Dear Readers:

On Monday night June 1, 2009 the Yorktown Democrats will nominate candidates for their fall slate. I am going to take this opportunity to put my two cents in before they gather. There is some controversy over some of the prospective nominees. This is not to be confused with any type of endorsement for November. This is just my endorsements for nomination to run in November.

County Legislator District 4

This is a no brainer. Mike Kaplowitz is the only choice. This district, this party needs him to continue to represent it. In the halls of the county legislature Mike is the smartest guy in the room. He knows it is our pockets the County Executive and down county Legislator's want to pick. The redistribution of wealth starts with us. Mike is the only one fighting for us. He has done this at great political risk to himself. The only chance we have to unseat the Legislature's Board Chairman Bill Ryan is re-electing Mike to lead the charge.

County Legislator District 1

Though only a small part of Yorktown, it none the less encompasses Mohegan Lake, Shrub Oak and Jefferson Village. We already know the Republicans have nominated former Peekskill Mayor John Testa. The only person who stands any chance at all to beat the former mayor is Domenic Volpe. This is going to be the race to watch on the county level. It will be hotly contested. John is a tireless campaigner and has a great record as the former Mayor to run on. A fiscal conservative, a man of principal, John is unstoppable against any other candidate. The only way the Democrats can even stand a chance is to nominate the same kind of candidate, that person being Domenic. He too is a fiscal conservative, and a man of principal. On top of that, Domenic has run this race before and knows the territory. Both John and Domenic are life long residents and have roots through out the district. In full discloser, I am friends of both and believe this will be a close contest that might be decided by write-in votes. Neither candidate will run away with this election.

Town Supervisor

This is another no brainer. Don Peters has earned the nomination to run for a second term. He has opened town government to unprecedented degrees. He has reigned in town spending, producing a budget that had a less increase in taxes than Cortlandt, another feat unprecedented, all the while keeping services up to par. He has shown political courage in opening up the discussion of police department consolidation during an election year. He has shown courage of character when secretly taped during a Christmas Party by standing behind his comments and not back tracking like your typical politician would have done. His mistakes are mistakes because he is not a politician and were process mistakes. His heart has always been in the right place. In full discloser Don has been a life long friend and I am proud to champion his cause.

Town Council

1) David Paganelli: This one should be unanimous. He is not from the political class, but the business class. We need another businessman on the council to compliment Peters. Plus his commitment to the community through his charitable works can not be denied, as he has used his money and time and not the tax payers. He is truly pure of heart. His reach through out the community and at county and state levels would be a boon to the interests of Yorktown. In full discloser he too is one I am proud to call friend.

2) Vishnu Patel: He has earned the nomination. He has new ideas and thinks out side the box. He has also shown commitment to the community through his many volunteer efforts. The town council needs new blood and ideas. Vishnu personifies that. His time has come. By nominating Vishnu and David, the Democrat committee would be speaking in bold strokes not pastel colors.

3) Lou Campisi: His time has come and gone. Like George Oros at the County level, Lou must move on for others to have their chance. He should spend the next year gathering support to make a run for Assembly District 99 as Greg Ball makes a run for Congress. He should learn from George that he will need time to seek higher office. He should stop threatening to primary, it does a disservice to his party and the town. Like his council partner Mat Metz, Lou should seek another venue to serve the people and by stepping aside he would garner the good will from the party needed to move up the ladder.

4) Nick DeTommaso: Another threatening to primary. He is a one issue candidate, that issue a stand alone Senior Center. This is an issue that will raise town taxes and in this economy ill advised. The Seniors have a center already and a promise of state funds to upgrade it to something the seniors can be proud of. Nick should stick to his cable t.v. show and stay a public advocate, there he could do the most good for the town.

This Wednesday June 3, 2009 I will be the sole guest for one hour on the Cable T.V. show "Down The Middle" from 8-9PM channel 74 in Yorktown and Putnam Valley. It is a balanced show in which two liberal Democrats take on one conservative. This is my best work. Any Republican seeking election or just a lesson on how to debate a Democrat should watch this show a take notes. You will see two Democrats totally lose the debate in the political arena of ideas. I await your e-mails after watching this show.

“Speak Out” with Assemblywoman Sandy Galef:
Presents Roundtable on Sharing and Consolidating Services

(May 29, 2009) On February 12, 2009 Assemblywoman Sandy Galef hosted a dialogue with officials from each of the towns within her district, as well as representatives from Putnam and Westchester County Executives’ offices. Assemblywoman Galef will be broadcasting February’s discussion on her cable television show “Speak Out with Sandy Galef.” The special will air in four parts consecutively from June to September.

The Roundtable, which was co-moderated by Assemblywoman Galef and Chairman of the Westchester County Association and former Westchester County Executive Al DelBello, focused on ways for local municipal leaders to deliver services for less through sharing and consolidation. The roster for the roundtable included: Putnam County Deputy Executive John Tully, Senior Assistant to Westchester County Executive Karen Pasquale, Briarcliff Trustee Robert Mayer, Buchanan Trustee Sean Murray, Cortlandt Town Supervisor Linda Puglisi, Croton Mayor Greg Schmidt, Kent Town Supervisor Katharine Doherty, Nelsonville Trustee Anthony Merante, Ossining Town Supervisor Catherine Borgia, Ossining Mayor William Hanauer, Peekskill Mayor Mary Foster, Philipstown Town Deputy Supervisor Richard Shea, and Putnam Valley Town Supervisor Robert Tendy. The panel members shared their experiences with sharing and consolidation. They discussed what they had achieved in their municipalities, how they are currently working on consolidating services, and what obstacles they have faced while cutting costs and streamlining services for their constituents.

“In light of these difficult economic times it is important that counties and municipalities operate more efficiently and deliver services for less through sharing and consolidation,” said Galef. The Assemblywoman sent out a questionnaire last fall on sharing and consolidation of government services, and her constituents responded with overwhelming public support for sharing services to cut costs. Recently, Galef has formed a shared services task force with community residents and members of her legislative district to more deeply explore the possibilities of cost-cutting alternatives in government structure and operations.

