BASIC LIBERTIES UNDER ASSAULT WHILE YOUR BACK IS TURNED

Dear Readers:

While you are being captivated with this years presidential elections and the bail-out of wall street, closer to home you have your basic liberties under assault. I do not exaggerate, two items this week underscore my assertion. One, in Putnam Valley there is discussion lead by Supervisor Bob Tendy about streamlining the process of town approval for minor improvements on your property. Two, Recently Weschester County Legislator George Oros held a press conference in which he warned that the state legislature was going to re-institute the commuter tax after the election to make up N.Y.C. 's financial shortfall of revenues due to the down turn on Wall Street. At first I was not alone in thinking George was just grandstanding. However on Friday September 26 on page two of the Daily News there was an article which stated that State Assembly leader Sheldon Silver was now in favor of this onerous tax. This is now an issue before you, the voter, in this years assembly races in the 90 & 99 districts.

According to a story in the NCN "P.V. Board splits over planning change"(09/24/08),the issue in Putnam Valley is the definition of "minor" work. If the work is deemed minor, the property owner only has to get the town engineer's permission instead of going thru the planning board process. There are examples in the proposal of what constitutes minor. Yet it seems those who wish total government control of all your actions on your property say the term is vague. This is hogwash. With the examples sited in the proposal, the term is defined. The detractors say they are concerned about the environment and the citizens as a whole. I disagree, I believe there intentions are about control. The entire premise that one has to ask permission to do even minor alterations on one's property, harkens back to the days when in elementary school one had to ask permission to go to the bathroom. How dare anyone, private citizen or elected official think they should have total say on minor work on somebody else's property in which they have no financial stake. The right to own property is fundamental to the founding of this nation. Instead of streamlining this process, I would suggest an ordinance or law that defines the term "minor" and then say that the owner need no ones permission to proceed. Everybody else can mind their own business.

As for the commuter tax, this is a direct assault on the reason we had a revolution to begin with. Taxation without representation. To give N.Y.C. the power to tax the income of non-residence is beyond the pale. Those paying taxes would have no say on how those monies are spent. There would be no accountability of those N.Y.C. elected officials in regards to those monies. You already have a Mayor who admits to a 19 million dollar slush fund to finance his preferred groups. You have a city council chairwoman who admitted to a 17 million dollar slush fund for the same reasons. These were on top of monies already earmarked. Why the heck should we have to pay for political charities that benefit only New York City residents, they after all are not paying for ours. It is imperative that we all stand behind Legislator Oros and now 90 assembly district candidate William Gouldman in stopping this now.

Middle Class Star Rebate Checks

I have been getting calls that many communities are going to ascertain how many homeowners are getting checks that owe nothing on their school taxes. I did learn that the Town of Greenburgh has 1,700 basic star homeowners that pay no school taxes and receive checks in addition to many on the enhanced star.. It is difficult for me to put a dollar value on this because I do not know how much is claimed on their tax returns.(However the state knows) Simple math indicates that it has to be anywhere from $0.00 to 2 million dollars. Basic qualifies from 0 to $1200. $1200. X 1,700 = a little over 2 million dollars. So now we know about two communities. I am awaiting for other communities to contact me.

I have been in touch with one New York State official who assures me that he will look into it and was very concerned.

Another aspect of this are the homeowners who for some reason or not fails to pay their taxes on time and get a check. In Yorktown we have homeowners who owe for many years and are getting a check. As you know the towns in Westchester must make the school districts whole. Last year we had to pay 1.6 million dollars to the school districts due to tax delinquents. I am sure many of these delinquents received a check. It is apparent that this program while a great program may need to be looked at a little more closely and perhaps we can all save more money.

Gouldman urged his opponent Assemblywoman Sandra Galef to pledge not to allow the commuter tax that was repealed in 1999. "At a time when it is increasingly harder to make ends meet, hard working commuters should not be forced to come up with an additional $500 per year in order to get to their jobs in New York City," Mr. Gouldman declared.

