In My Opinion: What's A Voter To Do?

VOTER I. D.:
Attorney General Eric Holder has declared war on states that try to ensure the integrity of their voting rolls by requiring some form of government identification. At he recent NAACP Convention in Houston, Tx.., he equated them to the old "Jim Crow" laws requiring payment before voting, the infamous "poll tax". Mind you those were repealed by the 24th Amendment to the Constitution and the Supreme Court in1964. Voter I. D. was upheld as eminently reasonable in 2008 by the Supreme Court when Indiana's laws requiring government I. D. was challenged.
The Attorney General believes it is his duty to protect the right of foreigners, and felons to vote, even though there are laws in many states that prohibit that. Those prohibitions too have been upheld by the Supreme Court. The Constitution leaves to the states voter requirements. In State elections they can allow felons and foreigners to vote or not.
TERM LIMITS:
In New York we have seen that even under clouds of ethic and criminal violations, and in the case of Congressman Charles Rangel, Congressional Censure, voters are loath to turn out of office their representatives. Also locally you have towns like Cortlandt where the elected officials have been their since the beginning of time and in Yorktown a councilman in his 16th year. So there are citizens who believe terms limits are the answer.
Those who believe in term limits act as if they wish to save the voters from themselves. In the Town of Cortlandt you have seen in recent elections opposition to the present representatives peaks at 30%. In Yorktown they have had three Supervisors in six tears and just voted out of office a councilman who had served twenty years. It seems to me voters have more than expressed themselves and their wishes. As for the voters preferring representatives of questionable character, you get the government you vote for and I am not ready to disenfranchise arbitrarily; the voter. It is, as it should be, up to the parties and the people to put up better candidates.
On this same topic, in Yorktown you have a very vocal group that wishes by public referendum to disenfranchise the voter by removing the Highway Superintendent as an elected position. They say it is order to create a DPW (Department of Public Works), however they can do that already without including the Highway Department. It has been said the it by making the Highway Department appointed it would give the council more control. But at what expense? At the expense of being accountable to the voter.
I believe that the integrity of the voting rolls is of paramount importance. I also believe, good or bad, agree or disagree, the voter's will be done. This is my opinion, you may beg to differ.

In My Opinion: Richard Milhouse Obama

Richard Nixon would be proud. Richard Nixon would feel vindicated. The Democrat Party and the media that so despised him have now fully embraced the concept of the "Imperial Presidency". Nixon's primary defense during Watergate "if the President does it, it is legal", has now been endorsed by President Obama and the press which screamed bloody murder, actually screamed "impeach the President" now sits by silent because it is now their "guy" doing it.
 
On Thursday 07/11/12 President Obama gutted warfare reform. He wrote out the work requirements for welfare with an executive command to Health and Human Services and Department of Labor. He believes that the work requirements that are the heart of the 1996 welfare reform (The Personal Responsibility and Work Opportunity Reconciliation Act of 1996) passed by congress and signed by then President Clinton can be waived or overridden by a legal device called a waiver authority under the Social Security law {section 1115 waiver authority under the Social Security law (42 U.S.C. 1315)}. . 
 
You did not know this because the press in it's continued role of protector of the President, had you worried if Mitt Romney left Bain Capital. in 1999, 2000 or 2001 as if it really matters. You are being told that Romney might have committed a felony by misrepresenting when he left Bain Capital. For the record when the press wanted Romney to be the Republican candidate and this same topic was brought up by Newt Gingrich during the Florida primary it was vetted by Time Magazine and the Washington Post, and they concluded that Romney spoke the truth about when he left. 
 
So why is this a story again? Easy. Obama is again treating the constitution like bird cage liner and the press does not want you to know. A duly enacted law such as this can not be waived away by executive order because the law itself says so. Obama issued this directive believing that the traditional TANF(Temporary Assistance for Needy Families) work requirements can be waived or overridden by section 1115 waiver authority under the Social Security law. Section42 U.S.C. 1315 which is the section Obama is using states that 'the Secretary may waive compliance with any of the requirements' of specified parts of various laws. However what Obama is purposely is ignoring is that any provision of law that can be waived under section 1115 must be listed in section 1115 itself. 
 
What is important to know and what Obama ignore's is the work provisions of the TANF program are contained in section 407. This section as well as most other TANF requirements, were deliberately not listed in section 1115 by Congress just to make sure future executive branch inhabitants could not do what this President has just done.
 
 
A lot of what Nixon did can be explained as the way politics was done in his generation. Obama does not have this as an excuse. Another big lesson of Watergate was that no one is above the law including the President. The national Democrat Party and their leadership as well as the press should be ashamed of themselves that now because their guy is doing it, it must now be alright. Hypocrisy has found a home with these now proven phonies. This is my opinion, you may beg to differ.

In My Opinion: There is Nothing Fair About It

"Tea party extremist such as yourself, Mr. Bazzo would rip to pieces every fairly negotiated public employee contract ever agreed upon. However, I am sure that would be just fine with you."


"Mr. Bazzo does not care about decades of legally negotiated contracts. Whatever loophole he and others can find to wiggle out of an agreement they will use. "


The two above comments more or less summarize the responses I get when I write about the unaffordable public employee contracts. "Fairly negotiated" and "legally negotiated" contracts , one term incorrect, the other correct. Yes, legally negotiated, but only in the perverse system we in New York live under. How ever,

"Fairly negotiated", no way, no how. The was and never has been anything fair about negotiations with public sector unions. The problem is there was never any one representing the employer, read that the tax payer.


