SENATOR BALL: JOURNAL NEWS JUST TURNED DESPERATION INTO ART FORM

Brewster, N.Y. – 04/13/2014 – Senator Greg Ball (R, C, I – Patterson), issuing the following statement regarding today’s Journal News article, “Cracks in the facade: Mahopac incidents raise questions about intolerance.”

“It is widely understood that the newspaper business isn't doing quite as well these days, but the Journal News just turned desperation into an art form. For no apparent reason, other than selling a few more papers, they have desperately tried to fabricate a story by going as far back to the early 1900’s. This hit piece strung together enough half-truths and unsubstantiated claims to choke a horse, including citing specific cases that have since been dismissed and clearly do not represent the community as a whole. Dig into any community looking for dirt, from Mount Vernon to Mahopac, and you will find enough to paint a tainted picture.

From gun maps to slanted editorials, I have dealt with the Journal News for nearly a decade. For the most part, the reporters are hard working, professional and fair. The editorial board is an entirely different animal and proudly leans somewhere to the left of Fidel Castro. Shame on the Journal News and shame on these ‘reporters.’

Today’s front-page hit piece by the Journal News represents a new kind of desperate, sickening low. Citing reports from a century ago, this article crudely patches together a series of largely unsubstantiated claims in an attempt to paint this community as patently and historically racist. What a slap in the face to the thousands of loving families in Mahopac who have open hearts, minds and do not deserve this type of gratuitous abuse. The only “crack in façade” we have in Putnam is this rag of a Newspaper that sits in our local businesses and driveways this morning,” said Senator Greg Ball.

            WHEREAS, the Town of Yorktown owns and has in its possession two pieces of equipment in the Central Garage which are no longer necessary or adaptable for use by the Town;

            WHEREAS, such items are listed as follows:

Request for the Town Board to authorize the Town Supervisor to sign two agreements
with Taser International, Inc. for the purchase of Taser smart cartridges and Taser holsters for the Yorktown Police Department, in accordance with the terms of the two quotes, both dated April 2, 2014, for $1,559.03 and $2,010.20 respectively.

Request from the Town Supervisor:
WHEREAS, Chapter 49 of the Laws of 1988 added a new Section 11-c to the New York Domestic Relations Law, empowering the governing body of any Village, Town or City to appoint one or more Marriage Officers and fix their compensation; and

WHEREAS, the Town Board of the Town of Yorktown, a duly constituted Town of the Suburban Class, deems it necessary and proper to create the position of Marriage Officer, possessing statutory authority to solemnize marriages within the Town;

NOW, THEREFORE, BE IT RESOLVED, that pursuant to the provisions of such Section 11-c of the Domestic Relations Law, Michael Grace, Town Supervisor, is hereby appointed a Marriage Officer of the Town of Yorktown, and be it

            WHEREAS New York State Department of Transportation (NYSDOT) competitively bid for improvements to Route 35/202 at Pine Grove Court and Stony Street in Yorktown, and
 
            WHERES the NYSDOT has contracted with ECCO III Enterprises, lowest bidder, for said repairs and improvements, and

            WHEREAS during a pressure test of the water main in this area it was determined that the existing town water main running along Stony Street is leaking, and

            WHEREAS representatives from the Town of Yorktown, NYS DOT and ECCO III met to discuss options for repair/replacement of 120 feet of ductile iron water main, and

            WHEREAS, ECCO III has provided the Water Department with an estimate based on unit cost included in the original NYSDOT awarded contract, and

            WHEREAS, the cost to complete repairs as discussed will be $94,985.00, and
 
            THEREFORE BE IT RESOLVED, the Town Board authorizes ECCO III, NYSDOT’s contractor, to install a new water main along Stony Street at the Bear Mountain Parkway Extension at a cost of $94,985.00.

A Note on the Proposed Annexation of Election Districts 17/20 from the Unincorporated Area to the Village of Briarcliff Manor
It is with great disappointment that we share that, this past Wednesday evening at their Village Board Meeting, the Village of Briarcliff Manor passed a resolution authorizing their attorneys to proceed with an appeal to the New York State Appellate Division, asking the Court to determine whether the annexation of Election Districts 17 and 20 by Briarcliff Manor would be in the overall public interest. This move is truly unfortunate for the taxpayers of the entire Town of Ossining and, particularly, of the Village of Briarcliff Manor, who will effectively pay twice for this upcoming trial.  In choosing this path, the Village, in its current rendition of its justification for annexation, is promoting that "the people should be allowed to decide".  Once again, the Village refuses to publicly acknowledge that this is about more than the will of the people, but rather that its main impetus for actively promoting annexation is to gain the additional tax parcels that hang in the balance, mostly from the commercially developed (and revenue producing) North State Road business district.
There has been, and continues to be, a significant divergence between the perceived responsibilities of the two Boards as to their function in respect to a proposed annexation. We believe that the clear, and legally mandated, responsibility of both Boards was to determine whether annexation would be in the best interest of the ENTIRE community, and that the focus of the subsequent analyses should be on the provision of services and whether annexation would facilitate the improvement of those services, without harming any other part of the community. The fundamental difference between our position and that portrayed by the Village stems from what we believe to be our obligation, under the state laws governing annexation, to consider the interests of all constituents- not just those who would vote in a referendum and not just those who signed the petition (some under what we believe were false pretenses), and who constitute less than one percent of the total Town population.
We stand by our findings that conclusively demonstrate that annexation would provide no real and practical benefit to the community, certainly none that would outweigh the harm that would be done to the other parts of the community that are, by law, deprived of the opportunity to vote in this matter. New York State law mandates that we perform the analysis that led to our findings and, having drawn those conclusions, we were legally obligated to state our objections to annexation. We are extremely confident that the Appellate Court, applying the recognized standards and established precedents, will deny the appeal and uphold our determination that this annexation proposal should fail.
In light of those standards and precedents that will be applied to the appeal, we are forced to conclude that the Village’s decision to appeal has demonstrated their willingness to behave in a reckless fashion with respect to its fiduciary obligations to Village taxpayers. In addition, the allocation of a mere $25,000 (as stated by the Village Manager at the aforementioned meeting) for anticipated legal costs represents either a lack of understanding of the appeal process in the context of annexation laws and procedures, or an attempt to mislead the public as to real costs that will likely be incurred by both parties. The appeal reopens the process to a complete new review and will require extensive court supervised discovery, experts, and a full exchange of documents and testimony during a protracted hearing. Even though it will result in the same conclusions, the process cannot be streamlined.
The costs to both the entire Town of Ossining and the people of Briarcliff will reflect the necessary steps in the process, certainly significantly exceeding the initial allocation by the Village.

"His comments were divisive and disgusting and drag our discourse into the dirt."

Israel's comments were made on CNN's "State of the Union."