"Sheldon Silver, who along with Mrs. Galef is responsible for making Westchester the county with the highest property taxes in America, is trying to dig deeper into the pockets of the people living in the 90th Assembly District by returning to economic policies that have failed. Throughout this campaign, I have emphasized that we must help people get through these hard times and not add to their burden, " asserted Mr. Gouldman. "I have proposed tax credits for mass transit users and reducing the state sales tax on gasoline and asked Mrs. Galef to support these initiatives. I hope that this time she will join me in standing with the people and not fall into lock step with the wishes of Sheldon Silver and the special interests of New York City once again, "Mr. Gouldman concluded.

On Monday September 8th, Mayor Mary Foster and the Peekskill Democrats approved variances on two development projects the details of which have not yet been presented to Council members, City employees, or taxpayers. One is for a Walgreen's on the corner of Main and Broad Street, the other for an AutoZone along McGregor Brook, on the site of the old Lincoln-Mercury Dealership.

This is contrary to the long-accepted practice of the former Testa Administration of including public input at the front of the development process, as well as along every step of the way.

Council Democrats Vote Against Clean Water for Peekskill

In 2004, the City began the two year process of reviewing the environmental impact of developing abandoned industrial property on the Waterfront. Drew Claxton, and later Mary Foster, became outspoken opponents of the required State Environmental Quality Review Act (SEQRA) studies, saying that two years of study was insufficient time to determine the impact of development.

And yet, on September 8th, both Foster and Claxton accepted on blind faith a vague proposal to develop an AutoZone, with no SEQRA study, that will threaten McGregor Brook, and could have a devastatingly negative impact on Peekskill's water table.

Council Democrats Vote Against Local Businesses Who Won't Pay to Play

In 2006, when Target-Lowe's said they wanted to build stores on Louisa Street, the developer made two detailed presentations to the public during Council work sessions, and the public was allowed to comment on the proposal at yet another Council meeting. Mary Foster and Drew Claxton said this wasn't good enough, and requested that the property be put out to a formal RFP. In the name of open government and public input, the Testa Administration honored Foster and Claxton's request, despite the fact that it would delay Target-Lowe's for six months.

When no one came forward with an alternative plan, Foster and Claxton still opposed the deal solely to protect a major political contributor, N. Dain's Son's Co. Inc.

Many people argued at the time that Lowe's posed no direct threat to Dain's Lumber since Dain's customer base was largely contractors - Dain's isn't even open on the weekends - while Lowe's customer base was weekend warriors who shop most often when Dain's is closed.

Nevertheless, as soon as Foster was elected Mayor, she went out of her way to kill the Target-Lowe's deal that would bring nearly 1,000 jobs to Peekskill, and attract thousands of people who would patronize downtown businesses each week.

Foster Changes Position So She Can Hurt Mom-and-Pop Businesses

Eight months later, Foster did a remarkable about face, and totally abandoned her commitment to protect local small business owners against big national chains.

On September 22, 2008, two local pharmacists, whose businesses are directly threatened by Foster's fast-tracking of Walgreen's, came to the Council meeting and pleaded with Mayor Foster to reconsider her decision, and to apply the same logic she did when killing Target-Lowe's to protect Dain's Lumber.

Mom-and-Pop Stand Up to Foster, but She Pokes Them in the Eye

Harvey Seeley, of DeChristopher Pharmacy, came to the podium and explained why it wasn't a "sound business and community choice" to destroy small businesses who have been serving the elderly and infirm of Peekskill for decades. He also mentioned that he actively contributes to the Elks, the Rotary, the BID, the School District, and other local charities - something that Walgreen's is unlikely to do.

Mary Foster's actions said, "Dain's Lumber gave us $400. . What did you give the Democratic Party? Nothing. And now you expect us to protect you?" Foster then went on, in her signature patronizing tone, to tell Mr. Seeley that "chain stores don't compete with Mom-and-Pop businesses like yours" - the direct opposite of what she had said months ago, when citing the reason why she denounced Target-Lowe's as big box retailers who "travel in herds" and threaten local businesses like her patron N. Dain's Son's Co. Inc.