Union representatives did what they were suppose to do, get the best deal for their members. Our government officials, whose job was to protect the tax payers and still hammer out a fair deal, did neither. What they did was hammer out a deal the would either get the union to support their candidacy with money, man power or both, or sit on the sidelines and not support their opponents. The tax payer was never part of the equation other than as a piggy bank. If you take the time to read the financial filings of the candidates and follow the money, you will see I am correct. The only solace we as taxpayer can take is that at least when our representatives are bought, they stay bought and deliver to the unions what they promise.


The union reps. have gone myopic. They forget that when you depend on other's money, you should make sure they still have it. You should not bite the hand that feeds you. As many published stories and reports can attest, union reps. have now taken it upon themselves to fight tooth and nail to protect the jobs of incompetents and perverts. So as not to lose dues paying members, they man the barricades when elected or appointed officials try to remove them from the tax roles.


Both parties have done what they could "legally" do, yet neither have done what they should do. Neither side has show any kind of moral compass or fairness to the tax payer. Quite the opposite, both sides show utter contempt for those who foot the bill.


In New York it has become standard to believe those who produce and wish to keep the rewards for their risk and labors, are now called selfish. The producers must be subservient to the takers, doing with less so the takers can have more. Under these conditions it would be fine with me if we could rip to pieces and use every loophole we can find to wiggle out of every public employee contract and start over. This is my opinion, you may beg to differ.

In My Opinion: Unemployment Lies

New York's unemployed has reached record levels, according to a notice I received from the New York State Department of Labor. New York does not have the money to pay these people. So it has to borrow the money from the Federal Unemployment Trust Fund (UI). Since 2009 the amount borrowed is in excess of 4 billion dollars. Every year New York must pay back to the federal government 102 million dollars in interest by 09/30. They do this by assessing New York businesses an Interest Assessment Surcharge (IAS) of 0.15% of taxable wages per employee to a maximum of $12.75 per employee. Remember this payment is only for the interest, the balance remains untouched.



The opening line in this notice states that the reason for this record level of unemployed workers is the national recession. Bah-humbug! The actual reason for New York's record unemployment is New York's anti-business economic policies. As there are 49 other states suffering through the national anti-business climate, yet many have lower unemployment levels than New York, per-capita. So it must be these other states have policies that encourage private sector growth.



It should come as no surprise that states that have more liberal economic policies: the redistribution of wealth, that punish success, that businesses who have the nerve to make a profit on their investments must be treated a criminal entities are the ones going broke.



In New York, the mantra being they must pay their fair share. The mantra being that businesses are started to create employment and pay health and retirement benefits, with all profits being property of the state. The mantra being that government can never do with less. What ever we pay ourselves and public workers both in pay, healthcare and pension is carved in stone as the least amount and when you are not looking, we will try to increase these levels of payment. These have lead to New York's biggest export, mid-level positions as business move them to more business friendly states.



New York's continued answer is to geld businesses rather than create a climate where new businesses can open and succeed, there-bye increasing employment and actual dollars to the state. To date not one unfunded mandate on local governments and school districts have been removed that would actually lower the costs and in turn property and school taxes. In fact there are bills passed this legislative session that increase these costs awaiting the Governor's signature. Don't tell me about property tax caps as they exempt pensions and litigation. Don't tell me about consolidation as that exempts county governments and school districts.



The biggest hurdle to lower unemployment is this continued resistance to our ability to harness our natural recourses. The states that have made it easier to harness their natural recourses have seen record levels of taxes flowing to their government coffers, record levels of employment. No, it is not national policies that hinder New York, it is state policy. This is my opinion, you may beg to differ.

In My Opinion: "A republic, if you can keep it"

In Maybury vs. Madison, the 1801 case that arguably codified as law the role of the Supreme Court a co-equal branch of government, Chief Justice Marshall for all intents and purpose said the constitution is what we say it is. In the recent ruling on "Obama Care", Chief Justice Roberts, an "originalist" moved the bar by stating for all intents and purpose that a tax is what we say it is. It is important to remember that through the entire process we were told from the President on down that the individual mandate was a penalty, not a tax.
I remember listening to the radio on the first day of oral arguments March 26, the justices dealt with this issue: Was the penalty imposed by the individual mandate in "Obama Care" a tax? If it was, the case would run afoul of the Anti-Injunction Act, which said a tax cannot be challenged in court until someone has actually been forced to pay it." The "Obama Care" taxes don't implement until 2014 and the court would have to throw it out because nobody had paid the tax yet. So the justices asked the government's lawyer, Solicitor General Donald Verrilli, is this a tax? The government's lawyer said no.


On the second day, the government's lawyer seeing how the questioning on the use of the "commerce clause" of the constitution was going, said, "If you don't like the Commerce Clause, we also think it's a tax."
It is there on the second day that Justice Roberts had his opening to rule out "Obama Care" through the "commerce clause", but rule it in as a tax.


Where Roberts drives logical thinking people nuts is where he writes that the mandate is a penalty for purposes of the Anti-Injunction Act, but is a tax for constitutional purposes. This prevents lawsuits based on the Anti-Injunction Act in 2014.

So we the people who cannot be protected from the political choices we make by the Court, according to Justice Roberts, must now take control of the situation ourselves. In this Roberts is right. Elections have consequences. Our mistake was looking to the courts to save us from ourselves.


This is a law that was fraudulently presented to us. Obama said the mandate was not a tax. Kirsten Gillibrand said it was not a tax. Nita Lowey said it was not a tax. The court said it was a tax. The government's lawyer said it was a tax. Our redress comes in November. Like Roberts wrote "we can throw them out."


At the first Constitutional Convention, Ben Franklin when asked "what kind of government are you trying to create?" , said "a republic, if you can keep it." The question this November is "do you want to keep it?'
This is my opinion, you may beg to differ.
