Dear Readers:

I received an e-mail from a member of the anti-DiBartolo crowd wishing to meet with me in an effort to win me over to their side in the Highway Superintendent Eric DiBartolo saga. I am answering this e-mail publicly to set matters straight once and for all. These are the reasons I will NOT meet with them:

a)Ibelieve there is an underlying agenda to blacken the character of the Highway Superintendent in an effort to bias the voting pool so when the referendum to eliminate the ELECTED position of Highway Superintendent is put on the ballot next year (which I believe is a real possibility), the voters will elect to eliminate the elected position and clear the way for the creation of an appointed position Director of Public Works which I am against.

b) He uses the term "evidence". We are not in a court of law, only the court of public opinion, so what they have are accusations, not evidence. These accusations have been vetted in last years election, and at the public forum at town board meetings. Some have already been addressed. I believe if there was any merit to their accusations the proper authorities would already be studying them. When and if they do, I will wait as I have done for the three years I have been writing my column, for the NCN to report on the findings then and only then will I opine on the matter. I will react to the same information that the readers have.

5) I believe in the presumption of innocence. This is what sets our judicial system apart from most other countries. The accuser must prove their case, the accused need not prove their innocence. I will not be a party to and at this time, a smear campaign.

This is how I feel and as both this blog, the "Bazzo at Work" blog on NCNLocal.com and my "In My Opinion" column in the NCN are based on my reactions to issues concerning my readers and the readers of NCN, I do not need anyone to tell me how I feel.

The Volpe Report has resumed scheduling for 2010. The next showing is special guest Yorktown Highway Superintendent Eric DiBartolo. Eric gives us a rundown of the events of the recent snowstorm and also some of the concerns he has with Yorktown's new administration. I also would like to acknowledge I have asked Dave Paganelli, owner of the The Traveler's Rest, to co-host and he has gladly accepted.

The Volpe Report is aired on public access Channel 74 in Yorktown on Thursdays at 6:00pm. Peekskill/Cortlandt viewers can watch on Channed 15 on Thursdays at 9:00pm.

Sculptor Richard Masloski and the Wizard of Oz

In his first show as the newly elected Westchester County Legislator for District 1, John introduces artist and sculptor Richard Masloski. Masloski is well known world-wide for his high level of artistry and especially known for many works throughout Westchester, including the "Lincoln in Peekskill" statue at the Lincoln Depot historic site in Peekskill. In this show Masloski, along with City of Peekskill Historian John Curran, discusses the connection of the Wizard of Oz author L. Frank Baum to Peekskill and the project he hopes to complete which is inspired by this theme.

I'v got to take a moment to continue our conversation from the cab the other night on the Citizens United decision. As I stated, while I am not opposed to the result, that corporations should be able to spend money on political ads at any time about any candidate or issue, I have a big problem with the basis for the court's decision.

The court held in no uncertain terms that a corporation has first amendment rights. How can anyone who claims to be conservative not stand up and cry out in outrage about the massive change in our society that such a decision brings with it.

Corporations are now citizens, with the same rights citizens enjoy. Okay, so can GE register to vote, or petition to adopt a baby. If they are denied those rights because they are corporations, do they not have a case that such decisions are unconstitutional discrimination.

I am not prepared to have corporate persons enjoy the same rights that living people enjoy. Do corporations enjoy equal protection under the 14th amendment? This case suggests that they do.

It is such an insane position to take that I don;t understand how you can support it. I get that you like the result. You are in teh minority by the way, since recent polls suggest the 80% of american (including 755 of republicans and 85% of democrats) are opposed to the ruling.

That is all that should matter. If the majority supports telling businesses what they can and can not say, a law shoul dbe passed. Isn't it you who are always speaking otu against judicial activism. Is it only when the judicial activism produces a result that you disagree with that you complain about activist judges.

the problem with that is that you reap what you sow and allowing judges to take such leaps allows them to do other things when the make-up on the court is different.

This was a terrible mistake that should be corrected immediately with an amendment to the US Constitution. It seems we have the supermajority necessary to accomplish such an act.