Mohammed Amin, the owner of Baxter's Pharmacy, followed Mr. Seeley at the podium, and called Mayor Foster on her blatant lie. Mr. Amin told Foster and the Council in substance that Walgreen's is a $32 billion national chain, with 6,941 locations in 49 states, the District of Columbia, Puerto Rico and Guam, which spent $355.9 million in advertising in 2007. Mr. Amin then instructed the Council that among Walgreen's tactics once they enter a small market like Peekskill, is that they hand out cash vouchers to the elderly and infirm, who are on fixed incomes and are threatened by ever-increasing taxes on every level of government. Walgreen's cynical goal, Mr. Amin stated, is to erode customer loyalty to local businesses, like DeChristopher's and Baxter's. Once Walgreen's has broken customer loyalty and succeeded in eliminating their Mom-and-Pop competitors, the elderly and infirm are forced to pay higher prices for pharmaceutical goods.

Foster blushed red at Mr. Amin's comments, and looked to Don Bennett to remind Mr. Amin that like Mr. Seeley, Mr. Amin hadn't contributed to the Democratic Party, but Dain's Lumber did, and that's why they opposed Target-Lowe's but support killing DeChristopher's and Baxter's Pharmacies. Bennett made a move to speak, but ultimately held his tongue.

The public at large is aghast at Foster's about-face.

Why did she approve the extension of the Steep Slopes Moratorium and then, on the very same night, vote to rubber-stamp waivers to every developer who didn't like the moratorium? Why did she advance projects that have not been presented to the Council? Why did she go to bat for developers who haven't even made applications to the City? Why has she excluded public input on these projects at the front of the development process? Why did she vote to create direct threats to long-standing family businesses in the Downtown, when she invoked the perceived interests of a campaign contributor to justifying killing Target-Lowe's?

And how will Council members answer for their complicity in violating every one of the promises they made to taxpayers when running for Council? Do they have a death wish? How can the Council look at our community with a straight face and not say that something is amiss?

"Foster's and the Council Majority's vote is inconsistent with every one of their campaign promises," said Peekskill Republican Chair Tim Warn. "Their hypocrisy is palpable. Foster told the public when running for Mayor that she had three decades of business experience and quote 'would never accept any deal on blind faith.' That's exactly what she's done here. It is just one more example of how Mary Foster only acts with blind faith in her narrow self-interest, and refuses to put Peekskill first."

THE DEVIL IS IN THE DETAILS

Dear Readers:

Our congressman Democrat John Hall towing the party line believes in class warfare. He believes in higher taxes for the rich, and higher oil prices to control our driving habits. This would be a great strategy if he represented an urban district. The problem is he does not. We are the rich he has voted to increase taxes on. Mass transit in this area although available, a car is still a necessity. Control is the ultimate objective of a liberal. Removing as much as possible the disposable income from people. Regulating private industry to such a degree as to make the cost of their product prohibited, private health insurance as an example, forcing us to look to the government for coverage. Also, as the recent mortgage and wall street melt down has shown, increasing governments hand into these enterprises to such a degree as to cause their collapse there-by forcing the government to take them over. Keeping the cost of gas so high as to have us rely on mass transit more and more in an effort to control our movements. These are the objectives of a liberal and John Hall is a liberal.

By voting to repeal the "Bush tax cuts for the rich", taxes will go up on incomes as low as $40,600.00 dollars. That's you. The devil you see is in the details. By raising the taxes on capital gains, this will be another blow to wall street, as if it needs another one. You, your retirement funds will be affected to a negative degree. By increasing taxes on the oil industry, your retirement fund will also be affected negatively. It also has the affect of keeping gas prices high. In fact there is now talk in congress of raising the gas tax 10 cents a gallon to make up the shortfall in monies needed to keep up the nations infrastructure. As we are driving less due to these high prices, the government is getting less in taxes. This is our congressman's answer to higher energy cost, higher taxes.