Darren Rigger Selected to Participate in International Exchange to the Republic of Korea
Political Study Program to Focus on Citizen Diplomacy

WASHINGTON, May 1, 2009 – Darren Rigger has been selected by The American Council of Young Political Leaders (ACYPL) as a delegate to the Republic of Korea for a 10 day political exchange program beginning on June 5, 2009. He will join 6 other young political and policy leaders from across the United States to study Korea’s political system, engage in dialogue on international issues, and forge professional relationships and friendships.

“ACYPL has the unique mission of proving select young leaders with an opportunity to travel internationally and engage firsthand in public diplomacy”, said ACYPL Chief Executive Officer Linda Rotunno. “Our delegates have access to key leaders in the nations they visit. They engage in dialogue on sensitive issues, gain a unique perspective on the country’s politics and its relations with the US, and, most importantly, forge professional relationships and friendships that can last a lifetime.”

Darren Rigger is the Chairman of the Peekskill Democratic City Committee, serves on the Westchester County Democratic Committee and works for both Congressman Charles Rangel and Hudson Valley Congressman John Hall. He will join other delegates, each between the age of 25 and 40, in Washington, D.C. for briefings by the U.S. Department of State and other Korean regional experts before flying to Seoul. I always enjoy reading your blog. This week, you included a "message from Greg Ball" which was really just a desperate plea for money surrounded by quotes. Ball cherry picked quotes like he was creating an ad for an upcoming bad movie. Many of the quotes were from an article that appeared in Roll Call newspaper. Roll Call is a political insider newspaper. I think in fairness people should be able to read the entire article (which I have attached below). This article reflects how many people in Washington see Greg Ball.

Politics & Poker: Ball Invites Scrutiny With ‘Google Me!’

"Google me!”
New York Assemblyman Greg Ball says this more than a few times in a recent conversation with writers and editors from Roll Call and the Rothenberg Political Report.

Ball, the likely Republican nominee against Rep. John Hall (D-N.Y.) — and a top recruit in the eyes of the National Republican Congressional Committee — is defiant as he invokes the G-word. Yeah, there’s a lot of crazy stuff out there, he concedes. But it’s also, he argues, a sign of how thoroughly battle-tested he is.

“Google me!”

The taunt has echoes of Gary Hart in 1987: “Follow me around.” Hart, in an interview with the New York Times Magazine that sure seems creepy in retrospect, was trying to debunk persistent rumors about his womanizing.

Little did he know that the very day those words were printed, a reporter from the Miami Herald, acting on a tip, was doing just that, turning up in the bargain a tasty morsel named Donna Rice. So much for Hart’s frontrunning presidential campaign.

“Google me!”

For his history-altering scoop, the Herald’s hardworking Tom Fiedler flew to Washington, D.C., hid in bushes, conducted round-the-clock surveillance and then confronted the principals. But in the 21st century, our “investigation” demands just a few strokes of the computer keys.

So we Googled Greg Ball. He’s right, there’s an awful lot out there. For a guy who is just 31 years old and in his third year in the Legislature, there are already 267 footnotes on his Wikipedia entry — that says something about the kind of passions he inflames.

“There’s controversy surrounding him in the past and there’s going to be controversy around him going forward,” says Michael Edelman, a Republican consultant and commentator in Westchester County, one of the five counties in the Hudson Valley district Ball is hoping to represent.

What kind of stories does Google reveal?

Well, for starters, Ball was accused of stalking a former girlfriend, who got a temporary order of protection against him. He’s been accused of posting on the Web misleading photographs of an encampment of illegal immigrants in his legislative district. A dead goat was found recently in his front yard — the work, Ball believes, of Salvadoran gangs who oppose his tough anti-immigration stance — and he’s been sleeping with a 12-gauge shotgun under his bed ever since. And until recently he has been in a vicious blood feud with his political enemies — who by the way, happen to be fellow Republicans.

Oh yes, Ball was also accused of sexually harassing a former Assembly aide. Details of this are scant on the Web, but in his conversation with Roll Call, which borders on the surreal at times, Ball dutifully provides some. The woman, he says, was put up to it by the establishment Republicans who were waging jihad against him. And the bottom line, from his point of view, is that the Assembly Standing Committee on Ethics and Guidance “cleared” him.

Which is technically true. On Oct. 20, 2008, the committee issued a letter — which is available online — saying an investigation into the accusation found that a violation of the Assembly’s Sexual Harassment/Retaliation Policy “was not established.” The committee also makes it a point to say that the statute of limitations on the woman’s accusations had run out, so the Assembly couldn’t have taken any action anyway.

A clean exoneration? Ball likes to think so. Google him — and judge for yourself.

It’s worth noting that additional dirt about Ball exists in the political ether that surpasses some of things that are out there in cyberworld. The point here is not to titillate, or to sling mud. The point is to ask, is this guy really viable?

Ball has many admirable qualities and an interesting story to tell. The son of blue-collar workers, he got a Congressional appointment to the U.S. Air Force Academy and worked a bunch of policy jobs in Washington, D.C., after his discharge. Since launching his political career, he’s been a ferocious reformer, unafraid to take on the entrenched interests of his party and the Democrats who run Albany.

Ball is handsome, driven and indefatigable, and he has advanced a populist political agenda that’s appealing and hard to pinpoint on the ideological spectrum.

“Democracy is not a spectator sport, and I am in this fight not to tear down the incumbent, but to restore America’s promise to the Hudson Valley,” Ball said during the formal announcement of his Congressional bid Saturday. “Blue-collar folks like my family and friends feel shafted by elitist politicians on both sides of the aisle. The unsustainable spending, the bailouts, the corporate welfare, the runaway defense contracts; all of this must stop and we must refocus our priorities in this time of crisis.”

Ball is reminiscent of a young Rahm Emanuel. He’s got a sharp political mind and an intense focus. And you get the sense that he’s got the 19th Congressional district, with its wealthy suburbs and rural areas, blue-collar precincts and liberal enclaves, wired. He’s studied the place since he was a kid, and he knows where his voters are and how to reach them.

With all due respect to the incumbent, it’s a sure bet that Ball will outwork John Hall in the 18 months between now and Election Day 2010.

What’s more, in the post-Clinton era, politicians can weather all manner of sex scandals. Sen. David Vitter (R-La.), after all, appears on his way to re-election, despite being linked to a D.C. prostitution ring.

