In My Opinion: Sometimes People Should Mind Their Own Business

Dear Readers:


Recently I had a chance to speak at a public hearing before the Peekksill City Council where the topics up for consideration were 1) should Peekskill lift the ban on tattoo parlors? 2) If the ban is lifted, where should they be allowed to locate? With respect to #2, the choices are industrial only, commercial (ie:shopping centers) , the artist district (it has been argued that tattoos are an art form) or all of the above. At no time would they be zoned for a residential,only area.


In full disclosure, I know Pat Conlon, the artist trying to open the tattoo parlor, he is a customer of mine. I spoke 1) in favor of lifting the ban and 2) that it should be located in the artist district. You can find this hearing on the City of Peekskill web site, click to videos, April 23 7:30 P.M. I speak 1 hour 17 minutes in to the video.


After speaking about this with the Mayor Of Pennysaver Community Bruce Apar, I had an epiphany. Whether a law should be changed is a proper topic for public opinions is fine with me. I do not believe where a business, especially a legally regulated business should be located should be decided on what the public thinks. The governments role in this should be 1) is it zoned properly? 2) Will it fall down? 3) Will it catch fire? 3) Will it flood out the neighbors? That's it. As far as the public is concerned, their only voice should be with their pocket books and wallets. Either they will patronize the establishment or they won't.


The business person risking their investment should be the decider of where they have the best chance to make a success. What has happened and it is a troubling trend, is that the municipalities and residents now think of themselves as partners, putting in their two cents without putting in a cent of investment. They are not and this trend must stop!


In the Town of Yorktown where I live, there are a number of buildings that exist that would not under today's rules. These building would have been stopped in their tracks by boards, councils and people afraid of what might happen. The history of these building have shown that none of those fears would have panned out.


In spite of this, the property owners and business investors would not have been allowed to maximize the value of their property. It is an insidious run around the "takings clause". All out of fear of what might be and if someone has an axe to grind about the type of business of the person trying to open it, or even the property owner. Yes, people have a right to their opinion, and they have a right to speak. However no where is it written that they have a right to be heard. Mine or anyone else's opinions about whether one likes or dislikes tattoos, wineries, big box stores etc. should dictate where those business should be allowed to operate. This is my opinion, you may beg to differ.

In My Opinion: Peekskill Is Safer Than You Think


Dear Readers:


The results of the Peekskill taxpayer paid "Peekskill Downtown Retail Recruitment Study" is in. This study, lasting about a year was presented to the Peekskill Council by Larisa Ortiz of Larisa Ortiz Associates. The results are from 1,711 respondents, about 60% from Peekskill, the rest from surrounding areas. The idea was to find out what people want to see developed on the waterfront and downtown.


Of course the starting point was the artist district, The Paramount Center and the various top notch restaurants. What was being sought was ideas for businesses to supplement this base of destinations of interests. The ideal group desired are those 35 and older with disposable income, as they already make up the majority of visitors and residents who shop Peekskill.


Realizing the available retail space and parking can not accommodate big box stores, the respondents said they wanted more boutique type businesses like clothing, and food. Yet, one obstacle to luring business to Peekskill are the hurdles one has to go through just to get started. The recent saga of the attempt to open a tatoo parlor in the artist district is a case in point. It has taken two years just to change the law to permit it.

Like most local governments, they do not take into account that the endless delays equals time and cost to those seeking to open a business.


The second major obstacle is the perception that still persists and the survey confirmed that people avoid downtown and the waterfront over safety and security. As a local Peekskill business man, I would like to address this. I am part owner of a taxi company licensed out of Peekskill and work the majority of my hours at night. It is my opinion that this perception of safety is not warranted.


Peekskill cabs unlike New York City do not have a barrier between customers and driver. Were safety at night a major concern, don't you think the cabs would install those barriers? Yes, there have been in the past problems, but that is because like most problems people encounter at night, they put themselves in a position to ask for trouble When one asks for trouble, it generally accepts.


Like you I do read police blotters and know that crime does exist. It also exists in other towns. In reading the blotters you would see that most crime is committed by those who reside outside of Peekskill. It is a testament to the Peekskill Police Department that dealing with a population with more economic disparities than the surrounding area, that they are as on top of the problem that they are. At any given time patrols and "stings" are a constant. Come on down, spend your money, in this case perception is not reality, you will have a safe, good time. This is my opinion, you may beg to differ.

In My Opinion: The Death Of Self-Government

Dear Readers:


As we await the Supreme Court to rule on the constitutionality of the "individual mandate", that which forces citizens to engage in commerce, whether they like it or not, under penalty of fine and/or imprisonment, in "Obama Care" here is what is being reported recently in the Hill.com (http://thehill.com/blogs/healthwatch/health-reform-implementation/220475-white-house-has-diverted-500m-to-irs-to-implement-health-law) : "The Obama administration is quietly diverting roughly $500 million to the IRS to help implement the president’s healthcare law. The money is only part of the IRS’s total implementation spending, and it is being provided outside the normal appropriations process."


During the debate leading up to the Christmas Eve 2009 Senate vote on "Obama Care" the funding of the IRS to hire 6000 auditors whose sole job is to make sure people and businesses are in compliance with this new law was part of the public debate. However when the new Congress took over in 2011 they did not provide funding for this. This is one of the pieces of legislation that the Democrat controlled Senate has yet to take up.


However this executive branch, in keeping with their continuing disregard for the other co-equal branches of government is using funds directed for other spending to fund this part of the law. So no matter how the Supreme Court rules, the IRS will have hired 6,000 new auditors. This is another example of this administrations increasing the size of government on the backs of taxpayers during this recession.