In a cynical ploy, just in time for elections, he has voted for the house's so called energy bill that they say allows for some off shore drilling. This way he can campaign on a platform saying he has voted for more drilling. The truth is that this new bill, actually allows oil companies to drill were there is no oil. It gives states the power to decide to allow drilling. It takes any royalties away from the state in an effort to make it less likely states will allow any drilling as it would not be in their interest to do so. Details, details, you must read the fine print. The truth is, congress has now adjourned so they can campaign for re-election. The senate will not take up this bill till after the election. There will be no more action on high energy prices till after the election. Their campaigns are more important than you fiscal suffering.

When Bush first took office in January 2001, the fourth quarter earnings for the year 2000 was minus .04%. The dot-come bubble had burst and we were headed into a recession. The Democrats blamed this recession on Bush, even though by that time(March 2001) Bush had been in office for two months. Well congress has controlled the purse strings for two years, yet they would like you to still believe the Republicans are in control and our fiscal woes are their fault. All this talk of deficit can now be laid at the feet of a Democrat controlled congress. Our debt is now $9.7 trillion dollars, they have increased it. Interest on this debt is $431 billion dollars, they have done nothing to decrease it. National defense, which they would have you believe is the cause of this fiscal mess is 20.5% of our budget. Social spending which they have increased and promise to increase more is 54%. John Hall has been part of this.

It will be your taxes he will raise to pay for these future expenses. Our gas prices will continue to stay high due to his votes to keep costs and taxes high. You will have less disposable income for the nicer things in life you enjoy should you send him back to congress. If he so is bent on class warfare, let him move to an urban area and represent them. How ever being that it's our pockets that will be picked, I think it is time to have a representative who will protect our interests. I suggest you pay attention to Republican candidate Kieran Lalor and his platform. This is not the time to vote party label if it not in your financial interest. Look at both platforms, read the fine print. Don't just decide on sound bites. I have done my research. Take time out of your busy schedule, do your own. It is not a crime to vote your self interest. Do not let talking heads, politicians and friends make you think otherwise. Believe me in the end all those people will do the same.

Star & School Taxes 2008

There are two aides given by New York State to property home owners in the Town of Yorktown. First is the (STAR) School Tax Assessment Reduction which lowers your taxable assessments in your school bills mailed out September 1, 2008. As we all found out with the tax bills this year that the State Legislature and the which the Governor signed in its budget reduced the amount of STAR assessment received by all taxpayers approximately 5 %. In Yorktown it amounted to 10% of both basic and the enhanced (65 yrs old and makes less than $73,000). The average dollar lost in Yorktown for basic was $185.00 and for the enhanced up to $376.00. So what one thought his school tax increase was turned out to be more because the State reduced its share. Several town in Westchester County did not know of this reduction and sent out the wrong bills. They are in the process of correcting this. In fact one municipality has thanked me for bringing this to their attention and are in the process of correcting the bills.

The second is the School Tax Rebate Program which for this year remained the same amounts for income brackets as last year except for those in the enhanced category mentioned above. The enhanced does not have income brackets and was in fact increased 40% and in Yorktown the average is $1300.

Our assessor reported to me that in Yorktown there are approximately 10,000 homeowners eligible for step one and two of above aides. They qualify for either the basic or enhanced star program and rebate. 16% or 1600 are in the enhanced star and qualify for the average check of $1300 for the step 2 rebate program. Of this 1600 approximately 672 or 42% pay no school tax by virtue of step one the School Tax Assessment Reduction. However they will receive the $1300. check. The remaining 48% or 928 homeowners will pay school taxes ranging from below or more than $1300. They will all get $1300. each. The total for those who pay nothing and get $1300. is $873,600. This money could of been used to off set the other 9,326 homeowners and or at least the 48% (928) other seniors who paid school taxes.

This is what occurred in Yorktown. How this reflects on other communities I can not ascertain at this time but in many cases it may be similar.

John McCain is down only five percentage points to Barack Obama in New York, as Obama’s lead in the heavily blue state continues to decline, a Siena College poll today shows.