But it’s a little trickier to survive this kind of stuff when you’re a fresh face, trying to introduce yourself to voters. Just ask Mike Erickson, the businessman who was the Republican nominee the past two cycles in Oregon’s 5th district. His candidacy was undone last year by reports that despite his opposition to abortion rights, he had driven a pregnant ex-girlfriend to a medical clinic to get an abortion. Erickson had an explanation, and maybe it seemed plausible to him — but it didn’t wash with the voters.

Alex Coronado (R), a local school board member, was waging what seemed like an earnest, appealing long-shot challenge to Rep. Loretta Sanchez (D-Calif.) in 2004. But in a conversation with Roll Call that was every bit as surreal as the one we had with Ball, Coronado started talking, unprovoked, about the man who was stalking her and her teenage daughter. She lost by 20 points.

That same year, Pueblo County Sheriff Dan Corsentino (R) seemed like a leading candidate for an open House seat in Colorado’s 3rd district, until he became undone by multiple sex scandals involving his office.

Greg Ball is a talented guy. But he seems to be the opposite of teflon. Just the other day, the local media were raising questions about the paperwork for his declaration of candidacy. A small matter, perhaps, but emblematic of something bigger.

Greg Ball may take comfort in knowing what’s out there when people Google him. But he’s never faced attacks like the kind the Democratic Congressional Campaign Committee and liberal interest groups are going to throw his way. It’s all too easy to see the 30-second ads with the words “stalker” and “sexual harassment” in them.

“John Hall is not going to mess around with him,” Edelman predicts.

And that alone may be enough for Hudson Valley voters to conclude that Hall is “still the one” in 2010.

A MESSAGE FROM CANDIDATE FOR YORKTOWN COUNCIL TERRANCE MURPHY:
Murphy represents Yorktown residents at Senate Hearing
Local Entrepreneur and Councilman Candidate urges lower taxes, better business etiquette

In a time when stimulating the economy and attracting businesses are the topic of much debate, the best answers can be given by those most experienced in creating jobs and sustaining growth. Therefore, when the New York State Senate Republican Program Development Committee chose to host the first of a series of hearings to develop an economic action plan in Yorktown Heights, local business owner Dr. Terrence Murphy was asked to give testimony on behalf of his fellow residents to offer several of his own common sense solutions towards getting the local economy back on track.

“I have lived in this town my entire life and can tell you first hand Mom and Pop shops like mine have been the life blood Yorktown has lived off of,” Murphy said. “Operating in the number one taxed county in the nation seriously threatens these establishments and prevents new ones from emerging.”

Dr. Murphy offered two ideas to strengthen existing and welcome new small and medium enterprises in Yorktown.

“Through my fourteen year experience as a small business owner here in Yorktown I see two common sense solutions,” Murphy stated at the hearing in the Mercy College auditorium. “First, we need to reverse the direction our taxes have been going. Lowering taxes on the county and town level will allow small businessmen and women the opportunity to live their dreams of owning their own establishments in addition to sustaining already existing businesses. Second, all levels of government need to lift the numerous obstacles already in place and welcome new businesses. This begins by improving our business etiquette. It is all common sense.”

After the hearing concluded, Murphy joined several prominent lawmakers and area chamber of commerce leaders to discuss his idea to repeal and recreate section 925-s of the state’s general municipal law, which would provide for the establishment of the town of Yorktown industrial development agency (IDA).

“IDAs are created to promote economic prosperity and actively attract and encourage development in the area in question," Murphy stated. “The Yorktown IDA ceased to exist since there were no outstanding bonds or obligations. The town board should be working to pass a local bill that would call on the state to reestablish the Yorktown IDA and promote economic and recreational opportunities for our residents.”

Murphy warned that the current economic climate is making it tougher and tougher for local businesses to survive. “My two businesses employ over 70 people and if things do not start to change 70 people will be looking for new jobs,” he added.

Dr. Murphy owns the Yorktown Health and Wellness Center on Commerce Street and is part owner of the family run Murphy’s Restaurant on Kear Street.

Will Modernize District Attorney's Office to Better Protect Westchester Citizens
White Plains, NY, May 27... Dan Schorr, an experienced prosecutor and candidate for Westchester District Attorney today announced that he will utilize GPS monitoring bracelets for criminals in Westchester County. GPS monitoring devices are currently being utilized across New York State, including all 5 boroughs of New York City, Rockland and Nassau Counties, among others.

"GPS tracking bracelets are the next best thing to assigning a police officer to each dangerous offender 24 hours a day, 7 days a week." said Dan Schorr, a former domestic violence and sex crimes prosecutor in Queens and Westchester Counties. "This technology provides a new level of protection against criminals and does so without any cost to the taxpayer."

Satellite tracking bracelets are affixed to the ankle of the perpetrator to monitor their real-time whereabouts. The coordinates are sent by the unit to a central computer, which plots the position using mapping software to tell if the offender is in or near a restricted area.

This technology is often used in cases where an Order of Protection is issued, particularly in cases involving domestic violence. When the offender gets within a specified distance of a restricted zone, a text message is automatically sent, notifying the local law enforcement agency and the victim. Multiple zones can be programmed, such as the victim's home, workplace, or child's school.

The cost of the device and 24-hour surveillance is approximately $15 per day. The offender is required to pay all costs as a condition of their release. Many criminal justice agencies contract with companies to provide the bracelets and to monitor the wearer's movements.

"There is no reason why Westchester County should be behind the times in employing new technology to keep our citizens safe." Mr. Schorr continued. "As DA, I will modernize the District Attorney's office to increase efficiency and better serve crime victims."

Mr. Schorr served as a prosecutor in Queens and Westchester Counties, specializing in domestic violence, sex crimes, child abuse, and homicide cases. Having served as an Assistant District Attorney, Mr. Schorr has compiled extensive trial experience and a strong record of convictions.

Blasts Westchester District Attorney DiFiore for Silence

Bill Would Allow Convicts to Work in Schools, Nursing Homes
White Plains, NY- May 28...Dan Schorr, an experienced prosecutor and candidate for Westchester District Attorney today blasted the provision in the Rockefeller Drug Law reforms that allows judges to seal offender's records from potential employers.

"This provision provides a glaring loophole through every protection we have worked so hard to put in place." said Dan Schorr. "This is a dangerous move that will open the door to potential felons working in our schools, hospitals and day care centers without anyone being the wiser."