This is how socialists work. In this case the IRS is there to ensure that people comply. It will be part of your tax return. If you don't get health insurance, they're will fine you, and you will be audited. When did the premise of our constitution change where everything happens as a result of being forced by the government to do it? When did we become the servant public?


This is why Justice Kennedy was right when he opined that if the court fines the individual mandate constitutional, it will forever alter the relationship between the government and the people. This is why polls show between 60% and 70% of the people want this law repealed. The majority of the people do not want this relationship altered. They certainly do not want 6,000 new auditors snooping into their lives.


Most importantly this is why this is a seminal election. To preserve our way of life the way we have lived under and to insure our children and their children have the same freedom from government intrusion, we must elect to Congress and the Senate those who will repeal this law regardless of what the Supreme Court rules. For over 230 years, our constitution has theoretically been a limiting document insuring government serves at the consent of the governed. Left unchallenged, if you the voter stays home and do not do with your vote what must be done, come 2013, you will forever be the servant of the government. It is up to you to make sure this experiment in self-government does not die. This is my opinion, you may beg to differ.

In My Opinion: The Impending Tax Increase Tusami of 2013

Dear Readers:


Here is why I continue to believe that Mitt Romney, Rick Santorum or Newt Gingrich can beat President Obama. In 271 days; if Obama wins, the majority of Americans will be hit with a tax increase which this country has never seen. An unprecedented $494 billion tax hike. When the majority of voters learn of this, Obama and Congressional and Senate Representatives, Republicans and Democrats who allow this to happen will be toast.


34 percent of the tax increase comes from the expiration of the 2001 and 2003 Bush tax cuts. These cuts are best known for reducing marginal income tax rates, but they also reduced the marriage penalty, increased the Child Tax Credit, the adoption credit, and increased tax breaks for education costs and dependent care costs. Another 25 percent comes from the expiration of the once-temporary payroll tax cut.


'The expiration of the patch on the Alternative Minimum Tax (AMT) accounts for 24 percent of the total potential 2013 tax increase. The balance of the tax hikes comes from new taxes under Obamacare, It is an explosion of tax increases intended destroy disposable income. Is is all planned to hit after the election.


President Barack Obama has kept his silence, The Democrat controlled Senate has made no effort to prevent this impending calamity to the economy. Since April 2009 they have not proposed one alternative budget proposal, though they are constitutionally required to do so. In the one thing that has brought both parties together in unanimity, both of this Presidents last two budget proposals have gone down to unanimous defeats with not one member of either party voting for them. The Republican controlled Congress has passed two budget proposals with some Democrats voting for them.


The President, using demagoguery and lies has derided both of these proposals. Even though both proposals increase government spending, not one entitlement gets less money, only the rate of increase is reduced, our President insists the Republicans and the thirty or so Democrats that voted for these proposals want children to starve and worse get sick. They want Grandma and Grandpa to not only starve, but get sick and die. He is counting on the ignorant and ill-informed not only to believe this but to vote for him.


The saddest part of this discussion is that these Republican proposals do not attempt to balance the budget for thirty years. This means nothing will happen to balance the budget. No Congress can bind another Congress to these proposals. Every Congress has a right and constitutional duty to make their own budget. The Republicans kick the can down the road. This is why the Congress is held in low esteem. They were elected to do something now, not later. Do not become part of the ignorant and ill-informed. Let your Congressional and Senate candidates know you want something done now...or else they too will become part of the 8.2% unemployed. This is my opinion, you may beg to differ.

In My Opinion: Why It Must be Gingrich

Dear Readers:


The race may not always be to the swiftest, nor the battle to the strongest, but that's the way to bet. So said my father to me over and over again. People may root for the under dog, but they stand with the top dog. Nobody really likes to lose, which is why the establishment usually wins. The look at the odds, see the lay of the land, write rules that favor themselves, and finally follow the money.


So ,like in 2010, when the underdogs (Tea Party backed candidates) actually won, against prevailing wisdom, they were taken by surprise. However, the establishment also knew they would be elevated into the leadership of the Party, Congress and control the committees. With that control, the establishment would be able to pick the Party nominee for President. Do not let these primaries fool you, the establishment would never actually let you pick the standard bearer. The establishment wants Mitt Romney, and if you actually cast enough ballots in the primaries to thwart their plans, they have the "super delegates", who are beholden to the party, to cast their ballots at the convention for the establishment candidate.


Both parties do this, you saw it in 1976 on the Republican side and in 1980 on the Democrat side. Look at all the establishment Republicans lining up, endorsing Romney. Follow the money. A betting person would pick Romney. You are being told he is the most electable. What they really mean, he is the most controllable. Make no mistake, it is all about control. Control of Congress, the Senate and the levers of power.


Any of the three standing Republicans ( I do not count Ron Paul ) can beat President Obama. There is no way I can be convinced that 50.1% of the voters will vote for four more years of this. Unlike 2008 when Obama was a blank slate and Conservatives stayed home, this year, people know this is a seminal election. They know that if Obama wins, it is the end of limited government. Washington will no longer serve the people, the people will be servants of the government. They know this because Obama is no longer a blank slate. He is an ideologue, more than willing to govern against the will of the people.


On April 24, 2012 Republicans in New York will go to the polls in what seems to be a meaningful primary. You can still send a message to the establishment. Were I a registered Republican, I would vote for Newt Gingrich. Of the three, Gingrich when in power, when his votes counted, was the only one who did not sell out the Conservatives as he walked across the isle to work with Democrats. Any one who has fond memories of the economy of the 1990's, can not do so without not only giving President Clinton credit, but also Gingrich. Do not let the media and establishment pick the next nominee. Send a message that you still count, vote for Gingrich. This is my opinion, you may beg to differ.