Seven weeks until Election Day, Obama leads McCain 46 percent to 41 percent among likely voters

Obama’s lead in New York has steadily declined, according to Siena. He led by eight percentage points in August, 13 points in July and 18 points in June, when he led 51-33 percent.

On six questions concerning current events – the economy, Iraq, terrorism, health care, America’s position in the world, and education – likely voters believe Obama will do a better job on four of them.

Yet on the six attributes voters often look at in choosing a candidate – compassion, patriotism, experience, intelligence, integrity, and leadership – New York’s voters give the edge to McCain on four of them.

“Although New York has long been regarded as a ‘safe’ state for the Democrats in presidential politics, likely voters in the Empire State are currently only giving Senator Obama a five-point cushion,” said Steven Greenberg, spokesman for Siena. “The conventions are over. The running mates are set. And as voters begin to focus on the race, New York’s overwhelming Democratic enrollment advantage is not reflected in how voters tell Siena they plan to vote.”

The poll also brought other good news for Republicans in New York, who are trying to retain control of the state Senate. New York likely voters are evenly divided 44 percent to 44 percent on whether they want to see Republicans continue to control the state Senate or have the Democrats take control for the first time since 1965.

Gov. David Paterson’s approval rating remains strong at 59 percent, but the poll found him losing in 2010 to New York City Mayor Michael Bloomberg by five percentage points and beats former New York City Mayor Rudy Giuliani by 10 points.

THE PERCEPTION OF NON-AGRESSION

Dear Readers:

There comes a time when it becomes apparent that a politician bent on self preservation no matter how nice a person or what they have done in the past must be retired into the private sector. They have hit the point where they believe any sacrifice of public and/or party good is necessary because in the big picture they are necessary. In fact they believe themselves to be indispensable. They get so use to the trappings of power, the ability to spend other peoples money on causes so they do not have to spend theirs, the ability to make laws that control the lives of others, they will not risk losing this. They have become entrenched. They will not take political risk as not to offend the friendships they have made within the ruling class. They form allegiances with each other.

Though not official, there is almost a perceived non-aggression pact where they won't endorse an a candidate of their party against a fellow member of this ruling class. You saw an example last year when Assemblywoman Galef would not endorse any Democrat ticket that had Dominec Volpe vs. George Oros for County Legislator. This friendship superceded party or people. This was at a time when the county Democrats desparately wanted that seat to cement a veto proof majority in the county legislature. Assemblywoman Sandra Galef sat this out on the sidelines, angering many, particularly in the Peekskill Democrat party. Another example was two years ago when Democrat County Legislator Mike Kaplowitz challenged Republican State Senator Vincent Leibell, she sat that one out also, again when the Democrats wanted that seat for party control of the state senate. This year they sent out a joint mailer together.

You see the perception of perceived non-aggression in the present race between Republican William Gouldman and Democrat Sandra Galef for the 90 assembly district. County Legislator George Oros is sitting this out on the sidelines. With the condition of our present state financial picture of which the Assemblywoman with her votes has been part and parcel, there are ample reasons to argue that a change is necessary. In any other situation, Republicans would unite behind their candidate campaigning, contributing and raising monies to defeat the incumbent Democrat. You have her inaction in helping keep the Workman's Compensation building in Peekskill. You have her yes vote on the present state budget that changed the star program formula where-bye people (many of them seniors) have found they have to pay higher school taxes then they were lead to believe. You have her yes vote on increasing taxes on people in the higher tax bracket, those people who create jobs and spur investment, as the assembly's answer to the downturn in the state's financial picture during last months emergency secession called by Governor Patterson.

These three issues alone, and we haven't even discussed the unfunded mandates she has voted for, should be fodder for a serious challenge to the assemblywoman by the Republicans. Speaking of unfunded mandates, these are the same "unfunded's" that our county legislature say are the reason their hands are tied when formulating the county budget. Yet the leading Republicans in this district (Legislator Oros and State Senator Leibell) sit this one out. So you see the perception of perceived non-aggression.