The provision goes into effect June 8 and was passed in a series of reforms to the drug laws enacted under former Governor Nelson Rockefeller in 1973 to give mandatory sentences for many drug crimes. The reforms were passed as part of the 2009-10 State budget.

Mr. Schorr said as DA, he would band with the other county District attorneys across New York to call for a repeal of this measure. He called on Westchester DA Janet DiFiore to publicly take a stand on this issue.

"While other District attorneys across the state are standing up against this dangerous provision, our DA in Westchester has been silent," Mr. Schorr declared. "The public deserves to know if she supports sealing the records of convicted drug criminals to potential employers."

Thursday's joint meeting will be about taking substantive action" Ball said. "If the business community is up to the task, and I believe they are, I can assure them that as elected officials we will stand by them and say, 'Enough is enough, we have reached our breaking point, and will be abused no longer!'"

What the hell is wrong with the bureaucrats at the Cortlandt Court House? First we had the saga of a citizen trying to pay a ticket early(see "A Fine Mess In Cortlandt" & "A Fine Mess In Cortlandt Continued"), now we have a scheduled court appearance canceled because the court house was closed for the Memorial Day Holiday.

In this weeks NCN there is a story on page 7 about five people in Mohegan Lake arrested on drug charges. They were scheduled to appear in court Friday May 22. Now I know nobody is going to feel sorry for these people arrested, so what if they are inconvenienced? How ever there were parents who took the day off of work to appear with their children and lawyers who had to make room on their schedule to be there. Was their inconvenience part of the deal also? They did nothing wrong. Now they will have to do this all over again June 1.

Who the hell is in charge of scheduling? Are they unfamiliar with the fact that the Memorial day Holiday falls at the end of May? Does their calendar not reflect this national holiday? When a few of the parents attempted to find out what happened they were met with bureaucratic double talk. No apology for their inconvenience was offered.

The first issue dealing with the ticket might have been an aberration. This second issue now is a pattern of incompetence. I think it is time for those in charge of the court house to get a lesson in dealing with the public. An apology to the parents, the lawyers and those arrested for this mix up should have been issued. Human error is not a crime, and owning up to it is not a sign of weakness. Making the best of a bad situation by doing what's right is never wrong. The right thing in this case would have been a truthful explanation of human error and an apology.

RE: LAST WEEKS POST "PEEKSKILL HOLLOW ROAD WORK OR ROAD BLOCK?"

Andy, I think that you misunderstand the views of those opposed to the existing Peekskill Hollow Road plan. The current plan calls for construction of four foot shoulders on each side of the road, from Oregon Corners to Adams Corners. This involves takings from 47 property owners. It also calls for replacing the bridge on Oscawana Lake Road with a four lane bridge, and for four lanes at the intersection of Oscawana Lake Road on both sides of Peekskill Hollow Road. Additionally, it will take parking away at Oregon Corners which could be devastating to the Deli. These are the parts of the plan that those of us opposed to the plan object to.

We support rehabilitation of the bridges with their current parameters, turning lanes at the High School, proper drainage (under the existing road, not under newly created shoulders) done in such a way that it doesn’t threaten the health of Peekskill Hollow Creek.

During the three years of the traffic study in preparation for this plan, there were no accidents at Lovers Lane. In fact, the accident rate for the entire length of the road was below average except at a couple of intersections. Oddly, these have not been addressed. Yet they could be solved with simple, low impact changes. I have spoken with the Putnam County Sheriff, Undersheriff, and several Deputies. Without fail, they have all said that adding the shoulders will make the road less safe because it will encourage greater speeds. Further, our Emergency Services people have said that Peekskill Hollow Road is not a dangerous road.

At the meeting with the County legislature regarding Peekskill Hollow Road, over 100 people turned out. The vast majority was there to oppose the plan as it stands. It was called the largest group to ever turn out for a single issue. Understand that this huge turnout, on a Wednesday night, represents many times that number. Many of them live on Peekskill Hollow Road, not on paved side roads. Drive the length of the road and you will be convinced by the huge number of signs people have posted.

Four foot shoulders on each side of the road would be a widening of nearly 50%. That is not a “mildly expansive” change of the current footprint, as stated by Legislator Fusco. Rather it is a major change, one that is unnecessary, and therefore unacceptable.

Finally, the overturned cars that Legislator Oliverio talked about in his remarks were caused by a condition that has already been partially addressed by the traffic light at the High School. Adding proper turning lanes would be the rest of the fix. That problem is not a reason to change the whole of the road from Oregon Corners to Adams Corners.

"John works extremely hard, has accomplished great things as a Mayor and will do an outstanding job as County Legislator," proclaimed Oros.

It was pointed out by all who spoke that John Testa's record speaks for itself. His non-partisan approach enabled John to accomplish much for the community. "I never approach issues in a partisan way," Testa said. "On the local level especially, it's about the individual, not the party. I have always been able to rise above petty politics. There is no room in good government for politics," said Testa.

In his speech, John explained his dedication and drive to serve the people he represents. "I take public service very seriously and never forget who enabled me to hold office. It must always be about the people first, not the one who is in office," said Testa. "I have a record of streamlining government, reducing spending and cutting taxes. During my last three years as mayor we had budgets with 0% tax increases. I want to bring my experience and passion of service to the County Legislature and am excited about serving the people of Northern Westchester," added Testa.

White Plains, N.Y. (May 18, 2009) --Westchester Republican County Committee Chairman Doug Colety today condemned County Executive Andy Spano for over-the-top security measures utilized at his nominating convention Wednesday evening at the Westchester County Center.

Westchester County Democrats gathered to nominate Mr. Spano, whose disregard for the taxpayers has been criticized over the past 12 years, and has caused a near-revolt of Westchester residents. Security for the event entailed more than two-dozen county police officers, most receiving overtime pay and others pulled away from their regular posts to cover the event. In addition to the uniformed officers, bomb-squad personnel, four DA investigators, and three officer-mounted horses were on hand for security.

Chairman Colety questioned who was paying for the county services for a political event and demanded that Andy Spano reimburse taxpayers for any costs associated with the convention.

