and worried that fighting would break out between white and Latino students if Latino students noticed the shirts (in America) on Cinco de Mayo. Assistant principal Miguel Rodriguez told the students to turn their shirts inside out or leave school.
 
 
Also, students of Mexican heritage told the local media that the students who wore American flag shirts should apologize. The apology did not happen. These students of Mexican heritage said ethnically Mexican students wouldn't wear a Mexican flag on the Fourth of July. On that point they got it right, because July 4 is not a school day. So, in today’s America one can burn the flag as an expression of speech, but one cannot wear it as an expression of speech. 
 
 
On Mexican Independence Day of this year (Sept. 16) singer Miley Cyrus had one of her dancers slap her prosthetic butt with a Mexican flag. Apparently she could go to jail for getting her fake butt whipped on stage with the Mexican flag.
 
 
Mexican officials are sensitive about disrespecting national symbols, so the congress of the state of Nuevo Leon wants her prosecuted. The crime of desecration carries a $1,200 fine and a 36 hour jail sentence. See, in America one can burn the American flag and is protected. However, if one disrespects the Mexican flag that person can be put in jail.
 
 
I want you to remember this, for in New York, should the Democrats win the senate, they plan on giving illegal residents  the right to vote in local and state elections, among other benefits. Mind you people who are going through legal channels to get citizenship still will not be able to vote, but those who came here illegally will.  However, they will not publicly say so until after the election—same as Obama giving amnesty through executive order. Both know that the citizens are wholly against this by 70-plus percent, according to recent polling. 
 
 
You want to know what real voter suppression is? It is not telling the voters your intent before the election. Do not think that the happenings in San Francisco and Mexico cannot happen here. They can and will if you elect Justin Wagner to the state senate.