Also in interesting sideline is that in the fight for the 99 Assembly district between Republican Greg Ball and Democrat John Degnan, you have the same leading Republicans helping the Democrat. Senator Leibel's active support during the primary(Degnan had the Democrat endorsement also) and Legislator Oros' sitting on the sidelines. This is in spite of the overwhelming support for Assemblyman Ball by Republican voters in the recent primary. Two assembly districts that overlap the districts of leading elected Republican lawmakers and those lawmakers are not trying to help the Republican win.

Should the Democrats win the 90 and 99 assembly districts, I submit much blame can be laid at the feet of our leading elected Republicans. If this does become the year of the Democrats, and this includes our congressional race between Republican Kerian Lalor and incumbent Democrat John Hall, it is a self-fulfilling prophecy. Our leading elected Republicans should be a leading force in orchestrating fundraiser's to help their fellow Republicans get their message out to the public. On their records, on their votes, on the fiscal woes that face the state and federal government, this does not have to be the year of the Democrat.

On that day, Peekskill will be one of the river towns participating in the annual Ferry Go Round event that brings visitors via ferry from town to town to enjoy the venues they offer (don't forget the "Taste of Peekskill" event, and come hungry!).
For your entertainment we'll be playing jazz at the Pier while you wait for the next ferry. This Sunday, I'll once again feature Rahn Burton on the keys, Lester Harper on bass, and Jeff Whalen on sax. We'll be playing many of your favorite standards, and, as always some surprises.

Darren Rigger Selected to Participate in International Exchange to Venezuela
Political Study Program to Focus on Citizen Diplomacy

WASHINGTON, September 4, 2008 – Darren Rigger has been selected by The American Council of Young Political Leaders (ACYPL) as a delegate to Venezuela for a 10 day political exchange program beginning on September 19, 2008. He will join 6 other young political and policy leaders from across the United States to study Venezuela’s political system, engage in dialogue on international issues, and forge professional relationships and friendships.



“ACYPL has the unique mission of proving select young leaders with an opportunity to travel internationally and engage firsthand in public diplomacy”, said ACYPL Chief Executive Officer Linda Rotunno. “Our delegates have access to key leaders in the nations they visit. They engage in dialogue on sensitive issues, gain a unique perspective on the country’s politics and its relations with the US, and, most importantly, forge professional relationships and friendships that can last a lifetime.”



Darren Rigger is the Chairman of the Peekskill Democratic City Committee, serves on the Westchester County Democratic Committee and works for both Congressman Charles Rangel and Hudson Valley Congressman John Hall. He will join other delegates, each between the age of 25 and 40, in Washington, D.C. for briefings by the U.S. Department of State and other Venezuela experts before flying to Caracas. The program will provide the delegates opportunities to travel within the country, and to interact with key national and local leaders, business representatives, and civic and community groups. Rigger also has a degree in International Diplomacy from the Georgetown University School of Foreign Service.



“I am honored to have been selected to participate in this ACYPL exchange to Venezuela,” said Rigger. “This will be an excellent opportunity for me to learn about the current political and social dynamics there and help the Venezuelan people better understand the United States.”

In honor of the beginning of football season and the 'renewed' NY Jets under Brett Favre I thought this photo would be appropriate. The NY Titans became the NY Jets in 1963 when owner David "Sonny" Werblin moved the team's training facility to Peekskill Military Academy. They remained in Peekskill until 1968 leaving just months before winning the Super Bowl. This photo was taken on what is now Torpy Field. Notice Hudson Avenue and the Administration Building in the background. This was a World Wide Photo taken in July of 1966. The original caption read:

On Sunday August 24, 2008 the members of the Centennial Hose Fire Company in Peekskill gathered for a short memorial service to honor the history, memories and accomplishments of the Centennial Hose Company. Just a few days earlier, on August 21st, the original Centennial Hose Firehouse collapsed as it was being readied for its move to a new location with plans for its restoration. I was proud to be a part of the memorial service and want to thank the members of Centennial Hose both past and present (including my Grandfather Louis Testa, a member of the company until his death in 1918) for including me in this tribute and for their unselfish dedication to Peekskill.