A MESSAGE FROM ASSEMBLYWOMAN SANDRA GALEF;
Assemblywoman Sandy Galef Announces Results of 2009 Constituent Survey

(May 20, 2009) Assemblywoman Sandy Galef 90th AD, has announced the results of her most recent constituent survey, citing that 979 constituents responded to the various questions regarding topics such as voting policies, consolidation of local governments and school districts, and use of electronic devices by minors while driving.

“These surveys help me understand how the people in my district feel about current important issues,” Galef said. “By asking a variety of questions, the community members in the 90th AD have a chance to share their thoughts with me which often helps shape my votes on these important subjects. This questionnaire touched on a cross section of topics from teen driver safety to elections to political robo-calling and more. It has provided me a great sampling of views from my constituents which I will strongly consider when introducing or voting on legislation.”

The greatest positive response was from 94% of respondents who said that the state should allow telephone recipients of political robo-calls to have their requests to be removed from their call lists honored so they can avoid receiving future calls. In addition 75% said yes, a non-partisan commission should be established to redraw state legislative districts after the next census is completed. When asked if New York should join other states in calling for a presidential election by popular vote rather than by vote of the Electoral College, 75% said yes.

An overwhelming 93% of respondents believe that drivers under 18 years of age should be banned from using handheld or hands free electronic devices such as cellphones, PDAs, iPods, or GPS devices while driving.

Regarding transparency within governments and school districts, 85% said that the state should require all governments and school districts to make tentative collective bargaining agreements available to the public at least two weeks prior to the agreement being ratified by either side. 73% believe that it should be easier for citizens to dissolve government-created districts, fire districts, or special districts. When asked whether we should empower the New York State Education Commissioner to order the consolidation of school districts where the Commissioner deems it prudent to do so, 55% said yes.

In answer to the question about whether New Yorkers should be allowed to vote by absentee ballot even if they may not be out of the area on Election Day, 55% of respondents said yes. 69% of respondents believed that all voting in a community should take place on two to three days in a calendar year, including elections for political offices and local building projects. The closest margin of views was regarding early voting for general elections in November: 51% of respondents said that New York should not adopt early voting.

Assemblywoman Galef has already been working towards many of these reforms in the Assembly. She has introduced two pieces of legislation regarding these survey results, one pertaining to the regulation of political robo-calls (A4174), and one requiring all governments and school districts to make tentative collective bargaining agreements available to the public (A6338). In addition, Galef is currently working on legislation that would make it easier for citizens to dissolve government-created districts. Lastly, Galef is a co-sponsor of a bill to prohibit the use of electronic devices while driving (A2453) as well as co-sponsoring another bill which would have New York join other states in calling for presidential election by popular vote rather than electoral vote (A1580B).

“I will work with my colleagues in the legislature to pass many of these proposals which my constituents care about so deeply. It is important to keep the communication open so that every voice is heard and I will continue working towards my district’s and the state’s needs,” Galef concluded.

State Senator William J. Larkin, Jr. (R, C – Cornwall-on-Hudson) and Assemblyman Greg Ball (R, C, I – Patterson) today were joined by Dr. John D’Ambrosio, President of the Orange County Chamber of Commerce, to unveil an official legislative letter signed by a dozen state lawmakers demanding an independent audit of the Metropolitan Transit Authority (MTA).

Larkin and Ball went a step further, to step up the heat on their fellow legislative leaders and the Governor, by unveiling a statewide petition and new website demanding that Malcolm Smith, Sheldon Silver and Governor Paterson immediately conduct an independent and forensic audit of the MTA at a press conference today.

“I believe it is absolutely ridiculous that an independent audit was not conducted prior to the approval of the state’s multibillion dollar MTA bailout. My colleagues and I in the Hudson Valley are demanding the Governor, Senate Majority Leader, and Assembly Speaker call for an audit of the MTA’s books immediately. If the Hudson Valley’s businesses, not-for-profits, hospitals and schools are going to have to pay for the errors of this historically mismanaged and wasteful authority, it is essential we are certain that the numbers being presented by the MTA are one hundred percent accurate,” said Larkin.

“If this issue is allowed to die, this tax hike is going to be the final nail in the coffin for the State of New York. Voters and taxpayers across this state must join this grassroots attempt to hold this Governor and this legislature accountable. Majority members, even those who voted ‘no’ on the floor but who were otherwise silent, need to join our fight, sign this legislative request, and demand an independent and forensic accounting of this bloated and unwieldy authority before another bailout is necessary,” stated Ball, who is the Ranking Member of the Assembly Corporations, Authorities and Commissions Committee, which has oversight of the MTA.

Signed by the entire Mid-Hudson GOP delegation, the letter requested that the Governor, Senate Majority Leader and Assembly Speaker immediately use their legislative authority to call for an independent forensic audit of the MTA’s finances. This power comes from the passage of S.5451/ A.8180, or the MTA Bailout Bill, which authorizes the legislature to conduct an independent audit of the MTA, including its subsidiaries, beginning every two years after 2009.

Additionally, the delegation announced the launch of a Web site, www.auditthemta.com, where members of the public can sign an online petition calling on the three leaders to immediately audit the MTA.

Assemblywoman Nancy Calhoun (R, C – Blooming Grove) stated, “I am pleased to be able to join my Senate and Assembly Republican colleagues in order to send a message to Governor Paterson, Senator Smith and Speaker Silver on behalf of the people in the Mid-Hudson region. The recently passed MTA bailout was nothing but a $1.8 billion gift to New York City on behalf of the state at taxpayer expense; mostly notably Hudson Valley businesses, schools, hospitals and not-for-profits. I believe an independent forensic audit of the MTA is the very least the state should do in order to prove to the residents of the Hudson Valley that they are not being used as an ATM.”

State Senator John J. Bonacic (R, I, C – Mt. Hope) said, “The MTA is nothing more than taxation without transportation for Orange County residents. Higher license and auto registration fees, along with the new payroll tax are all unfair to Hudson Valley residents and businesses. 1) BIRMINGHAM,DANIEL(Putnam County Legislator): "We are all concerned with the safety of Peekskill Hollow Road. I think we can make it a safer road without turning it into a major speedway that will ruin it's county charm".

