TITLE:  We Have Been Here Before

 
Since President Obama's re-election, one can not help but be impressed with his ability in his use of executive power to advance his vision and thwart the his opponents.  He has ignored the will of congress in laws passed and signed not only by past Presidents but also by him.  Being that history does not start when you were born, it is NOT an unprecedented unilateral use of Presidential power. 

 

He has fashioned policy through this unilateral power he has taken upon himself because of a linguini spined congress and a complicit media which in the past were peopled with a sense of there roles in honoring the sacrifices of those in the past who pledged their honor, wealth and lives to secure that a nation of laws, and as Lincoln said, a government of, by and for the people would not perish from the Earth.  These institutions are now peopled with those who in allowing these things to happen feel they will be allowed to do the same when they in their dreams achieve power. 

 

What are these things?  First and foremost, he has not only refused to enforce laws properly enacted by Congress, he has re-written many of those same laws for political expediency.  In spite of the explicate separations of powers in the Constitution, he has made policy and changed explicit provisions in law by executive order and bureaucratic maneuvers.  It is not just Obama Care.  It is the proposed Dream Act, Cap and Trade Legislation that can not get enough support in the Legislative branch of government to become law  because those lawmakers know it is against the will of the people to enact those pieces of legislation.  It is also his ignoring specific provisions in President Clinton's signature legislation reforming "welfare as we know it'.

 

This President who swore to not only uphold the Constitution but also swore to see the laws faithfully executed, believes this gives him the power to forbid their execution.  In 1838 the Supreme Court ruled that "this novel construction of the Constitution is entirely inadmissible.'  This is what I meant when I said this "it is NOT an unprecedented unilateral use of Presidential power." 

 

He is not the first to perceive the limits on executive power are defects in the Constitution.  Nixon believed if the President does it, it is not illegal.  Watergate and the laws in its aftermath disproved that theory.  However, if one wishes to read about a president who perceived this supposed defect and a Congress and a media who knew their proper roles one must look at the Presidency of Andrew Johnson. 

 

All you probably know about him is he was the first President to be impeached and avoided conviction by one vote in the Senate.  However,
 
....like this President, Johnson attempted to transcend the limits of the Presidency by direct appeals to the people.  Though he only learned to write later in life, being taught by his wife in his twenties, he was an acknowledged powerful an persuasive speaker. 
 
....Also like this President, he took to the stump to demagogue and skewer his opponents. 
 
....Like this President, he would invoke past Presidents, claim devotion to the principals of the Constitution, defend his use of Presidential power and attack Congress and the Senate, single out particular members to attack them for not supporting his actions. 
 
....Also like this President and the modern Democrat party,  when losing legislative disputes, he would look to the courts to settle those disputes. 
 
....Finally like this President, he acts and rules in the belief he is reacting to an unjust majority in Congress believing that majority is the result of a temper tantrum of the people and they knew not what they were doing.   

 

We are not in unfamiliar grounds. The difference is now we have professional politicians, and they now  behave as a ruling class.  Those individuals who would defend the separation of powers are now attacked by the royal media as "hostage takers'.  

 

I am not invoking the notion of impeaching this President, though the legal ground are there, for we have not the Congress and media with a proper sense of their functions.  I am saying you must look to this years elections as a chance to put back into Congress those who would protect the separation of powers.  Put into office those who would defend the institution they are being elected to and use for the good of the people the powers invested in that institution.  We survived the excesses of Johnson and Nixon, we will survive the excesses of this President IF you do your job.  This is what I say, what say you?