2) ANTHONY FUSCO(Putnam County Legislator): "Andy: Thanks for considering my view.
"While the bucolic views of Putnam Valley are ones to be envied, they should never stand in the way of public safety. My understanding is that the proposed work is mildly expansive of the current footprint of Peekskill Hollow Road, and that the roadwork will bring the engineered driving surface and drainage systems up to current standards. PHR is a main thoroughfare in Putnam Valley and for the people, not only of Putnam Valley, but of Putnam County in general and beyond.

We owe it to our citizenry to do what is best for the many, sometimes at the dismay of the few. In this instance, I believe this minimally invasive work is a must, and I do support its progress."

3) SAM OLIVERIO (Putnam County Legislator): "Hi Andy, Here's my full position in a nutshell...
"I understand the opinions and concerns of the residents along Peekskill Hollow Rd. I whole-heartedly agree that widening, reshaping and otherwise altering that bucolic stretch of road would be criminal. I also strongly believe that: #1-We really do need both of the Peekskill Hollow Road bridges repaired (the State has notified us that they are in great need of work and could be red-flagged within months). #2-The turning lanes by the High School are also necessary -I work here and have personally observed 2 overturned cars (prior to the light being installed) and 7 fender benders since the light was installed. #3-Drainage by Lover's Lane and Oregon Corners must be corrected. -When 3 of my High School students and staff are injured in a span of 2 weeks this past February because of black ice on the poorly drained Lovers' Lane section of Peekskill Hollow Road, I have to state that this is more than just a bad case of poor driving.

Andy, I grew up on Peekskill Hollow Rd. (been here since 1955). My Mom still resides at Adams Corners, my brother at Tompkins Corners. I was elected, above all else, to ensure the health and safety of all of our residents (the only reason government really exists). Adams Corners north to Rt. 301 of Peekskill Hollow Road will not be touched by this project, but the safety issues mentioned above are necessary and our Federal Grant monies should be used solely to remedy those concerns. (Much better the cost being shared by all of our US neighbors then just by our County neighbors)":

4) BOB TENDY(Supervisor Putnam Valley: This is what I have to say on this project, which I support. It will not change the character of the road one bit. It will, however, make it safer. In addition, there has been talk of trying to have PHR designated as a NYS scenic byway. I support this idea as well. Making it a scenic byway will make the improvements on the road all the more necessary, will help with potential tourism--which will help the businesses. In addition, it will help us to preserve and record the historic reference points on the road and the "story" of the road over the years".

5) SAM DAVIS(former Putnam Valley Supervisor): Here you go Andy. Hope it's okay.
"Peekskill Hollow Road is one of the cherished roads of Putnam Valley. It defines the character and feel of our beautiful Town. Adding four foot shoulders on each side would destroy that, while making the road less safe. Those of us (most residents) who want to preserve the beauty and character of Peekskill Hollow Road, support necessary bridge rehabilitation (within the existing parameters), and drainage improvements where needed. I am gratified that the County has finally heard the voices of our residents, and seems to be responding appropriately. We’ll continue to be vigilant until we have a new plan in hand".

MY COMMENTS:

This is what I think. One would think that a project that would straighten out the curve at Lover's Lane, fix poor drainage that causes severe icing in the winter, fixing bridges, and would put turning lanes at the entrance to the High School would be a no brainer. Yet when ever it comes to upgrading anything in Putnam Valley there is always a group of malcontents that want Putnam Valley to be the town where time stands still. For some misguided reason they place potential though not proven environmental concerns over people's safety. They speak their obstructionism as if it were gospel. They believe their fear of what might happen should trump what is happening, especially when you read Sam Oliverio's comments.

If you listen to those opposed, you would think that those officials for the upgrade are either misinformed or lying through their teeth. Their argument is that if you disagree, you are ignorant of the facts, as they are the only keepers of eternal truth. There can be in their eyes, no honest difference of opinion. As I have lived in the area for fifty-four years, I find it interesting these are the same people who now live on paved side roads in winterized housing , where neither at one time had previously existed. It seems those changes of the bucolic and historical nature of the area is okay as long as they benefit. I would be more convinced of their historical concerns if they started ripping up the pavement and turning their homes back to summer only bungalows.

The real historical portions after Adam's Corners would not be touched. As cars are wont to break down with out notice, shoulders are a good idea, for a disabled car on the roadway itself is a lot more dangerous, especially should one break down on the Lover's Lane curve. The fact is Peekskill Hollow Road is now a main thorough fare for people entering from Mill Street or Oregon Corners. Those opposed my not like this, but it is a fact none the less. One would think that the planned upgrade would turn this road into a mini-NASCAR race way.

The monies are there for this. As Legislator Fusco stated it's "mildly expansive of the current footprint ". It is my belief that on this issue, time should not stand still.

.You supply a current Driver's License
.You supply your Social Security #
.You will submit to a physical & mental evaluation at any time of their choosing
.Each update - change or ownership through private or public sale must be reported and costs $25
- Failure to do so you automatically lose the right to own a firearm and are subject up to a year in jail.

There is a child provision clause on page 16 section 305 stating a child-access provision. Guns must be locked and inaccessible to any child under 18.

The Government would have the right to come and inspect that you are storing your gun safely away from accessibility to children and fine is punishable for up to 5 yrs. in prison.

Peekskill School Board & Budget Vote, Tuesday May 19th

Ladies and Gentlemen...I am passing this on to you because I believe next Tuesday's School Board and budget vote is extremely important.

I have known Kenny Haskins since he was very young...he and my son have been buddies since childhood. There is no question that our school board needs someone who is an independent thinker who will not automatically fall in step with what ever board members are told to do by the Superintendent. Kenny will be that type of member on the board. Over the past 4 years, school taxes in this City have risen by 38.5%...just last month, at the urging of the Superintendent, the school board voted to impose an energy tax on city residents on top of another rate increase in the school tax. It seems that other than one current Board member, there is no one on the school board who has any respect at all for those who pay taxes in Peekskill...I am confident that Kenny Haskins will bring some balance and logic to the decisions that are made by the school board.

I would also urge you to consider Marcela Bobe for the same reasons. Marcela is also a first time candidate with two children attending Peekskill schools. An attorney by trade, most of her experience for the last 13 years has been in the finance area. She has three years of experience in the treasury function of the company QSP Inc., of Chappaqua, responsible for investing up to $800 million; four years of internal audit, mostly performing operational audits, both in the U.S. and many of the company's 19 international offices; and five years as a compensation manager of one of the company's subsidiaries, with a sales organization of about 300 sales employees. As a board member, Marcela will bring her considerable financial skills and professional experience to our school board, which is in desperate need of both.

My name is Kenny Haskins and I am running for Peekskill City School District School Board. I am lifetime resident of Peekskill and graduate of the Peekskill City School system. I am also a Peekskill High School graduate class of 1987. I participated in many extracurricular activities such as Basketball, Baseball, and Football. I received an undergraduate degree in Business Administration from Mercy College in 1994. I received my Masters of Science in Learning Technology from Mercy College 2002. In December of 2008,I received my second Masters of Art Degree from the College of New Rochelle in Educational Leadership. I worked in the Peekskill City School District for 14 years so I am quite familiar with what is happening and not happening in our schools. I would like to see changes to better service our students by increasing scores and student achievement. Our students should be challenged academically. We also need more competitive extracurricular sports programs to compete with other schools and to provide more college scholarships. Too many of our young people of Peekskill are attending other public and private schools. This needs to change now! Part of the problem is the increase in school taxes and the schools itself. This was not the case when I was growing up in Peekskill. Let's get back to the culture and sense of community Peekskill stood for in the past. It is time for a change and I believe I can help in this change.

A MESSAGE FROM PUTNAM VALLEY SUPERVISOR BOB TENDY:
RE: PEEKSKILL HOLLOW ROAD:

Some residents of Putnam Valley have expressed concern about County roadwork scheduled for Peekskill Hollow Road (PHR) from Adams Corners to Oregon Corners. I would like to address some of these concerns. Factually, this is not a town project, it is a county project--and I support it.

I have seen signs and received mailings from a small group declaring themselves “Friends of Peekskill Hollow Road (FOPHR).” The signs read "RURAL YES, URBAN NO." The persons who created them (most of the organizers of “FOPHR” are members of the local Democratic Committee) have lead people to believe that some mass urbanization project is being planned. It is simply not true. However, this is an election year; and, unfortunately, some are grasping for issues, misleading people, and creating upsetment where none should exist.

Most of these signs are northeast of Adams Corners--all the way to the reservoir at 301. Yet no work is proposed on this stretch of PHR. "FOPHR” have misled people into believing that the county plans to widen all of PHR and turn it into a 4 lane, 50 MPH road. This is false. Peekskill Hollow Road is not being widened. The shoulders are being widened for better drainage and to make the road safer on some of the bad turns. There is currently very little room at some sections for a car to avoid a collision if it encounters an oncoming vehicle over the midline on a blind turn.

The project will also give us additional turn lanes at the intersection of Oregon Road and Peekskill Hollow Road. This is an urgently needed change as traffic congestion during busy hours is becoming intolerable. As we strive to attract appropriate businesses into our area, this improvement is necessary if we are to have a smooth flow of pedestrian and vehicular traffic in the area.

In addition, poorly designed drainage has made parts of PHR a nightmare in winter after a freezing rain or after a snow melt followed by a freeze. I have received many complaints about this. It can be a sheet of ice on one particular curve: traveling northeast, cars are pitched down and slide out into oncoming traffic as the road curves inward. This has happened to me on a few occasions. I travel that road daily. Unless you use the road regularly, you wouldn't understand how bad the situation is. Parents drive their children to the high school and middle school every weekday; our high school seniors and visiting students traverse this road daily. Putnam Valley doesn't need to wait for a student’s car or a bus to slide into an oncoming truck before we know portions of PHR are poorly designed.

Cavalierly, “FOPHR” have shrugged off these concerns, calling it "a cry of safety as an excuse for the project." This is also false. It's simply a fact that the road was poorly planned, and at some spots it is dangerous. From what I know of “FOPHR,” none of them visit our high school or middle school for any activities, and based on a picture of some of them in a recent newspaper article, none of them have children who attend or visit our school.

“FOPHR” have cited vague “environmental” reasons for opposing the project. Yet, the fact is that the one serious environmental problem we have had on PHR was a direct result of speed and a bad curve on an icy portion of the road. You may recall an oil truck going too fast around a bad turn on PHR about four years ago. It overturned. Thousands of gallons of oil spilled into the Peekskill Hollow Brook. Although this did not happen where the current project is planned, this is a very real danger on stretches of PHR currently considered for renovation. This roadwork will help prevent future spills such as this one.

“FOPHR” also proclaim that the project will ruin the “rural” and “historic” character of the road. In fact, no streams are being diverted or culverted; no forests are being flattened; no parking lots created. Other than de minimus drainage easements, and adjusting dangerous curves, angles and sight lines, nothing about the road is changing. Claims of “straightening” the road are absurd. Straightening the road is an impossibility--and undesirable.

I can't think of anything "historic" about the stretch of road in question. There are no historic landmarks; no homes or old barns are being knocked down; no sites of historic interest are being taken away. Just because a road is old doesn't make it "historic." The only thing "historic" about this portion of the road is that it is historically dangerous. And since when did "rural" mean we have to leave a dangerous road dangerous?

Unfortunately, people have been misled by "FOPHR." I am a “Friend of the People who Drive on Peekskill Hollow Road.” PHR is a stretch of blacktop. It is an inanimate object. I am not its “friend.” People are my friends--and their safety is more important to me than politics and a poorly designed road.

A MESSAGE FROM CANDIDATE FOR YORKTOWN COUNCIL MARK DREXEL:
RE; SCHOOL BUDGET VOTE:

In an effort to ensure that accurate information is received by all,
the Yorktown Board of Ed offers the following summary of the most
important facts concerning the fiscal 2009-10 YCSD budget:

FUNDING - On April 13th, the Board unanimously approved the 2009-10
budget with a 1.67% spending increase and a targeted tax increase of
2.60%. The decision was made based on an expected restoration in state
aid of $1.3 million and a projected loss of $800,000 in revenue.
Furthermore, the Board has authorized the use of $1.3 million from fund
balance to help offset the tax increase. However, the final tax rate
continues to be a work in progress as we continue to evaluate the nature
and extent of state and federal aid, revenue and reserves.

DECLINING ENROLLMENT - To be fiscally responsible it was necessary to
reduce positions as a means of right-sizing the district. Over the past
5 years, our student population has decreased by 325 students. As
recommended by our Administrators, this budget includes the elimination
of 22 positions or partial reduction in hours. Some of these reductions
have occurred through retirements. We, like everyone else in the
country, need to find ways to maximize our resources.

STUDENT PERFORMANCE - Student performance data between 2002 and 2006
indicated that approximately 75% of our students earned Regents
Diplomas. The Board and Administration had set a goal to improve this
rate. Over the past two years, 86% of our students have graduated with a
Regents Diploma with approximately 56% earning Advanced Designation
status. This Board and Administration continued to raise the standard.
Our progress is evident by the results of 2008 data indicating 91% of
our students attained a Regents Diploma, with 62% earning Advanced
Designation. We are pleased with this progress and know we are on the
right path, but need to continue with the evaluation of courses to
ensure the rigor and the economic efficiency of every department.

Please remember to vote May 19 at Mohansic Elementary School from 7 am
to 9pm.

BALL FIGHTS FOR VETERANS,
Announces NEW LEGISLATIVE PACKAGE

Assemblyman Greg Ball (R, C, I - Patterson) today joined with the State
Division of Veterans' Affairs Director Colonel James McDonough and members
of the bipartisan New York State Armed Forces Legislative Caucus to discuss
legislative and outreach efforts to increase services for veterans across
the state.

"With Albany divided on so many issues, it is a pleasure to see
legislators from both sides of the aisle come together in a concerted effort
to support our veterans. I am proud to join with my colleagues, Colonel
McDonough and our veterans' agencies, to enhance outreach efforts assuring
that veterans are aware and receiving the benefits and services they
deserve," said the Assemblyman, who is a member of the Assembly Veterans'
Affairs Committee and a former Air Force officer.

Ball has been an ardent advocate for veterans in the State Assembly and has
helped to move meaningful legislation, including measures which honor the
contribution of those who served in the Cold War Era, support disabled
veteran-owned businesses, and creating and extending a Veterans Property Tax
Exemption to include Korean War and War on Terror veterans. The Assemblyman
was also the original author of legislation to create a veterans' tuition
remission program: this measure was adopted into law in the 2007-08 State
Budget and offers free SUNY/CUNY tuition (or its equivalent at a private
institution) to any combat veteran. Ball is working to extend this benefit
to all veterans.

This year, Ball is sponsoring new legislation aimed specifically at
improving the quality of life for veterans and their loved ones and ensuring
better services, including legislation to help returning veterans, trained
as medics, to become gainfully employed and to provide real property
exemptions for surviving spouses of veterans. His legislation to create an
expeditionary medal for War on Terror veterans has recently picked up a
Senate sponsor, Senator Jeffrey D. Klein (D - Bronx) giving the bill support
from majority conference members in both houses.

Ball also is working with local veterans to create a new legislative package
that will create a new subset in the Division of Veterans' Affairs honoring
Atomic Veterans, or veterans who served circa the mid-1940s to mid-1960s on
classified ionized radiation projects. Public information and recognition
of these projects was severely restricted until 1996 and many projects still
remain classified, but Ball feels that these service persons deserve the
same recognition and benefits as other veterans groups. Details of the new
Atomic Veterans legislative package include:

a.. Recognizing Atomic Veterans with the creation of a New York State
Atomic Veterans Medal;

a.. Providing for the eligibility of Atomic Veterans for services and
benefits currently extended to other veterans groups, including health care
services and disability benefits;

a.. Providing benefits and services for living Atomic Veterans and
surviving spouses of deceased Atomic Veterans, including the ability for
veterans or their surviving spouses to file a compensation claim and receive
assistance therein; and

a.. Introducing a Legislative Resolution commemorating, recognizing and
honoring the "Forgotten Atomic Veterans" and their significant contribution
to the great state of New York.

*BALL, CARPENTERS, HOST 1099 FRAUD EMPLOYEE MISCLASSIFICATION PREVENTION
FORUM*

County and local elected officials participated in a forum at the Putnam
County Bureau of Emergency Services on 1099 worker misclassifications
and payroll fraud today that was hosted by Assemblyman Greg Ball (R, C,
I – Patterson) and the Empire State Regional Council of Carpenters.

According to the Governor’s Joint Task Force on Employee
Misclassification, the failure to properly classify workers as employees
costs the state millions of dollars in lost tax revenues each year. A
recent Cornell University study estimated found that worker
misclassification cost the State of New York almost four billion dollars
over a four-year period.

“This type of fraud costs taxpayers big time and is the heart and soul
of the Hudson Valley's sizeable black market economy. Some employers
have made a concerted effort to avoid their obligations, including the
payment of legal mandates such as wages and overtime, employment taxes,
and obtaining workers' compensation coverage,” Ball said. “New Yorkers
who are paying taxes are left out of work while many out of state and
undocumented workers are not treated as employees, and are thus denied
the safeguards and benefits afforded to them by the law.”

Special guest speakers at the forum included the Rockland County
District Attorney’s office, and Alexander Restiano, assistant to
Westchester County Executive Andy Spano, who discussed how the problem
of worker misclassification in New York State harms workers and
law-abiding businesses within the state, and solutions to reduce fraud
and recover lost revenue in local municipalities.

“Thousands of workers are being improperly classified as independent
contractors and others are being paid off-the-books as part of an
underground economy,” Ball added. “Some workers are even being forced to
'volunteer' their labor. In some of the most extreme instances, workers
are being transported across state borders, entirely beholden to and
dependent upon their employer for food, transportation, and lodging.
This is a serious crime, and workers have been killed in the process or
severely injured while working under-the-table.”

In addition to the very real impact of misclassification of workers,
employee misclassification adversely impacts legitimate employers in the
State who are forced to compete in the marketplace against employers who
lower their operating costs and increase their profits by misclassifying
their employees.

Ball has introduced comprehensive legislation (A6793) to address this
serious issue which would follow recommendations laid forth by the
employee misclassification task force to amend the definition of
"employee" and establish a single standard to put an end to inconsistent
worker classification among partner agencies in New York. The
legislation also lifts data sharing restrictions between the Department
of Labor and the Department of Taxation and Finance and provides access
to records and work sites, which would foster significant interagency
cooperation.
